HomeMy WebLinkAbout007-6-04LAND USE AND DEVELOPMENT COMMISSION July 6, 2004 Minutes of the regular meeting of the Land Use and Development Commission held at Chubbuck City Offices, 5160 Yellowstone, July 6, 2004. Present: Chairman Pete Anderson; Commission Members: Michelle Christy, Jason Mendenhall, DeLoy Stuart, Mary Harker, Lee Merrill; City Staff. Larry Kohntopp; Attorney Tom Holmes, and Secretary Myrna Crapo Chairman Anderson called the meeting to order at 7:00 p.m. Chairman Anderson asked if any member of the Commission had a conflict of interest. There was none. Chairman Anderson asked for approval of the minutes of June 1, 2004. Jason Mendenhall moved to approve the minutes as mailed, Lee Merrill seconded; all voted in favor. PUBLIC HEARING: 1. An application by Parker -John, 697 E. 1600 N. Idaho falls, Idaho 83402 for a Conditional Use Permit for zero -lot line and a Designated Geographic Area for 5580 and 5590 Sample Way. Property is zoned Limited Residential 9-2). Willard Price, 697 E. 1600 N. Idaho Falls, they initially did 16 lots in the front and an additional 16 and are contemplating a third and fourth division. They have a developer that wants n to build twin homes on these two lots. The lot is lower than Siphon road, so they will have the bedrooms on the upper level. The corner lot is 105 X 97 the second lot is 90 X 97. The footage is 1100 square feet for each home. Access would be onto Sample Way. They will be individually owned. Hugh Hatch, 345 W. Siphon, he owns three acres next to them. He is concerned with the lots being sold about who owned a strip of ground between his property and this subdivision. These two lots back up to his home. He doesn't wants four homes that close and feels it is imposing on those already there. DaMaugh Tubbs 5570 Sample Way, he will be next to these buildings. They only want two homes and not four on that property. There will only be one entry way. Bill Andreason, 402 Garden Oakes Circle, he supports the two previous speakers and has a concern with increase traffic and automobiles. The public hearing was closing. Willard Price: The 15' gap between the properties is owned by Hugh Hatch. The Commission discussed: 1. Designating a geographic area. 2. Conditional use permit to cluster them. Jason Mendenhall moved to make the boundaries of the geographic area to encompass Garden Oaks one and two subdivision. Mary Harker seconded: Roll call vote: Michelle Christy, yes; Jason Mendenhall, yes; DeLoy Stuart, yes; Mary Harker, yes; Lee Merrill, yes; Pete Anderson, yes. Land Use and Development Commission July 6, 2004 Page 2 The commission discussed: 1. Only one crossing 2. Not enough room to put two homes. 3. Combining the lots together would make one nice duplex 4. Concern on parking and traffic 5. Neighbors not knowing when they bought their homes that two twin homes would be put there. 6. If it needs to be re- plated 7. It is a four -Plex; according to the design drawn by Mr. Price. Willard Price they want to do a zero lot line to create a buffer between Siphon Road. Jason Mendenhall moved to deny the conditional use permit for clustering. Deloy Stuart seconded. Roll call vote: Michelle Christy, yes; Jason Mendenhall, yes; Deloy Stuart, yes; Mary Harker, yes; Lee Merrill, yes; Pete Anderson, yes. 2. An application by the City of Chubbuck to amend ordinance 18.12.030(2)(k) adding a daycare to clarify that a day care may be a major home occupation. The meeting was opened for a public hearing. Hugh Hatch, 345 W. Siphon, they have a day care on Yellowstone that is closed down. He wanted an explanation of what this change would do. The public hearing was closed and brought back to the committion for discussion. Lee Merrill moved to recommend to the City Council approval of the application by the City of Chubbuck to amend ordinance 18.12.030(2)(A) adding a daycare to clarify that a day care may be a major home occupation. Michelle Christy, seconded. Roll call vote: Michelle Christy, yes; Jason Mendenhall, yes; DeLoy Stuart, yes; Mary Harker, yes; Lee Merrill, yes; Pete Anderson, yes. GENERAL BUSINESS: 3. Discussion of a change in Chubbuck Municipal Code; amending section 18.12.020 (c) to lessen required buffer to a residential lot where the non residential use is a permitted use in a Limited Commercial (C -1) zone. Attorney Tom Homes told the commission that this had already been approved by the city council. We don't need to do anything. ,. Jason Mendenhall moved to adjourn at 8:00 p.n Myrna , secretary
