HomeMy WebLinkAbout006-1-04n LAND USE AND DEVELOPMENT COMMISSION June 1, 2004 Minutes of the regular meeting of the Land Use and Development Commission held at Chubbuck City Offices, 5160 Yellowstone, June 1, 2004. Present: Chairman Pete Anderson; Commission Members: Gayle Anderson, Michelle Christy, Mary Harker, DeLoy Stuart, Jason Mendenhall, Lee Merrill ; City Staff. Larry Kohntopp, Steve Smart; Attorney Tom Holmes, and Secretary Myrna Crapo Chairman Anderson called the meeting to order at 7:00 p.m. Chairman Anderson asked if any member of the Commission had a conflict of interest. Michelle Christy stated she had a conflict of interest with item 1 on the agenda. Chairman Anderson asked for approval of the minutes of May 4, 2004. Lee Merrill moved to approve the minutes as mailed, Gayle Anderson, seconded; all voted in favor. 1. An application by Michelle Christy, 195 Jacob, Chubbuck, Idaho, 83202 for a Conditional Use Permit for a daycare at 195 Jacob. Property is zoned Limited Residential R -2). n Michelle Christy: the children are allowed only in the back yard to play. She has a 6' privacy fence in the back and parking in front of her house. She has 12 to 13 children at her day care on an average . Chairman Anderson for the record stated that we had received a petition signed by 14 individuals and 9 letters all in favor of the application. Mary Ann Hansen, 260 Noah, her 4 years old son goes to Michelle Christy. She hasn't seen any negative impact on Jacob Street. She would like to have the day care. Trena Hall, 5134 Redfish, she live by her in her previous neighborhood and she was a wonderful neighbor. They enjoyed having her there in the area. She would like the application approved Mark Peck, 4657 Sawtooth, three of their children have been taken care of by Michelle. She is a good babysitter. They would like us to accept the application for the conditional use permit. Richard Romriell, 5764 Eden, his deck is about 25' from where the children play. The noise factor during the spring, when the children are outside will be loud. There is limited parking and it increases the traffic. The valuation to his property will be affected. n n Land Use and Development Commission June 1, 2004 Page 2 Tammy Williams 181 Jacob, she is the next door neighbor, and has never been able to hear the children in her back yard. There is not a traffic problem. It provides a safety for the children in the area. Michelle Christy, 195 Jacob she wanted to buy a home in a family neighborhood and when she was buying her home people in the neighborhood were excited. She chose the neighborhood because it is family oriented. Counting her own children she should have 13 kids. The meeting was brought back to the commission for discussion. The commission discussed: 1. How many children she has at one time. 2. 17 of the neighbors signing the petition 3. Limiting the number of children to 12 besides her own 4. Traffic concerns Mary Harker moved that we approve the application of Michelle Christy of 195 Jacob to operate a day care center with the standard requirements as found in her license and is approved in other day centers in her neighborhood and that we limit it to the standard of 12 children besides her own. Lee Merrill seconded. Roll call vote: Gayle Anderson, yes; Mary Harker, yes; DeLoy Stuart, no; Jason Mendenhall, yes; Lee Merrill, yes; Pete Anderson, yes. 2. An application by South East Idaho Development, Inc. 1754 Cottage, Pocatello, ID 83201 for a change of Land Use District from Agricultural (A) to Single Family Residential R -1). The property is located north of I -86 and west of I -15; east of Mountain Park and Mount Lake Terrace Subdivision; 900 -1100 block of East Chubbuck Road. Dan Long, 460 Lincoln Suite C, American Falls, This land was agricultural but it is difficult to farm because of drainage problem. Mary's Park will be extended. The meeting was opened for public comment. Dennis Olsen, 855 Washburn, has concerns about the traffic. Mary's park is very popular with a lot of kids using it. He is concerned with the traffic during the construction. Ingress and egress into Mountain park subdivision, a traffic issue is developing on Hiline Road. It will be a real traffic problem in the future. The road past their home will become a major highway. Klay Wagner, 766 Washburn, does the zoning allowing them to build the street across the ravine. The public hearing was closed and brought back to the commission. n Land Use and Development Commission June 1, 2004 Page 3 Jason Mendenhall, moved to recommend to the city council approval of the application by South East Idaho Development, Inc. 1754 Cottage, Pocatello, ID 83201 for a change of Land Use District from Agricultural (A) to Single Family Residential R -1. Property located north of I- 86 and west of I -15; east of Mountain Park and Mount Lake Terrace Subdivision; 900 -1100 block of East Chubbuck Road. Mary Harker, seconded. Roll Call Vote: Gayle Anderson, yes; Michelle Christy, yes; Mary Harker, yes; DeLoy Stuart, yes; Jason Mendenhall, yes; Lee Merrill, yes; Pete Anderson, yes. 3.An application by S & T, 1754 Cottage, Pocatello, ID 83202 for a Preliminary Plat for Hartland Estates. Property is located north of I -86 and west of I -15; east of Mountain Park and Mount Lake Terrace Subdivision; 900 -1100 block of East Chubbuck Road. Dan Long, Snake River Survey, 460 Lincoln Suite C, American Falls, 110 lots which will have city water and sewer, the street will be hooked onto Mountain Park Street and Brundage. Most of the traffic will be carried out to Chubbuck Road. Simplot has a slurry line on interstate 86, and will physicall stake the slurry line. It will not effect any of the building lots. The lots are comparable to the subdivisions in the area. There will be no twin homes in the subdivision. Sacajawa Road will be a gradual slope and tilted slightly to the downhill side. Lots 17 -23 in block 6 have a buildable area on them. The meeting was opened for public comment Morris Kinghorn, 4470 Wasatch, He is not oppose to the subdivision, but is concerned about the quality of the house to be built there. He is concerns about the value of the property. and the square footage of the houses. Brent Buck, 887 E. Mountain Park, asked what would be done with the steep gully. Linda Marley, 4492 Sawtell, the egree into and out of the subdivision, is a problem for her. The park is heavly used by the children. With the traffic going out onto Hiline, it will generate a lot of traffic going off of the hill every morning. Christa Winn, 4486 Wasatch, she doesn't want the area to look like the Satterfield Subdivision with the traffic problem. Her children play a lot in the park. LaDawn Anderson, 834 E. Mountain park, her sons ride their bikes all the time. When cars are coming down E. Mountain Park and Washburn the sun is in their eyes, and several kids have almost gotten hit. She would like to see another exit onto Chubbuck instead of Washburn. Emily Evans, 829 Washburn, she agrees with the previous people. She is concerned about Washburn traffic, people drive fast past there. Her children catch the bus where Washburn comes down. She likes using Chubbuck Road as an access. She is concerned for her children both in winter and in the summer. The traffic will increase. 01-1.1 Land Use and Development Commission June 1, 2004 Page4 Dan Christensen, 867Washburn, the extension of Mary's park will bring in that many more people. He is opposed to Washburn being extended into the subdivision. Klay Wagner, 766 Washburn he is concerned about the extra traffic down Washburn, and would like the extension out of the subdivision put somewhere else. Too much traffic will be generated causing a safety problem. Janae Johnson, 841 Washburn lives across from Mary's park and is opposed to the subdivision. This subdivision empties out onto Mountain Park and Hiline. The safety issues are a concern. The public hearing was closed: Dan Long, they are willing to put some speed bumps there to slow traffic at the park. They want a minimum of 1300 sq feet homes in the area. The development will be done in three phases. The commission discussed: 1. Moving Sacajawea Drive down by Mary's park. Ken Pape, 1754 Cottage, Southeast Idaho development, explained why they had started the crossing without the approval of the preliminary plat and discussed the cost of moving the road. The commission discussed: 1. Putting speed bumps 2. Putting Stiped Road and Sacajawea Road in the 1" phase. 3. The request by the state for sound barriers 4. Moving Sacajawea down to the park 5. Completion of Hiline Road 6. Paving of road Deloy Stuart moved to recommend to the City Council approval of the plat map for the Hartland Estate application by South East Idaho Development 1754 Cottage, Pocatello, Idaho with the condition that the phase closest to Chubbuck Road either be completed first or that the roads Stripe and Sacajawea be finished and developed which ever phase is done first at that time to Chubbuck Road and that speed bumps be place in front of Mary's park on both Brundage and Washburn. Gayle Anderson seconded. Roll call vote: Gayle Anderson, yes; Michelle Christy, yes; Mary Harker, yes; DeLoy Stuart, yes; Jason Mendenhall; Lee Merrill, yes; Pete Anderson, no. GENERAL BUSINESS: 4. Discussion on an ordinance adding a daycare to section 18.12.030 (2) (k) of the Chubbuck Municipal code to clarify that a day care may be a major home occupation. Land Use and Development Commission June 1, 2004 Page 5 The Commission discussed: 1. Fees charges on Day care because only 1 person refused to sign. Jason Mendenhall moved to take the amendments to 18.12.030 to ublic hearing. Gayle Anderson seconded. All voted in favor. Jason Mendenhall moved to adjourn at 8:45 p.m. with el s onding.
