HomeMy WebLinkAbout005-4-04LAND USE AND DEVELOPMENT COMMISSION May 4, 2004 Minutes of the regular session of the Land Use and Development Commission held at Chubbuck City Offices, 5160 Yellowstone, May 4, 2004. Present: Chairman Pete Anderson; Commission Members: DeLoy Stuart, Mary Harker, Jason Mendenhall, Michelle Christy, Ray Rosen, Lee Merrill; City Staff. Steve Smart, Larry Kohntopp, Attorney, Tom Holmes; and Secretary Myrna Crapo Chairman Anderson called the meeting to order at 7:00 p.m. Chairman Anderson asked if any member of the Commission had a conflict of interest. There was none. Chairman Anderson asked for approval of the minutes of April 6, 2004. Jason Mendenhall moved to approve the minutes as mailed with the corrections handled out at the meeting, Mary Harker seconded; all voted in favor. PUBLIC HEARING: 1. An application by Keith Rasmussen - Rasmussen properties, 1396 Satterfield Drive, Pocatello, Id, 83201, for a Planned Unit Development, (PUD), together with its Preliminary Development Plan. Property is located at Briscoe Road adjacent to 159 Belva Lane and 219 Briscoe. Property is presently zoned Limited Residential (R -2). Keith Rasmussen, 1396 Satterfield Drive, there is enough room for eight parking spaces. They are all handicapped individuals, and are required to have a five year lease with them. The road is now 18'; 42' from front of the house to the fence line. The commission discussed: 1. The people will have disabilities and will require a special handicapped space for parking. Two renters will be wheelchair bound. 2. Lot three is an existing home. 3. There will be two occupants per unit. 4. The residents will be referred by the agencies here in town. 5. The map shows the survey line which included the property fences 6. Concern for the density of the area and parking spaces 7. Designating a 5`' parking space for visitors parking Jason Mendenhall moved that we recommend to the City Council approval of the application by Keith Rasmussen - Rasmussen properties, 1396 Satterfield Drive, Pocatello, Idaho for a Planned Unit Development, (PUD), together with its Preliminary Development Plan. Property is presently zoned Limited Residential (R -2) with the following two conditions: 1- the north south corridor be made 20' 2. That there be additional parking space for visitors on the property. Ray Rosen seconded the motion. Roll call vote: Ray Rosen, yes; Mary Harker, yes; Lee Merrill, yes; Michelle Christy, yes; Deloy Stuart; yes, Jason Mendenhall, yes; Pete Anderson, yes. 2. Property is located at Briscoe Road adjacent to 159 Belva Lane and 219 Briscoe. Property is presently zoned Limited Residential (R -2). Larry Kohntopp: Access lanes definition were presented. No where does it say we have to have two way traffic. The 20' comes from the fire department. The commission questioned if the 20' access is acceptable. Chairman Anderson opened the meeting for public comments. Lisa Smith, 210 Briscoe, questioned the access on the side of the roadway off of Briscoe. 20' is not enough. People park on Briscoe because they can't park on their property. 6" of the property line on the fences with the Whited belonged to this property and would bring it up to 18'. Children darts out between the trucks and now play in the street. Don Curtis, 224 Briscoe Road, from the geographic area discussion prior by the Land Use it was his understanding they were allowing no more that two in the area. The kids will have no place to play with only 25' narrow road with kids in it. There will be a lot of traffic. The kids needs a place to play. Ray Coles, 227 Briscoe Road, People can't drive up to the mail box and pull out. We need parking places to park off of the road. We need to take care of things as they are now. Ardith Whited, 207 Briscoe Road, duplex's on the west side of her, they have a business that they run out of their home and kids will want to play on their equipment. She would like a privacy fence and want's a guarantee of a fence. Jackie Wallace, 159 Belva, police were called on her as she was blocking the right -of -way to his property. The garbage truck backs down Belva Lane. Her house adjoing his property. The hitch on her trailer is out to the 25'. She almost had a head collision today. The area already has a lot of traffic. Land Use and Development May 4, 2004 Page 3 Paul Sorenson, 147 Belva, traffic is a huge concern it is a blind corner being only 16' wide there. There is a home at sector lot 3 on a part foundation and the front door is 9' away from the road. The blind corner sometimes make you have to come to a complete stop. It is a cramped little area. If this does go through please put some speed bumps there. Andrew Hubbard, 5959 Ruth, the existing road is 17 to 18 Meet. There is 42' from the fence of Whited to the front of the existing building. They can make the road 20' wide. The driveway is currently 25' deep. The majority of people on Briscoe park on the road in front of their houses. Don Curtis, 224 Briscoe, Make the lots on the right a little larger and put a park in the corner. Keith Rasmussen, the requirements were set by the city and those requirements were met. The commission discussed: 1. The designated geographic area was for a different zoning and the 10% doesn't apply to PUD.'s 2. We need to consider the kids 3. Parents need to have the intelligence not to rent a one bedroom unit n 4. Designating a play area in the plat 5. Speed bumps 6. One way traffic 7. No parking on Belva Lane 8. Don't connect the two roads Ray Rosen moved that we recommend approval to the City Council of the preliminary plat by Keith Rasmussen - Rasmussen properties, 1396 Satterfield Drive, Pocatello, ID for a preliminary plat. Property is located at Briscoe Road adjacent to 159 Belva Lane and 219 Briscoe. Property is presently zoned Limited Residential (R -2). Motion dies for lack of a second. Jason Mendenhall moved to recommend approval of this application to the city council by Keith Rasmussen - Rasmussen Properties, 1396 Satterfield Drive, Pocatello, Idaho, 83201 for a preliminary plat. Property is located at Briscoe Road adjacent to 159 Belva Lane and 219 Briscoe. Property is presently zoned Limited Residential with the condition that speed bumps be place in the section of the road that is for this development with approval of the city staff. Mary Harker seconded. Roll call vote: Ray Rosen, yes; Mary Harker, yes; Lee Merrill yes; Michelle Christy, no; DeLoy Stuart, yes; Jason Mendenhall, yes; Pete Anderson, yes. 3 An ordinance clarifying the interests of a Limited Commercial (C -1) zoning classification; amending the schedule of General controls for Land Use Districts in Limited Commercial (C -1) Districts; amending section 18.12.020 (C) to lessen the required buffer to a residential lot where the nonresidential use is a permitted use in a limited commercial (0-1) zone. .� Land Use and Development May 4, 2004 Page 4 The public hearing was opened for public comment. There was no public comment so it was closed and brought back to the commission. Mary Harker moved to recommend to the city council to acceptance the ordinance 18.12.020 to lessen the required buffer to a residential lot where the nonresidential use is a permitted use in a limited commercial (C -1) zone and that the revised list be accepted. Lee Merrill seconded. Roll call vote: Ray Rosen, yes; Mary Harker, yes; Lee Merrill, yes; Michelle Christy, yes; DeLoy Stuart, yes; Jason Mendenhall, yes; Pete Anderson, yes. GENERAL BUSINESS: 4. Discussion of a proposed county subdivision in the area of city impact. Sunset West Subdivison located Philbin and West Chubbuck. Steve Smart informed the commission that the developer made a proposal to the county and the county has asked for the city's input. This property desires city water and sewer. Sewer is available on Siphon Road. Gene Hancock, presented a revised drawing. They have backed off from the corner 100'. The entrance into the church on the south is 300' and the other 600'. They are trying to construct the streets so they are not a speedway. The commission discussed: 1. The walking path layout is in the northern portion of the development and is not tied to Church property and or into the southwest corner. 2. Commercial area will not be included 3. They would like to put a school in the north portion 4. Commission suggested that they look at using gray water into the lots along with the city water 5. Conforming with our city standards 6. House numbering conforming with cities addresses. 7. Be developmed in accopance with our subdivision ordinance. 8. The city wants collector and arterial streets designated. 9. Moving the church site away from the intersection and being accessed from a inner street. 10. Minor arterial and collector are lined up where we would like them. 11. High back curbs 12.
