Minutes of the regular session of the Land Use and Development Commission held at Chubbuck City
Offices, 5160 Yellowstone March 2, 2004.
Present: Chairman Pete Anderson; Commission Members: Michelle Miller, Gail Anderson, Lee
Merrill, Deloy Stuart, Ray Rosen, Mary Harker; City Staff. Steve Smart, Sean Harris Secretary Myrna
Crapo
Chairman Anderson called the meeting to order at 7:00 p.m.
Chairman Anderson asked for approval of the minutes of February 3, 2004; Ray Rosen moved to
approve the minutes, Gayle Anderson seconded; all voted in favor.
Chairman Anderson asked if any member of the Commission had a conflict of interest. There was
none.
PUBLIC HEARING:
1.An application by Charlie Frasure, 102 Laurel Lane, Chubbuck ID 83202 for a Preliminary
Plat for Frasure Industrial Park, 2 ° addition. Property is located north of 5048 Rainbow.
Brad Frasure, 2767 Wildhorse Ridge they are adding 10 more lots to finish the project off.
The meeting was opened for public comment. There was none so the public hearing was
closed and brought back to the commission for discussion and a motion.
The commission discussed:
1. How clean the project has looked.
Gayle Anderson, moved to recommend to the city council that they accept the application by Charlie
Frasure, 102 Laurel Lane for a Preliminary Plat for Frasure Industrial Park, 2r addition. Property is
located north of 5048 Rainbow. Michelle Miller seconded. Roll call vote: Michelle Miller, yes; Gail
Anderson, yes; Lee Merrill, yes: Deloy Stuart, yes: Ray Rosen, yes; Jason Mendenhall, yes; Pete
Anderson, yes.
2. An application by Dustin Morrison, 4755 Heidi Court, Chubbuck ID 83202 for a
Preliminary Plat for Taylor Bean Estates. Property is located at end of Briscoe Road and
Sample Way.
The Commission discussed:
1. Briscoe crossing onto Hawthorne being in the master plan

Brian Flynn, Rocky Mountain Survey, the development will be developed in 4 phases. They feel that
there is plenty of inlets and outlets without the Hawthorne extension. The public can use the park at
Stuart as it is close.
The meeting was opened for public comment.
Neil Matthewson, 422 Mindy Lane, They would like Lori blocked off. He would like to see a park in
the one corner. He asked what kinds of houses would be going in there.
Kathy Waller, 5375 Stuart, They moved into the neighborhood recently and is concerned with this
development. She would like to see the park.
Phil Quinton, 5372 Lori Lane, they were told that there would be a park put there.
Pete Boll 5377 Lori Lane. When they moved into the subdivision they were told there would be a park
there. The people living up by Siphon Road will not be going to Stuart Park. It will not be safe for the
e-11N children to walk. They need traffic regulated in the subdivision and long streets encourage cars to
speed. He is a policeman with City of Pocatello. It would take constant reenforcement to keep the
speed down. A significant amount of traffic will be generated through the subdivision. The shorter the
traffic lanes the lower the speed would be.
The commission discussed:
1. How far it would be to get to Stuart Park.
2. A park going by Lori if it goes in.
The public hearing was closed and brought back to the commission for discussion and a motion.
Dusty Morrison, 4755 Heidi Court, The original park was a buffer between Stick built homes and
modular homes. The house in this subdivision should appraise from $150,000 or $165,000. They
want concession from the city on the park. If the city wants a park they would do one. Entrances will
be served by three different roads. It is easier to sell homes if the roads are short. They are opened to
suggestions on the roads. This is a hard project to know what type of homes to build in what price
range.
The commission discussed:
1. The size of the park would be an acre or about 6 %2 of the lots.
2. When Garden Oaks was Developed the city collected a guarantee for the park.
3. Need to bring Briscoe across to be in compliance with comp plan.

Ray Rosen moved to recommend approval of the preliminary plat for Taylor Bean Estates with the
following additions: 1. Briscoe Road be extended to Hawthorne at Darris intersection. 2. a park is
shown on the plat; Jason Mendenhall seconded. Roll call vote: Michelle Miller, yes; Gail Anderson,
yes; Lee Merrill, yes; Deloy Stuart, yes; Ray Rosen, yes; Jason Mendenhall, yes; Mary Harker, yes:
Pete Anderson, yes. .
GENERAL BUSINESS:
3. Ordinance amending the schedule of general controls for Land Use Distribution
Attorney Tom Holmes discussed Pocatello Neighborhood Commercial ordinance Our ordinance is
more restrictive. The ordinance states that it has to be comparable with the neighborhood.
The Commission discussed:
1. Using the warm fuzzy language from some of Pocatello ordinance and keeping the list of
controls.
n 2. An invitation for businesses to come to Chubbuck.
3. Keeping our controls
4. Keeping broad enough not to be too restrictive
5. Limit the square footage for commercial development
6. Take a look at the 40' buffer
7. One more look before we go to public hearing.
8. Discussing the changes at the next meeting.
4. Discussion of Land Rush Estates Planned Unit Development
Steve Smart review the P. U. D. for Land Rush Estates.
1. We could not serve them with sewer but could with water.
2. Bannock County and D. E. Q would like our input
3. They need to develop to city standards
4. Central sewer system instead of individual sewer
