Present: Acting chairman Jason Mendenhall, Commission Members: Deloy Stuart, Mary Harker, Gayle Anderson, Michelle Christy, Michelle Miller, City Staff. Steve Smart, Larry Kohntopp and Sean Harris and secretary Myrna Crapo Chairman Mendenhall called the meeting to order at 7:00 p.m. Chairman Mendenhall asked if anyone on the commission had a conflict of interest. There was none. Chairman Mendenhall asked for approval of the minutes of July 1, 2003. Mary Harker moved to approve the minutes, Gayle Anderson seconded; all voted in favor. PUBLIC HEARING: 1. An application by Jackson's; Food Store #30, P.O. Box 610, Meridian, Idaho 83680 for a Conditional Use Permit to expand the existing store to include Diesel Truck refueling island and truck parking. Property is zoned General Commercial (C -2). Chairman Mendenhall asked for any additional comments from City Staff: Steve Smart explained that we accepted this application because we are going to finish Kings Way this year. They could make a one way lope then having the trucks go north bound on Kings Way and west onto Evans Lane. Evans Lane and Kings Way is being work on at the present time. Idaho Transportation Department has expressed to the city staff their concerns about the safety issue of the trucks exiting back onto Yellowstone from Burnside road. John Jackson, Jackson Food Store, Meridian Idaho they have made a contribution to the cleaning up of the location, as prior to the time they bought the property it was in weeds and an old home that wasn't being lived in. Safety is their main concern but they want to make it an easy access for trucks to enter and leave their business. They will be fixing the curb cut to allow easier turn radius and don't feel it will increase the number of trucks that they get each day. Jack Davis, Jackson Food Store, Meridian, Idaho they had previously installed security cameras to monitor the access to their location. They have 10 trucks that came into their lot per day at the present time and would like to be able to service them. They are not able to sell them gas at the present time. The amount of time it takes to exit from Burnside back onto Yellowstone is an average of a minute and 15 seconds. The commission discussed: 1. Exiting onto Burnside and then ontoYellowstone. The public hearing was opened for comments in favor of the application. Land Use and Development Commission August 5, 2003 Page 2 R Ken Oram, Idaho Central Credit Union, 4425 Burley Drive, goes through the intersection four times a day. You have to back up often for a truck. He feels that the trucks should be forced onto Kings way for safety issues. The public hearing was opened for any opposed to the application. Margaret Waldram, 147 Evans Lane, she doesn't like the truck stop there in the area. It will limit the number of the businesses that will want to locate there. She is afraid for the children of the area. McKee's have field trips visiting the store, that is a safety issue. There is no stop sign there onto Evans Lane. At night the trucks are parking down Kings Way and leave their engines running. She has difficulty sleeping with the trucks running all night. Julie Hitchcock, 201 Evans Lane, She has a child that catches the bus on Kings Way and Evans Lane and is concerned for his safety. He rides his bike along Evans Lane as it is a dead end street and doesn't understand why we need a one way there. Rick Mabey, 157 Evans Lane, He agrees with what had been said about safety concerns with the children and the constant flow of traffic. Mae Hitchcock, 152 Evans Lane, is concerned that when the truck lane is directed to Evans Lane it will take more time for her to get onto Yellowstone. John Jackson, felt it would help with the truck parking and idling through the night. There will only be five or six spaces for a truck to park. They will only have one pump. The traffic survey showed that only 15 trucks per day stop there. It will help all of the other trucks that stop and don't buy anything. The truck traffic is already there and they are working on the ease of entry and exit. The public hearing was closed and brought back to the commission. The commission discussed: 1. This won't be an impact on the area but will help develop the area. 2. A stop light in the future on Evans Lane. 3. The diagram shows three pumps but it will only be one pump. 4.Trucks parking on the side streets - will not be allowed. 5. Ease of access and convenience will increase the traffic. Steve Smart: They will monitor traffic pattern. The stop sign would be on the least traveled leg. Mr. Jackson, there will be six places for people to park and it will be asphalt; there is no asphalt in the area at this time. ' Land Use and Development Commission August 5, 2003 Page 3 Gayle Anderson made a motion for the application of Jackson Food Store Inc. P.O. Box 610, Meridian, Idaho 83680 a conditional use permit at 4444 Yellowstone Avenue, Chubbuck Idaho to allow a 55 foot wide access east of Burnside being developed truck trailer access. The property is presently zoned commercial. Mary Harker seconded. Roll call vote: Deloy Stuart, no; Mary Harker, yes; Gayle Anderson, yes; Michelle Christy, yes; Michelle Miller, no; Jason Mendenhall, yes. 2. An application by Arave Construction Co., 1395 N.W. Main, Blackfoot ID 83221 for change of Land Use District to General Commercial (C -2) contingent upon requested annexation. Property is located at southeast corner of Yellowstone and Siphon Roads, (approximately 5560 Yellowstone). Tom Arave, Arave Construction Company, Blackfoot, ID; they are asking for annexation and zoning on a 15 acre parcel. It is in a commercial corridor, and is in agreement with the comprehensive plan. There will be no access onto Yellowstone from this property. It will be an extension to Industrial Way and would hook into Diamond Circle. They would access the lots from Industrial Way. Chairman Mendenhall opened the public hearing and asked if anyone was here in favor of the application. Chuck Peck, 2298 Tanja Lane, Pocatello, he owns 2 acres on the opposite side of the railroad tracks. He was in agreement with what they were doing. Their property is also zoned C -2. Chairman Mendenhall asked for comments from anyone opposed to the application. Glen Marshall, P.O. Box 250, Pocatello, developer of the property of North Side Plaza across Siphon Road. They dedicated 40 feet at that time to the right of way. They need some consideration to build a buffer between the dense housing and this development. Light commercial on Siphon could buffer North Side Plaza. He is concerned with the family development at Diamond Court. The multiple housing could be on the south side of the tract. Doug Sayer, 170 E. Siphon Road, Premiere Technology, they will be developing more industrial in the area and will built a transition zone. He would like to see the development have a light industrial against the dense residential. Terry Wakefield, Premiere Technology, they felt that they needed a transition zone on Siphon. Residential adjacent to Industrial is not a good thing. Larry Kohntopp, city staff, the original application requesting C -2 and R -4 was changed at the last minute and the corrected application was for C -2 only. Tom Arave: they don't have any types of business in mind at this point. The lots will be primary for businesses. They will not have accesses to Siphon Road. Land Use and Development Commission August 5, 2003 Page 4 The public hearing was closed again and brought back to the commission for comments and a motion. Doug Sayer because of the change of zoning to General Commercial was in strong support of the proposition. He was not aware that the application had been changed at the last minute. Deloy Stuart made a motion to recommend to the City Council approval for Arave Construction, at 1395 N. W. Main, Blackfoot, Idaho for change of Land Use District to General Commercial (C -2) contingent upon requested annexation. Property is located at southeast corner of Yellowstone and Siphon Road. Michelle Miller seconded. Roll call vote: Deloy Stuart, yes; Mary Harker, yes; Gayle Anderson, yes; Michelle Christy, yes; Michelle Miller, yes; Jason Mendenhall, yes. 3. An application by Cary Baird/Kays Kove, Box 57, Inkom, ID 83245, for a Planned Unit Development, (PUD), for twin homes, together with its Preliminary Development Plan. The L.U.D.C. will also consider the preliminary plat. Property is located at 550 E. Chubbuck Road. Property is presently zoned Limited Residential (R -2). Mitchell Greer, Rocky Mountain Engineering and Surveying, 155 S. 2' Pocatello, Idaho they will turn it into eight twin home properties. They have provided additional parking for people visiting those who live there. There will be single access off of Hiline Road, with an emergency access off of Chubbuck Road. The existing home will be sold as a single family resident accessing off of the driveway on the western side of the property. They have reserved the right -of -way for improvement on Hiline Road. Chairman Mendenhall opened the public hearing and asked for anyone in support of the application. Kent England, 4671 Annie's Avenue, Rachels Rainbow Subdivision, they are about 80% widows that live in the Rachel's Rainbow subdivision. This property will be on flat ground and should work well. Cary Baird, Inkom, Idaho, this is the fifth subdivision that they have built. Average age is 72 years old for the people who buy the twin homes. There is a need for this type of subdivision. Mary Bunce, 755 E. Chubbuck Road, she would like to know the size of the property - it is 2 %2 acres. Chairman Mendenhall asked for anyone in opposition to the application. Bill Paul, 540 E. Chubbuck Road, He is concerned about maintaining the Fort Hall Ditch, the fence for his animals, and the access to Chubbuck Road. What is the tentative start date on it. Will he run into problems with his livestock. Land Use and Development Commission August 5, 2003 Page 5 .� The commission discussed: 1. Fencing between Mr. Paul and the proposed development 2. Access to East Chubbuck Road Mitch Greer, 155 S. 2 nd Avenue, they will fence their property from the adjoining property The Chubbuck Road access will not be used only in an emergency situation. It won't be opened at all and will have a gate. The canal water will be piped and maintained the current flow. City staff: Informed Mr. Paul the number of livestock he could have on his two acres. Deloy Stuart, moved to approve the application of Cary Baird/Kays Kove, Box 57, Inkom, ID 83245, for a Planned Unit Development, (PUD), for twin homes, together with its Preliminary Development Plan. That also we require that the fence be put between the Paul's property and this development. Preliminary plat also. Mary Harker seconded. Deloy Stuart pulled the motion. Mitch Greer, the retaining wall would be needed to support the road, sidewalk and curb and gutter. Cary Baird, they gave a 40' easement to the city. For financial reasons to put curb, gutter and sidewalk it would not pay to put the subdivision in.. The commission discussed: 1. Concern for children walking on the side of Hiline Road. 2. City staff has to require curb, gutter and sidewalk. Sean Harris, City of Chubbuck, the applicant is asking to leave it as it is. Deloy Stuart moved to make a recommendation to the City Council that they approve an application by Cary Baird/Kays Kove, Box 57, Inkom, ID for a Planned Unit Development for twin homes and also that they approve the preliminary development plan which has been presented tonight with the condition that a fence is put up between the property of the Paul's home and the development with the preliminary plat. An application by the City of Chubbuck, 5160 Yellowstone, Chubbuck, ID, 83202 for a conditional use permit for an emergency services and public works radio tower to a height of 120' which is in excess of the allowable 70' in a commercial zone. Property is presently zoned General Commercial (C -2). Steve Smart, Public Works Director, we are building an office addition at the city. The 101N police had a 50' tower for one of their antennas; the new building will extend beyond the location of the 50' tower. We needed to increase the towers over the top of the trees in order to make some of the links. The public hearing was opened for public comment. Land Use and Development Commission August 6, 2003 Page 6 Mary Bunce, 755 E. Chubbuck, asked if it would attract lightening. Steve Smart: it is a metal tower. The public hearing was closed and brought back to the commission. Michelle Miller moved to approve an application by the City of Chubbuck for a conditional use permit for emergency service and public works radio tower to a height of 120'; which is in excess of the allowable 70' in a commercial zone. Deloy Stuart seconded. Roll Call vote: Deloy Stuart, yes; Mary Harker, yes; Gayle Anderson, yes; Michelle Christy, yes; Michelle Miller, yes; Jason Mendenhall, yes. Mary Harker informed the City Council that a group is interested in a city cemetery and someone will be at the city council. Richard Morgan is representative of the group.
