HomeMy WebLinkAbout006-3-03LAND USE AND DEVELOPMENT COMMISSION June 3, 2003 Minutes of the regular session of the Land Use and Development Commission held at Ellis School, 5500 Whitaker, June 3, 2003. Present: Chairman Pete Anderson; Commission members: Michelle Miller, Michelle Christy, Ray Rosen, Jason Mendenhall, Mary Harker, Deloy Stuart, Lee Merrill, Gayle Anderson; Attorney: Tom Homes; City staff. Steve Smart, Larry Kohntopp, and Secretary Myrna Crapo Chairman Anderson called the meeting to order at 7:08 p.m. Chairman Anderson asked if anyone on the commission had a conflict of interest. Attorney Tom Holmes informed the commission that his firm had been involved with people in items 3, 4, and 5, but not with respect to any of the items before us tonight. Chairman Anderson asked for approval of the minutes of May 6, 2003. Ray Rosen moved to approve the minutes as mailed, Mary Harker, seconded; all voted in favor. Chairman Anderson had received a request to move item 5 for Heritage. Development behind item 1. PUBLIC HEARING: 1. A conditional use permit application by Jed Adamson, Box 454, Aberdeen, 83210 to have a message therapy school at 265 E. Chubbuck Road #B. Property is zoned (C -2) General Commercial. Jed Adamson, Box 454, Aberdeen, he graduated from school in Utah. He spent 20 years in pre hospital as an ambulance driver and then went through Acupuncture, Naturopathic program. He had three requests to start a massage therapy school so he decided to start one. He plans on 10 students per class. He will operate Thursday, Friday, Saturday nights; he will be in the office the rest of the week. He eventually would like to operate a day time program, perhaps in August. He will operate a student clinic in the evenings probably two or three students at a time. Thursday night he will be opened until 10:00 o'clock. The meeting was opened for public comments, for or against. There was none. The public hearing was closed and brought back to the commission for discussion and motion. The commission discussed: 1. The location of the business 2. The parking situation. Michelle Miller moved to accept the conditional use permit application by Jed Adamson, Box 454, Aberdeen, Idaho, 83210 to have a message therapy school at 265 E. Chubbuck Road #B; with Mary Harker seconding. Property is located west of Roanoke Drive and Chesapeake Avenue. Gene Hancock, 12367 N. Hawthorne, represented Mike Bird. The meeting was opened for public comment, seeing none the hearing was closed and brought to the commission for a discussion. Gayle Anderson, recommend to the City Council approval of the application by Heritage Development, Box 2684, Pocatello, Idaho for a preliminary plat for Victorian Village, 3' Addition. Property is located west of Roanoke Drive and Chesapeake Avenue conditioned upon annexation and zoning. Ray Rosen seconded. Roll Call vote: Deloy Stuart, yes; Mary Harker, yes; Lee Merrill, yes; Michelle Miller, yes; Michelle Christy, yes; Gayle Anderson, yes; Ray Rosen, yes; Jason Mendenhall, yes; Pete Anderson, yes. 3. An application by Rodney Burch, 375 Lisa, Chubbuck, ID 83202, for a change of land use district from General Residential (R -3) to Limited Commercial (C -1) for use as professional office space. Property is located at 485 West Chubbuck Road. ag Commission questioned the present zoning, if this was not already allowed. It was not. Rodney Birch, 375 Lisa, owns the property and has accepted an offer of sale contingent upon this zoning approval; their plans is to build a dental office. The present home will be destroyed. They will build addition space for lease or rent. All the buildings will be removed. Misti Manor surrounds on the east and south, the west is a church, north is a home. The public hearing was opened for public comment. There was none, so the public hearing was closed, and brought back to the commission for discussion. Commission felt it would be a nice addition to the city. Deloy Stuart, moved to recommend to the City Council approval of the application by Rodney Burch, 375 Lisa, Chubbuck, ID 83202, for a change of Land use district from General Residential (R -3)to Limited Commercial (C -1), for use as a professional office space for the property located at 485 West Chubbuck Road. An application by Darris Ellis, 13560 N. Hawthorne for annexation and zoning changes eo"� from Agricultural (A) to Planned Unit Development, (P.U.D.)for residential use with subordinate commercial uses. Property is located south of Margaret Street. The application is for Park Meadows P.U.D. 4 5 6th and 7 additions. They will continue with Margaret Street. The meeting was opened for public comment, seeing none; the public comment were closed and brought back to the commission for discussion and a motion. Jason Mendenhall moved to recommend to the city council approval of the application by Darns Ellis, 13560 N. Hawthorne for annexation and a zoning changes from Agricultural (A) to Planned Unit Development, (P.U.D.) for residential use with subordinate commercial uses. Property is located south of Margaret Street. The application is for Park Meadows P.U.D. 0, 5 6` and 7 additions. Lee Merrill seconded. Bryan Fynn, Rocky Mountain Engineering Surveying, 155 S. 2 ° Pocatello, ID 83202. Steve Smart asked about the part of the area that will be town houses (twin homes). ''\ The meeting was opened for public comment. Donna Jones, 4729 Ponderosa, they abut the construction that is just being completed. The contractor should be stopped from working until he can do site containment. She hasn't seen the water truck for the last two weeks, until today. Last summer they were forced to put in a 6' high privacy fence to replace their 4' fence because of the dirt and dust, at a cost of over $3,000. She had to throw away her patio cushions because she couldn't clean them any more. Last summer while mowing the lawn, the dust was coming up as she was riding the rider mower. Shortly after that she couldn't catch her breath. and couldn't get enough oxygen into her lungs. She feels that people doing the construction need to do an adequate containment of dust and dirt. Faye Jones, 4729 Ponderosa, when he goes to mow the lawn he has to wear a face mask. This morning when he walked out to shut his water off, just walking through the grass where the water had been his tennis shoes were filthy with mud. One day last week a new family moved in next door to them, and washed their blinds. The blinds were filthy with dirt and dust just after the dust storm and they had to redo them. He gets to where he can't breath; even in his house; it is terrible. Dorothy Christensen, 1045 Concord, they are not in the direct line of that dust. A week ago Saturday, because of the wind, while looking out her window she couldn't see the homes in the subdivision. They were buried in dirt. It needs to be watered down on a regular basis. Darns Ellis, 13561 N. Hawthorne Road, Larry R Seams of the Department of Environmental Quality came by today and cited a couple of builders. It was a dust bowl on the week end caused by some of the another builder. He has tried to keep water on the holes that he is working on. They are trying to control the dust by the water. There are eight other builders building there. ,. The 10% cap on high density. 2. Need to watch the development in the future. 3. In the original plan they indicate there would be higher densities. Mitch Greer, Rocky Mountain Engineering, this request for twin homes is consistent with the overall plan presented previously. Lee Merrill, make a motion to recommendation to the City Council approval of the application by Darris Ellis, 13560 N.
