Present: Chairman Pete Anderson; Commission members: Lee Merrill, Michelle Miller, Jason Mendenhall, Mary Harker, and Gayle Anderson, Attorney: Tom Homes; City staff. Larry Kohntopp, Sean Harris, and Secretary Myrna Crapo Chairman Anderson called the meeting to order at 7:00 p.m. Chairman Anderson asked for approval of the minutes of January 7, 2003. Lee Merrill moved to approve the minutes, Gayle Anderson, seconded; all voted in favor. PUBLIC HEARING: 1. A conditional use permit application by Christ's Love Vineyard, 3715 Sandpiper, Pocatello, ID, for a Church at SW corner of Siphon and Whitaker Road, north of Victorian Village. Property is zoned (C1) Limited Commercial. Larry Kohntopp pointed out that church's are conditionally permitted in every zone except industrial. The commission discussed the ditch in the area. Pastor Race Robinson, 3715 Sandpieper they will purchase 1.2 acres next to the railroad tracts. It will be a 3,000 sq feet sanctuary, kitchen, class rooms, with 2 bathrooms. The landscape with have grass and trees up to Siphon. Chairman Anderson opened the meeting up to public comment for and against. There was none so the public hearing was brought back to the commission. Mary Harker moved to accept the Conditional Use Permit application for Christ's Love Vineyard, 3715 Sandpiper, Pocatello, ID for a church at the southwest corner of Siphon and Whitaker Road, North of Victorian Village property zoned C -1 (Limited Commercial) and that the following conditions 1 thru 9 on pages 1 and 2 of the report from the Design Review Committee, March 4, 2003 be complied with. Michelle Miller seconded. Roll call vote: Lee Merrill, yes; Michelle Miller, yes; Jason Mendenhall, yes; Mary Harker, yes; Gayle Anderson, yes: Pete Anderson, yes. 2.An application by Sharik Peck, 2298 Tonja Lane, Pocatello, ID 83201, for a Preliminary Plat for Ergo Land Subdivision. Property is located at the SW corner of Siphon and Whitaker, North of Victorian Village. Land Use Commission April 1, 2002 Page 2 n Sharik Peck, 2298 Tonja Lane, They want to expand their business and decided on the land on siphon Road. It will be another 1 to 2 years before they can start building. They want to leave a lot of open space and were seeking businesses that would do that. He is a physical therapist. They don't have access to irrigation water. He would like to keep open spaces for building in the future. Along the parking lot and Siphon Road that want to have a path that meanders through the area with trees along it. The meeting was opened to public comment, there was none. It was brought back to the commission for a recommendation and a motion to the city council. The commission reviewed the Staff Report. The commission discussed: 1. The culvert would allow the run off water to nun off. Jason Mendenhall moved to recommend to the city council approval of the application by Sharik Peck, 2298 Tonja Lane, Pocatello Idaho, 83201 for a Preliminary Plat for Ergo Land Subdivision, the property is located in the SW corner of Siphon and Whitaker, north of Victorian Village with the recommendations of the city staff attached. Mary Harker, seconded. Roll Call vote: Lee Merrill, yes; Michelle Miller, yes; Jason Mendenhall, yes; Mary Harker, yes; Gayle Anderson, yes; Pete Anderson, yes. 3. An ordinance amending 18.08.040A schedule of General controls to conditionally permit certain business in Industrial zones. The public hearing was opened for public comments for or against. There was none. The public hearing was closed and brought back to the land use commission for a motion and a discussion. Mary Harker recommended that Martial arts instruction be used in place of Karate /jiujitsu instruction. Gayle Anderson moved to recommended to the city council an ordinance amending 18.08.040A schedule of General controls to conditionally permit certain businesses in Industrial zones. Lee Merrill seconded. Roll call vote: Lee Merrill, yes; Michelle Miller, yes; Jason Mendenhall, yes; Mary Harker, yes; Gayle Anderson, yes; Pete Anderson, yes. GENERAL BUSINESS: Larry Kohntopp expressed appreciation for the commission's work on the comprehensive plan. The plan was approved by the city council and is now inplace.
