HomeMy WebLinkAbout010-05-10City of Chubbuck LAND USE & DEVELOPMENT COMMISSION MINUTES October 5, 2010 7:00 PM Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, October 5, 2010. Present: Chairman Pete Anderson; Commission Members: Jason Mendenhall, Rodney Burch, James Eborn, Ron Horner, George Merrill, Bryan Nield; City Staff: Steven Smart, Paul Andrus; City Attorney Tom Holmes. Chairman Anderson called the meeting to order at 7:00 PM. APPROVAL OF MINUTES for August 3, 2010 Jason Mendenhall moved the minutes for August 3, 2010, be approved as mailed; Ron Horner seconded. All voted to approve. GENERAL BUSINESS: Review setbacks relative to lot size (Section 18.08.040B). Chairman Anderson explained the reason for the discussion and noted homes that have done additions over the years that left too small of a setback between two homes. He said lot sizes are getting smaller in new developments. Smart commented on the ordinance dating back to 1979. Access to the rear yard was the goal of side setback minimums. It was increased to a total of 14 with a minimum of 5 feet on one side to accommodate RVs or maintenance vehicles. Burch noted the setback is being interpreted as being from the foundation not the eaves or cantilevers. Chairman Anderson noted when this happens on both sides of a common property line, it leaves only 4 or 5 feet between eaves. He said the International Building Code says eaves within five feet of the property line require fire rated construction. Commission discussed concerns: • home insurance issues, possibly deny a fire claim, Bryan said insurance cannot deny a fire claim other than arson • Paul Andrus said our fire marshall had no setback concerns • possibly not a land use issue, but an enforcement issue • how setbacks are measured is not clear, whether to foundation of the home or to the foundation of a deck/porch • smaller lot not an issue, most are 70 feet wide or above • in R -2, a 20 -foot front setback does not allow enough for parking without blocking sidewalk. Better parking discourages vehicles or RVs along the street. • in R -1, a 25 -foot front setback seems adequate, but it used to be 30 feet. Commission discussed options. They concluded the side setbacks would not need changed. They discussed changing R -2 front set back to 25 feet from the property line. Smart described the swale section. Commission discussed parking and sidewalk issues that could be resolved. Several other local cities use 25 -foot setbacks. Corner lots must be considered and are covered in the code. Historical concerns involved affordable lots and housing. Commission requested some data on which to base its final decision. Paul will collect data. 2. Review Use Matrix (Section 18.08.040A). Paul Andrus explained there are advantages and disadvantages in the matrix. Getting familiar with it helps. Changing it could be too time consuming. Chairman Anderson said just choosing what code to base changes on can get complicated. Districts relate closely to parking requirements. Smart said Conditional Use covers undefined categories or situations. Eborn noted discussion encourages up to date code and good training for commission members. Flexibility encourages business. No change was proposed at this time. 3. Reschedule the November 2, 2010, meeting for Thursday, November 4, 2010, to avoid election day conflicts.
