LAND USE & DEVELOPMENT COMMISSION
MINUTES
August 3, 2010
7:00 PM
Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City
Hall, 5160 Yellowstone, August 3, 2010.
Present: Chairman Pete Anderson; Commission Members: Jason Mendenhall, James Eborn,
Morris Kinghorn, George Merrill, Jay Buttars; City Staff. Steven Smart, Paul Andrus; City
Attorney Tom Holmes.
Chairman Anderson called the meeting to order at 7:00 PM.
APPROVAL OF MINUTES
There being no corrections. Jason Mendenhall moved the minutes for June 1, 2010, be approved
as mailed; Morris Kinghorn seconded. All voted to approve.
PUBLIC HEARINGS:
1. Consider proposed ordinance amending city code Section 18.20.112 (F) regarding the
procedure for approval of a Planned Unit Development.
Chairman Anderson said we are basically changing one word, from principles to plan, in
the ordinance. Tom Holmes explained that the meaning of the word units includes all
types and one or many buildings.
Chairman Anderson then opened the item for public hearing. There being none, the
hearing was returned to the commission for discussion.
The commission discussed the difference between the terms "site plan" and "preliminary
development plan" in Section F. They discussed requiring the applicant to provide
clearly defined exceptions. They discussed adding a period after the word development
(development. Whenever) in #3.
Jason Mendenhall moved the commission recommend the city council approval of the
proposed ordinance amending city code Section 18.20.112 (F) regarding the procedure for
approval of a Planned Unit Development with the correction of the plan having an "s" in
parenthesis and also adding sentence structure to Section #3. Jim Eborn seconded the
motion. With all understanding the motion, they voted.
Roll Call Vote: George Merrill -Yes; Jason Mendenhall -Yes; Jay Buttars -Yes; Morris
Kinghorn -Yes; James Eborn -Yes; Pete Anderson -Yes. Motion carries. Chairman
Anderson said the application will go before the city council.
Paul Andrus, City Staff, said he has had several requests for apartments created for aging parents.
The commission discussed what amenities should be allowed and the conditional use permit
process required. There is no control over what a new owner may do with an apartment built by
the old owner. They affirmed the process already in place which involves public comment.

Jason Mendenhall moved the meeting be adjourned; Morris Kinghorn seconded. All voted to
adjourn.
The meeting adjourned at 7:23 PM.
