LAND USE & DEVELOPMENT COMMISSION
MINUTES
April 7, 2009
7:00 PM
Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City
Hall, 5160 Yellowstone, April 7, 2009.
Present: Chairman Pete Anderson; Commission Members: Shawna Elzner; James Ebom, Ron
Horner, Morris Kinghom, Jason Mendenhall; City Staff. Paul Andrus, Larry Kohntopp, Secretary
DeLaina Baker.
Chairman Anderson called the meeting to order at 7:00 pm.
Chairman Anderson asked if there were any conflicts, and there being none, he proceeded.
APPROVAL OF MINUTES for March 3, 2009.
Morris Kinghom asked that the minutes have an additional sentence on page 2 in
paragraph 3 to reflect that "Pocatello planning & zoning asked us to join them in creating
windmill policies ". Jason Mendenhall moved for approval of the minutes for March 3,
2009, with the addition noted by Morris Kinghom; Morris Kinghom seconded; all voted
in favor.
PUBLIC HEARING
An application by FD Properties, 167 Southside Way Suite A, Chubbuck, Idaho, 83202
for Southside Plaza Condo Preliminary Plat. This property is located at the southwest
corner of Southside Way and Industrial Way.
Brian Flynn, 2714 Stone River Circle, said the building, with asphalt, sewer and water
services, is already existing in this eight unit condo plat.
Commission questions:
• confirmed it is a commercial not residential project
• just dividing existing storage building into sections
• confirmed there will be no living quarters in sections
• confirmed an owner's association will care for landscaping
City Staff, Larry Kohntopp, said it is zoned industrial and the existing use is commercial.
Chairman Anderson opened the hearing for public comment. There being no public
comment, he returned the hearing to the commission for discussion. Chairman Anderson
clarified for the commission that industrial zoning allows more uses or occupancies than
regular commercial.
Morris Kinghom moved the commission recommend the city council approve the
'~ application by FD Properties, 167 Southside Way Suite A, Chubbuck, Idaho, 83202 for
Southside Plaza Condo Preliminary Plat, located at the southwest corner of Southside
Way and Industrial Way as platted. Ron Horner seconded the motion.
There being no further discussion and with all understanding the motion, they voted. Roll
Call Vote: James Ebom -Yes; Shawna Elzner -Yes; Ron Horner -Yes; Morris Kinghom -
Yes; Jason Mendenhall -Yes; Chairman Pete Anderson -Yes. Motion was approved and
will go to council on April 28th.
2. Proposed ordinance amending Title 18 Sections 17.12.050 and 18.28.020(A) regarding
specific hearing notice and application fees.
Paul Andrus, City Staff, said the ordinance needs amended to reflect the actual current
fees adopted by resolution.
Chairman Anderson opened the hearing for public comment. There being no public
comment, it was returned to the commission for discussion:
• the fees are referred to by resolution rather than a specifically stated amount
Jason Mendenhall moved the commission recommend city council approval of the
proposed ordinance amending Title 18 Sections 17.12.050 and 18.28.020(A) regarding
specific hearing notice and application fees. Shawna Elzner seconded the motion. There
being no further discussion and with all understanding the motion, they voted. Roll Call
Vote: James Ebom -Yes; Shawna Elzner -Yes; Ron Horner -Yes; Morris Kinghom -Yes;
Jason Mendenhall -Yes; Chairman Pete Anderson -Yes. Motion was approved.
GENERAL BUSINESS
1. Discuss Commission recommendation that the Comprehensive Plan zoning on the Matt
and Linda Clawson property located at 14051 W. Chubbuck Road be changed from C-
Commercial to Mixed Use.
Tom Holmes reviewed the history of the recommendation from the time the annexation
was first reviewed by the city council last summer when the comprehensive plan change
was recommended for residential properties to remain consistent with the plan.
Discussion followed:
• division of the property would be allowed if zoning were mixed use
• if zoning is compatible with proposed roundabout or future commercial use. A
commercial use would require a conditional use permit.
• whether to change the other corners of the intersection zoning to mixed use also,
which would allow commercial with a conditional use permit.
• trends show lack of development pressure other than residential
• Sunset West Subdivision would fall within mixed use
' A comprehensive plan change requires public hearings in both land use commission and
city council meetings. Larry said zoning on E. Chubbuck Road from Hiline Road east to
Sacajawea was elected by residents there to be changed to R -1, low density residential,
which discourages home sales.
Jason Mendenhall moved a comprehensive plan land use change be brought up for public
hearing for changing the zoning going as far as the city determines on all corners of
Chubbuck & Philbin Road intersection to mixed use; Morris Kinghorn seconded the
motion. All voted in favor; motion carries.
2. Review Comprehensive Plan and discuss proposed ordinance amending Title 18 Section
18.12.030(A) regarding temporary use of storage containers in residential areas.
Paul Andrus said a storage company asked about placing the units at residences for
storage, and the code did not specifically allow or exclude this practice. He said Mayor
England felt a time limit of thirty days was reasonable.
Commission discussed:
• reasons for storage containers to be excluded
• some containers have been left too long
• the need to define what type of container is a "shipping container"
• the time period to allow, thirty days or two weeks
• could require a permit
Commission concluded the ordinance needs a definition including limitation on size,
should have a shorter time period of 14 -16 days, and include a permit that outlines
penalties. Tom will rewrite the ordinance with recommendations.
Morris Kinghorn moved the meeting be adjourned; Ron Horner seconded; all approved.
The meeting adjourned at 7:49 PM.
