MINUTES
March 3, 2009

Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City
Hall, 5160 Yellowstone, March 3, 2009.
Present: Commission Members: Morris Kinghorn (Conducting), Michelle Christy; James Eborn,
Ron Horner, Bryan Nield; City Staff. Steven Smart, Larry Kohntopp, Paul Andrus, Andy
Despain.
Morris Kinghorn called the meeting to order at 7:05 pm.
APPROVAL OF MINUTES: Jim Eborn moved for approval of last meeting's minutes for
February 3, 2009, as written; Ron Horner seconded; all voted in favor.
GENERAL BUSINESS
Morris Kinghorn announced extension of terms to 2012 for Commissioners Pete
Anderson and Jason Mendenhall. New commissioner, Bryan Nield, was welcomed.
2. Consider draft ordinance amending Title 18 Sections 17.12.050 and 18.28.0209(A)
regarding specific fees.
Paul Andrus said this update was necessary to eliminate stating specific amounts in one
section and to reference the fees as set by resolution. Morris Kinghorn said this approach
was recommended at the AIC training he just attended. Commission discussed how the
fees were limited or calculated. Larry Kohntopp said it was a flat fee for many years.
Then, after committee meetings which included the builders association, the fees began
being brought up to current standards with a review every three years.
Commission discussed where the fees can be found on the application.
There being no further discussion, Michelle Christy moved that city staff be directed to
publish notice for a public hearing on the draft ordinance amending Title 18 Sections
17.12.050 and 18.28.0209(A) to be held at the April meeting; Jim Eborn seconded; all
approved.
Morris Kinghorn commented on the training he attended last Saturday and had questions on a
couple of items. Steve Smart responded the Comprehensive Plan was last reviewed about 2002.
The commission discussed scheduling some blocks of time to review the comp plan and the
ordinances.
Morris Kinghom clarified the meaning of a "conditional use permit ". Larry Kohntopp described
a major or minor home occupation. Steve Smart referred to the table of permitted and non-
permitted uses for each zone. For a conditional use permit, a public hearing notice is sent to
residents within 300 feet. Michelle Christy related her personal experience with the application
process for her day care.
Commission briefly continued discussing their priorities when making a decision.
3. Commissioners viewed the second half of the DVD of a recent web -based workshop held
by the Association of Idaho Cities titled " Model Ordinances for Zoning & Subdivisions ".
Morris Kinghorn said members of Pocatello's planning & zoning commission shared some
concerns with him. Pocatello planning & zoning asked us to join them in creating windmill
policies. He proposed the commission review windmills regarding height, pole type etc. He
also proposed they review gray water reuse regulations.
Ron Horner noted he has been told manufactured homes are not approved for subdivisions, but
the workshop said they just have to meet certain conditions. Smart said if they qualify for a
home loan, the city can not discriminate, but they can set standards. It is no longer personal
property, but is considered real property.
Jim Ebom moved the meeting be adjourned; Ron Horner seconded; all approved.
The meeting adjourned at 8:15 PM.
