HomeMy WebLinkAbout008-05-08City of Chubbuck LAND USE & DEVELOPMENT COMMISSION MINUTES August 5, 2008 7:00 PM Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, August 5, 2008. Present: Chairman Pete Anderson; Commission Members: Morris Kinghom; James Eborn, Ron Horner, Jason Mendenhall; City Staff: Tom Holmes, Steven Smart, Secretary DeLaina Baker; Police Department: Patty Unruh. Chairman Anderson called the meeting to order at 7:02 pm. There being no conflicts of interest, the meeting proceeded. APPROVAL OF MINUTES Jason Mendenhall moved the minutes for July 1, 2008, be approved as mailed; Morris Kinghorn seconded; all approved. PUBLIC HEARING: n 1. A proposed amendment to the major home occupation ordinance that would allow a daycare provider operating as a home occupation to allow a temporary person on the premises. Patty Unruh, Administrative Assistant representing the Chubbuck Police Department, said current home occupation ordinance does not allow someone other than the home residents to fill in temporarily at a daycare. We want to be able to background check a temporary. The time period would be no more than 14 days. We want to provide opportunity not to be in violation in a special situation. Commissioners discussed: 1. The time period was confirmed as 14 consecutive days. 2. The temporary person would go through a licensing procedure. There being no further city staff comment and no public comment, the meeting was returned to the commission for discussion. There was no further discussion. Morris Kinghorn moved the proposed amendment to the major home occupation ordinance, which would allow a daycare provider operating as a home occupation to allow a temporary person on the premises, be recommended to the city council for adoption into the ordinance; Jim Eborn seconded. With all commission members understanding the motion, they voted. Roll Call Vote: James Eborn -Yes; Ron Horner -Yes; Morris Kinghorn -Yes; Jason Mendenhall -Yes; Chairman Pete Anderson -Yes. Motion carried and will go to the city council in September. LUDC Page 1 of 3 2. An application by the City of Chubbuck for a zoning change from R -2 Limited Residential to C -2 n General Commercial on Highway Acres Subdivision, Lots 17, 18, & 19, which are city owned rental properties. These lots are more commonly known as 216, 234 and 242 -248 Highway Avenue. n Larry Kohntopp, City Planner, representing city staff. He said the city purchased properties over the years on the north side of Highway to expand city lot. He pointed out properties on the display and described the current uses. He said the city has preserved the homes as rentals to maintain the residential nature. The back parts of the lots have been used to expand the city lot. Larry Kohntopp responded to the commission that the zone change is so the city can use back sides of the lots, and the rentals will remain. The hearing was then opened for public comment. Dwain Kinghorn, 145 Highway Avenue, said the city council promised Highway Avenue residents the street would remain R2; he is aware of the plan mentioned by Larry Kohntopp and does not oppose the commercial zoning; he appreciates the care the city has given the rental homes it maintains. Steve Grumbein, 231 Highway Avenue, would like to know how commercial zoning on the north side of the street will affect home values on the south side of the street. He would like to know how the surrounding commercial zoning is affecting the taxes. There being no further public comment, the hearing was returned to city staff. Larry Kohntopp attempted to answer Mr. Grumbein by noting that the city's Comprehensive Plan includes future zoning of commercial expected in this area. If the north side remains rental homes, the south side should not be affected. A commercial zoning may be beneficial to a property owner. Commissioners discussed: 1. Residential zoned properties would not change tax rates. 2. The new property has provided space for new buildings, and the lots may be used for materials storage such as aggregate. Jason Mendenhall moved the application by the City of Chubbuck for a zoning change from R -2 Limited Residential to C -2 General Commercial on Highway Acres Subdivision, Lots 17, 18, & 19, be recommended for approval by the city council; Morris Kinghom seconded. With all commission members understanding the motion, they voted. Roll Call Vote: James Ebom -Yes; Ron Horner -Yes; Morris Kinghom -Yes, Jason Mendenhall -Yes; Chairman Pete Anderson - Yes. Motion carried and will go to the city council. Chairman Anderson suggested the city's promise to the residents should be formalized in some manner.
