HomeMy WebLinkAbout010 04 73PLANNING AND ZONING COMMISSION MINUTES -OCTOBER 4, 1973 Minutes of the regular meeting of the Plauniug and Zoning Commi ssion held in the city municipal bud_lding October 4, 1973. Present: Chairmau Jim Brauson, Commission members Allen Martin, Jack Menard, Rodney Parrish, Del Peters and Larry Rawlins. Meeting called to order at 8:03 p.m, by Chaimman Jim Branson. Minutes of meeting September 6 approved as written. PUBLIC 1. HEARING ITEMS: Robert D. Vesser and Carolyn H. Vesser has requested a variance to allow the construction and operation of a photo studio on their property at 147 Parrish Drive. Mr. Vesser stated he planned to b~ild an addition of 20 f~Ot x 38 foot in front of his home. He has dO foot from his present home to the curb line. Mr. Vesser indicated he would inst~11 sidewalks. Chairman Branson asked Mr. Vesser to prepare a plot plan of his b~ilding proposals so the commission would have something definite to consider. Mr. Vesser returned later in the meeting with a plot plan of his proposed construction. He stated he would leave a 20 foot setback, inst~11 sidewalk,s and provide 2 off-street parking spaces. Jack Menard made motion the commission recommend the council approve Mr. Vesser' s variance. Peters seconded with si1 comm~ ssion members approving but Rodney Parrish, who abstained from voting. John R. Valenty, Mgr., Valenty and Sons, Inc., requests a variance to allow him to develop a six-unit tr~l er court on their property on Valenty Road. Frances McPherson, 13~ Valenty Rd. protested the exit road next to her property. Laramie Ankrum, E. Chubbuck Rd. stated he felt the development would upgrade the area. Del Peters made motion the commission recommend city council grant a variance to allow Mr. Valenty to construct a trailer park in the present neighborhood commercial zone. Rawlins seconded. It was~ade clear to Mr. Valenty and those present Mr. Valenty would be required to comply with the Chubbuck tr~ler ordinance. The commission vote was unanimous in favor of motion. Land Investment, Inc., which the Par~ishes represent are requesting additional acreage be zoned Residential -2 Tr~41ers to ~11 ow development of a Residential -2 Tr~ler Subdivision. This acreage lies south of Chub~uck Rd and East of Railroad tracks. Max Parrish presented the planned proposal of development. Several residents from East Chubbuck Road were present to question the request and development and voice their protests. Chairman Branson asked~Mr. Parrish why they were not developing the lots along Chubbuck Road in Mobile Manor. Mr. Parrish stated they had never agreed to bud_ld homes on these lots. Paul Thompson and Dean Morgan stated the Parrishes had agreed to develop homes on these lots, Paul Thompson asked when the Parrishes would correct the irrigation problem through Mobile Manor. Mr. Thompson stated the pipe has constricted the water flow. Mr. Parrish told Mr. Thompson the irrigation company stated the 15 inch concrete pipe inst~lled would carry the necessary inches of water. Mr. & Mrs. Jack Ranstrom, Dean Morgan and Dee Green were also present and protested the zoning request. The Mobile Manor developed lots were commended by Paul Thompson but he reiterated the compl~ut of those present of non- development of lots facing Chubbuck Road and faulty irrigation construction. Larry Rawlins suggested the Parrishes advertise the lots facing Chubbuck Road for sale. Jack Menard moved the request be tabled for the present until commiss- ion could meetS_in closed session.to make a decision. Rawlins seconded and motion passed. Comm~ion met in private session on this matter later in evening. Del Peters made motion the commission recommend the council approve the rezoning of this request with the exception of the frontage on Chubbuck Road of 100 foot in depth be retained in its present zone of light industrial. Rawlins seconded. Motion passed by a majority vote with Parrish and Martin abstaining from voting. (cont'd m~uutes of October ~ commission meeting) PARADISE ACRES SUBDIVISION - Paul Smith, Vice President of Northwest Development Company presented their proposed preliminary plat which consists of 353 lots and 102.~5 acres which lie north of Siphon Road and west of Yellowstone Hwy. Mr. Smith proposes all underground utilities, sidewalk, curb and gutter install- ation. Sewer and water is proposed to be furnished by Chubbuck city. Rodney Parrish recommended the first entrance road from Siphon Road continue through the subdivision. Jack Menard asked Mr. Smith if they would object putting in their own well system. Mr. Smith stated they would not have any objection if it could be done financially in project and city would accept same when annexed. The commission members agreed the subdivision should comply with the subdivision and zoniug ordinances of the city. Jack Menard moved the commission recommend the council approve this preliminary plat only if engineer's survey proves Chubbuck can serve the subdivision with water. Martin seconded with an unanimous vote in favor of motion. Jack Menard reported a visit had been made to David Edward Reese, 741 West Chubbuck Road asking him his feeling as to serving on the planning and zoning commission. Mr. Reese was very interested in doing so. RALPH NELSON SUBDIVISION final plat was presented for approval. This subdivision lies on Adams drive on each side of street and was developed with the exception of a few lots before the subdivision ordiuance was adopted. Allen Martin moved the commission recommend the council approve plat. Rawlins seconded with an unanimous vote in favor of motion. Meeting adjourned at ll:~5 p.m. J~mes B.
