Minutes of the regular meeting of the planning and zoning commi ssion held in the city
municipal building December 6, 1975.
Meeting called to order at 8:00 p.m. by Chairman Branson.
Present: Chairman Jim Branson, Commission members Jack Menard, Rodney Parrish, Del Peters
and Ed Reese.
Minutes of October ~th meeting read' by clerk and approved.
City council members Dwain Kinghorn, Jack Menard, Earl Rom~iell and Wayne Taylor present
to discuss Jerry Tydeman's variance request.
PUBLIC HEARING ITEM REVIEWED - Commi ssion members and councL1 members lurther discussed
Jerry Tydeman' s variance request to operate a business at 156 Hiway Avenue. Chairman
Branson apologized to Mr. Tydeman for taking action on a conditional use at the last
meeting which is disallowed in ordinance. Councilmen Kinghorn and Romriell both stated
on second considerations they felt they should uphold zoning which will not allow the
approval of Nr. Tydeman' s request. It was the consensus of the commission that it
wo~ld not be proper to grant conditional useor variance according to ordinance for
this type of business. The only way this business could be ~11 owed is by rezoning and
commission didn't feel this residential area sh0~ld be rezoned. Del Peters made
motion the commission rescind the recommendation to city council for a conditional
use permit and commi ssion recommend the council deny Mr. Tydeman' s variance request.
Menard seconded with ~11 members votin~ in favor of motion with the exception of Ed
Reese who abstained from voting because of being a new member this evening.
ZONING OFFICER._- It was discussed by commission the need of a zoning officer to enforce
zoning laws. Rodney Parrish recommended the council appoint the building inspector
to be the zoning officer. Peters seconded the motion ~ith an unanimous vote in favor
of motion
REQUEST TO OPERATE MOBILE HOME SALES BUSINESS WITH TRAlV,~R AS OFFICE - LOwell Allen asked
what the possibility of operating a business in trailer unit wo~ld be.on property located
on corner of West Burnside and Yellowstone. Commission member Parrish informed Mr. Allen
sewer is not available to this property and it would be his responsibility to inst~l
sewer to the property. Mr. Allen stated the property on the corner of ~ast Burnside
and Yellowstone was also being considered and asked the commissioners feelingdon using
a mobile office. The commission said they felt a business as such could be allowed to
use a mobile unit for an office. Mr. Allen was told he would be required to request
a variance to use a trailer as an office and the commission would hold a public hearing ko
to take action on same. Commission also informed Mr. Allen he might be required to
install curb and gutter on property where business is located and he would need to check
with council on this.
REQUEST TO USE TRAILER AS SUNDAY SCHOOL CLASSROOM - Pastor Franklin Sedwick, Church of
God Prophecy, 155 Valenty Rd. was present to discuss possibility of being granted a
variance to use a mobile home for classroom use. Commission told Pastor Sedwick they
felt a trailer would not be acceptable because of fire code regulations.
CLERK to send out copy of public hearing notice to commission members at the time of
publication.
APPOINTMENTS for committees to be renewed on July 1, 197~.
COMMISSION AND COUNCIL discussed the necessity of keeping the drain ditches open through
Chubbuck.
FOUR-_PLEX UNITS - Rodney Parrish showed the comm~ ssion a plan for two four-plexeS on the
corner of Chubbuck Rd and Hiline. Commission members all thought this was an ideal
plan for this Residential 2-zone and that a variance for same could be granted.
Menard moved meeting adjourned, Reese seconded with all in favor. Meeting adjourned at
10.05 p.m.
