Present: Acting Chairman Jack Menard, Commission members Allen Martin, Del Peters and Ed Reese. Escused - Rodney Parrish, James Branson and Larry Rawlins. Meeting called to order by Acting Chairman Jack Menard at 8:00 p.m. PUBLIC HEARING IT~ - Rodney Clark, Clark Real Estate requests a variance of the Zoning Ordinance requirements to allow the construction of a duplex on the north one-half of Lot 12, Block 2, in the Neider 1st Addition having a twelve (12) foot front yard setback and a rear yard having a depth of nine (9) feet. Boyd Neider, 606 Boyd Street, presented a petition with 110 signatures bbjecting to the proposed variance request. Boyd Neider also read the Neider 1st Addition restrictive covenants which requires at least a 25 foot front yard setback. Jim Chatterton, ~26 Boyd, stated his objection of Boyd Street being a through~ street to serve the new Heights Subdivision and Mr. Chatterton and Mr. Neider presented a petition to deny access to Clark Real Estate Subdivision from the present Boyd Street in Neider 1st Addition with a total of 109 signatures. Ade Zajanc, 686 Boyd, stated traffic was heavy enough~on streets in Neider Addition at the present without opening~$~reet thru into new subdivision. Lee ~rrill, ~928 Joy, proposed a foot traffic path be constructed from subdivision to school area for childrens safety. Acting Chairman Jack Menard informed residents pre. sent the street access had been approved but the petition would be presneted to the council for review, and would be discussed at the regular council meeting Tuesday June 2~.-~ Commission Member Ed Reese made motion the Planning and Zoning commission recommend council deny request for variance of zoning ordinance to construct duplex on north one-half of Lot 12, Block 2 in the Neider 1st Addition having a twelve (12) foot front yard setback and a rear yard having a depth of nine (9) foot. Del Peters seconded motion with an unanimous vote in favor. PUBLIC HEA~ING ITHM - Dan and Ellen Kunz requests a conditional use of the zoning regulations to allow them to erect a sign in front of their new business bud~lding, E1 Cielito Wedding Chapel and REcreation Center, 51~7 Whitaker Rd. Mrs. Kunz requested a signature type sign with the business name to be attached to the building and a spot light to shine on sign. Mr. Kunz also requested to be allowed to place a four foot by four foot sign in front of lot. Mr. and Mrs. Kunz informed commission the sign would be 95 feet from nearest residence property line and 60 feet from their own residence. Commission member Jack Menard requested a quiet sign with soft light re- flection. Dave Higbee with Safety commission has made recommendation to P & Z Commission that the sign, if allowed, be at least seven feet from ground level. Commission member Allen Martin moved the commission recommend the city council approve a A foot by ~ foot quiet shadowed fluorescent lighted sign near street providing the sign is seven foot high and be at least eighty (80) feet from nearest residence and commission also recommends approval of a signature type business name sign to be installed on building and also lighted. Ed Reese seconded motion with all commission members voting in favor. Page 2 - P & Z Miuutes PUELIC HEARING ITeM - Edward F. Boh~er, requests a rezoning of his property which lies in the SW~~ of Section 10, Township 6 Sou~h, Range 3A E., Boise Meridian, Bannock County and west of Yellowstone Highway 91-191 along the ~200 block. Frank Allen , A031 Ronald Road, stated his objection to commercial property inasmuch as it encroaches very close to his residential property. Mr. Allens strongest concern was objection to the possibility of Ronald Road being extended into this commercial property. After further discussion Del Peters made motion the commission recommend the city council rezone Mr. Bohrer's property which is zoned Residential 3 -Livestock to Commercial General (C-3). Mr. Peters ~lSo recommended that at the time of developing this rezoned commercial property a screening fence be installed between commercial and residential zones. Ed Reese seconded motion with an unanimous vote in favor of motion. ENGINEW~ SPECIFICATIONS - Commission member Jack Menard said he felt a complete set of engineers specifications for subdivisions should be prepared and presented to subdividers when pre-application submitted. ANNEXATION OF PROPERTY north of the Church lateral west of Hawthorne Road to the sewer easement and north to north property line of Dell Subdivision. Commission discussed annexing this area. Allen Martin moved the city annex all property east of sewer easement to Hawthorne Road and north to north property line of Dell subdivision.
