Present: Chairman Jsmes Branson, Commission members Allen Martin, Jack Menard Rodney Parrish and Del Peters. Ed Reese attended latter part of meeting, Larry Rawlins excused. Meeting called to order by Chairman Branson at 8:05 p.m. MLuutes of July 2 meeting read and apProved by commission. PUH~IC HEARING IT~; Edith L. Cahoon and Mrs. Lois Moeller requests a variance of mon~ng to allow the placement of a trailer home on property at 203 Burley Drive and owned by Edith L. Cahoon. The request is being made so their agLug parents, Mr. and Mrs. Willard Honeycutt, can live in the trailer and wd~ll be near parents. After some discussion Allen Martin moved the commission recommend variance be granted for a one year period as long as lived in by parents, when mobile home no longer needed by parents the trailer will need to be moved. Mobile home sha~l . be placed on property as proposed by drawing submitted. Del Peters seconded motion. All commission members voted in favor of motion with the exception of Rodney Parrish who abstained from voting. PU~IC HEARING IT~: Max F. Parrish, Secretary and General Counsel of Diverified Investment Group, Inc., requests a conditional use or variance to permit the south 55 feet more or less of a piece of property~ which is 165 ft. x ~55 ft. and lies at the corner of Hawthorne Road and Chastain Drive, to be utilized for four-plex Nse~ The property lies on the west side of Hawthorne Road in the 5000 block. Theron Pollard, president of Diversified Investment Group, Inc., represented the group in the request~and reviewed their request and showed the proposed plans for four-plex use and also the proposed plan for duplex use. The commission showed a proposed zoning map used during public hearings prior to zoning. All property west of Hawthorne Road was proposed to R-2. Excerpts from minutes of June, 1971 showed Mayor Cotant as informing Mr. Chastain the city had decided to zone Mr. Chastains property, Lester Selders property and the Earl Ellis property Residential - 3 Livestock. cony of Allen Martin read a letter he had sent to a party in California in June, 1971 whereby he had informed the party that the property proposed for multiple dwellings close to his property had been zoned Residential - 2. M~x Parrish stated it was his understanding the property is zoned R-3 on the north and the 58 feet on the south was the portion remaining in Zone 2. Mr. Parrish further stated he felt the engineer and acting Attorney Martin Ward were of the same opinion. Jack Menard reported Attorney Don Burnett said if a difference of opinion in the zone of certain property comes up, the Planning and Zoning makes recommendation and the city council makes the decision of the intended zone. Mr. Burnett also informed Councilman Menard that the number of people could be far denser with duplex construction than with the six four-plex construction. Councilman Menard informed commission that he and Attorney Burnett feels a determination should be made on the zone of property involved, Page 2 - PLANNING AND ZONING MINUTES - August 7, 1975 PU~.IC HEARING ITEM: cont'd - Councilman Menard also reported that Attorney Burnett said if Mr. Chastain would ~rant easement to one-half of street iuto school p~operty, Diversified Investment Group, Inc. would be able to build what they have proposed and also use the street which serves the Chubbuck Elementary School as egress and ingress to their development. Commissioner member Jack Menard informed commission if a 30 ft. access street is available into serve the property of one owner this property may develop as many units as the square footage will allow. After further discussion James Branson said the matter would be tabled this evening. Commission member Jack Menard recommended if matter be tabled the P & Z Commission meet and determine recommendation for zone of property prior to council meeting August 12. Del Peters moved matter be tabled until Tuesday evening at 6:0© p.m. when a meeting will be held to determine a recommendation of zone to city council. Menard seconded motion and all commis.~on members voted in favor with ex- ception of Rodney Parrish, who abstained from voting. H~NDERSON MOBILE HC~E PARK - R. Jay Henderson presented plans f~ the develop- ment of their mobile home park. Planning and Zoning members reviewed the submitted plan. The plans show extension of Whitaker Road to the north and south property line, also extension of north and south street running paralell to RE tracks to north and south property line. Development is planned in three phases. Commission member Jack Menard informed Mr. Henderson the ordinance requires a seven foot high screening fence to be installed around park and that fence should be at least 50% solid. Mr. Menard informed all present the city council would request the proposed property to be rezoned to Residentail - ~ and the Hendersons would be required to request a variance to develop ~ mobile park in the R-~ zone. After further discussion Del Peters moved the P & Z commission recommend the council accept preliminary plat of Henderson Mobile Home Park. Martin seconded motion with all commission members ~oting in favor with the exception of Rodney Parrish who abstained from voting. MOBILE HOME XONE - Commi~aion member Jack Menard informed commission Attorney Don Burnett recommended the city provide Mobile Home zones in the city.
