April 3, 1975
Minutes of the regular meeting of the iPlanning and Zoning commission held in the
city mmnicipal building April 6, 1975.
Present: Acting Chairman Jack Menard, Allen Martin, Rodney Parrish, Del Peters
and Ed Reese. Chairman James Branson and Larry Rawlins excused.
Meeting called to order at 8:00 p.m. by Acting Chairman Jack Menard.
Minutes of March 6 meeting read by secretary. Mr. Menard asked for any corrections
or additions to March 6, March ll and March 18 minutes. There be~iug non~ the ~
minutes were approved as written.
PUBLIC HEARING ITEM: Robert and Karen Kennedy have requested a variance of zoning
to operate their business of Custom Drapery at 5122 Hawthorne Road. Mr. Kennedy
explained their business consisted of fabricating drapes in the lower level of
building at 5122 Hawthorne Road. Their business is operated mostly by phone and
referral, with them hanging the drapes in the customers homes.
Lester Selders, 5121 Hawthorne Road stated the place is kept very neat and is
no disturbance at all.
Robert Kennedy requested an unlimited variance. Jack Menard told Mr. Kennedy the
commission would only want yearly review of variance so that the business could
be kept in the same line in which variance was granted.
Rodney Parrish moved the commission recommend variance to zoning ordinance be granted
~i~to allow Mr. and Mrs. Kennedy to operate their business at 5122 Hawthorne Road
as long as they provide adequate offstreet parking and the business does not
constitute a nuisance to neighbors. Variance to be reviewed at the end of each year.
Delmar Peters seconded motion. Voting was unanimous in favor of motion.
PUBLIC HEARING ITHM: Francis R. Beck has requested a variance which will allow
him to construct a four foot high chain link fence across the front of his
property and along east side of his property at 761 West Chubbuck Road.
Mr. Beck explained he has a mongloid child and feels a fence with a height of
four feet would better protect his child from traffic on Chubbuck Road.
Allen Martin moved commission recommend council approve Mr. Becks' variance
to allow him to install a fence four foot high along east and north of his
froSyard. Ed Reese seconded motion. All commission members voted in favor
of motion.
PUBLIC HEARING IT~4: C. Roger Seaton is requesting a zoning variance to allow
the development of a 168 unit Mobile Home Park on the west side of Hiline Road
and lying immediately south of the present Mobile Home Estates development.
Mr. Clarence Smith, architect, told commission they have submitted plans for
a proposed mobile home park and request the commissions consideration on granting
of variance.
Mr. Menard told Mr. Smith and Mr. Seaton the water supply was marginal on the
east side of the tracks. Mr. Seaton asked if l&8 units would create a problem
why did city just approve two large housing developments recently. Mr. Seaton
and Mr. Smith were told these subdivisions have been reviewed for past two years
and area in the area of two good sized wells.
Mr. Seaton asked if it would not be more advantageous to city, where the mobile
park puts in their own water lines, sewer lines and maintains the street, than
a subdivision where city will be required to maintain these utilities.
Mr. Hynek stated he was representing his father from Mobile Manor and he had no
objection.
Mrs. Norgaard, 5060 Hawthorne stated She thought Chubbuck was full of mobile
homes and asked how many the city is going to allow. It was noted by those~
present that people need a place to live.
Mr. Menard told Mr. Smith the city engineer would check the plan to see if it
complies with trailer ordinance.

Roger Seaton informed commission Dale Hancock requested a six foot high chain
link fence on the south of park be installed and he has agreed. Mr. Seaton
also told council a fence with a h~ght of ten foot will be installed along
the railroad right of way.
Ed Reese made motion the commission recommend acceptance of proposed trailer
development by Mr~ Seaton~ subject to engineering appraisal of utilities--water
sewer and streets. Del Peters seconded motion. Roll call vote: Ed Reese, yes;
Del Peters, yes; Allen Martin, yes; Rodney PaRRISH, abstaining; Jack Menard, no.
PARADISE ACRES FINAL PLAT was reviewed by commission, Rodney Parrish requested
the wor~ commercial block be removed from ~eserved Agricultural Transitional
area.
Del Peters moved the commission recommend the council approve the final plat
with commercial block identification to be removed. Allen Martin seconded
motion. All commission members voted yes with exception of Rodney Parrish. Mr.
Parrish voted no.
REIGHTS SUBDIVISION - Robert Clark and Tim Shurtliff, engineer of project, presented
the revised plat of the Heights Subdivision. Mr. Clark and Mr. Shurtliff requested
tentative final plat approval. Commission reviewed the plat. Rodney Parrish
said he felt the park areas should be larger.
After further review, Allen Martin recommended the council accept the tentative
fina~ plat presented this evening, providing it be zoned Residential -2 (two)
and the park areas be fenced by developer with a chain link fence of six foot
height. Street side not to be fenced. Del Peters seconded motion. All comma
ission members~ voted in favor of motion.
Commissiom discdssed ~avimg an additional engineer firm review plats prepared
by Forsgren, Perkins & Assoc. P.A., city engineers. Also discussed ~as the
possible need of a public works director.
