HomeMy WebLinkAbout009 02 76PLANNING AND ZONING MINUTES September 2, 1976 Minutes of the regular meeting of the Planning and Zoning Commission held in the city municipal building September 2, 1976. Present: Chairman Jack J. Menard, Commission Members Dwain Kinghorn, Dee Stalder, Jim Chatterton, Del Peters and Dick Anderson. Members excused' Larry Rawlins, Ed Reese and Clifford Payne. Meeting called to order at 8:00 p.m. Minutes of the Planning and Zoning meeting held August 5, 1976 were read with the following correction: Highland Homes variance extension to read, sidewalk, curb and gutter to be installed under State Specifications by November 1, 1976. Commission Member Dick Anderson made motion to approve minutes as corrected. Del Peters seconded motion with all members voting in favor. Minutes of the recessed meeting of the Planning and Zoning Commission held August 19, 1976 were read. Commission Member Dwain Kinghorn made motion minutes be approved as written. Jim Chatterton seconded motion with all members voting in favor. PUBLIC HEARING ITEM: Dale and Donna Willie have requested a variance from zoning regulations to allow the use of a mobile home for residential purposes at 228 Burley Drive in Chubbuck. Mrs. Willie stated the property is not wide enough to bUild a home on and if they are not allowed to place a mobile home on this property then it would have to revert back to pasture land. Chairman Menard asked if there was any neighbors in attendance, there being none, and Mrs. Willie having a petition signed by the neighbors that they had no objection, Mrs. Willie was told by the Commission that because of an error in publishing the wrong address on the public hearing that a formal motion could not be made at this meeting; but they could be assured that the variance would be granted at the next planning and zoning meeting after a correction was published. PUBLIC HEARING ITEM: John O. Cotant, Jr., has requested that his property at 420 West Chubbuck Road in Chubbuck be re-zoned from Combined Residential- Livestock (R-2L) to Neighborhood Commercial-Livestock (C-IL). Mr. Cotant said that he felt he could utilise his property if it was zoned Neighborhood Commercial-Livestock with restrictions made by the Commission. Wayne Roderick, 4920 Hawthorne Road, read a letter from the neighbors voiceing objection to the re-zoning request. Letter attached to minutes. Chairman Jack Menard asked the feelings o~ the Commission Members. Jim Chatterton said that at the last meeting he had opposed the re-zong as he had felt the concern of the people living in the neighborhood and that he still Was opposed to the re-zoning. Del Peters asked Mr. Cotant when he had firm plans for Highland Homes to move their offices to 420 W. Chubbuck Road, would he be willing to come back before the ccmmission with his request. Mr. Cotant said that Highland Homes would Page Two definetly consider this property for their offices and display area. Carolyn Roderick, 4920 Hawthorne Road, said that if they could be assured that Mr. Cotant would retain ownership of the property they would have no objection to the re-zoning. Commission Member Dwain Kinghorn reviewed the grandfather rights that Mr. Cotant has with his trucking business. Mrs. Ken Carter, 4856 Hawthorne Road, asked Mr. Cotant if they were going to build more four plex units on the property. Mr. Cotant assured her they would not build four plex units at 420 W. Chubbuck Road. Commission Member Dwain Kinghorn stated that he would like to discourage spot zoning but that he felt Chubbuck Road was definetly a commercial area. Gordon Waford, Homestead Road, stated the commission although appointed by the City Council should have the interest of the people in mind when the final decision is made on zoning changes. Chairman Menard said that he would recommend for Mr. Cotant to request a variance if he wished to move Highland Homes offices to 420 W. Chubbuck Rd. Mr. Menard then asked the people in attendance if they would have any objection on a variance request. Mr. Roderick said that they would rather not see a commercial use made of the property but they might be agreeable to a variance. Commission Member Jim Chatterton made a motion to.recommend to the City Council that request of John O. Cotant to have property re-zoned from R-2[ to Neighborhood Commercial-Livestock (C-1L) to be denied. Del Peters seconded the motion. Roll call vote taken: Chatterton - yes, Peters- yes, Stalder - yes, Anderson - yes, Kinghorn - no. PUBLIC HEARING ITEM: The Planning and Zoning Commission will consider what zoning classification should be recommended to the City Council for property proposed to be annexed to the City of Chubbuck. Legal description in Public Hearing notice. Kenneth Orton, Siphon Road, asked if the Zoning would have any affect on annexation. Commission Member Del Peters said that if area is annexed he would recommend Combined ReSidential - Livestock (R-2L) to the England property and then zone Agricultural Transitional (A-T). Chairman Jack Menard read from the Zoning Ordinance No. 98 the requirements of R-2L zoning. Mr. Waford asked if an R-1L zone could be created. Glenn Perry, Hom'estead Road, asked if the property on Homestead could be zoned Agricultural Transitional. Mr. Menard told him that an A-T zone is a planning zone. Mr. Peters asked that they explore an R-1L zone. Commission Member Jim Chatterton made motion to recommend to the City Council that in case of annexation of the property,described in Public Hearing notice, be zoned Agricultural Transitional (A-T) with the exception of Dell Road, which is already established, to be zoned CombinedlResidential - Livestock (R-2L). Dick Anderson seconded the motion. The Commission Members voted in favor with the exception of Dell Peters who abstained from voting. Page Three Commission Member Dwain Kinghorn made a motion to recommend to the City Council a new zone Single-family Residential-Livestock be created. Dee Stalder seconded the motion with four members voting in favor. Dell Peters abstained from voting. EVERGREEN VILLAGE plans were reviewed by the Commission Members. They expressed their approval of the plans and said that a building permit could be issued. Meeting recessed at 11:00 p.m. until September 23, 1976 at 8:00 p.m. Jack J.
