October 7, 1976
Minutes of the regular meeting of the Planning and Zoning Commission
held in the city municipal building October 7, 1976.
Present: Chairman Jack J. Menard, Commission Members Dwain Kinghorn,
Del Peters, Larry Rawlins and Dick Anderson. Clifford Payne and Dee Stalder
were excused.
Meeting called to order at 8:00 P.M.
Minutes of meeting held September 2, 1976 and recessed meeting held
September 23, 1976 were read. Commission Member Dick Anderson made motion
to accept minutes as read. Del Peters seconded the motion. Voting was
unanimous.
PUBLIC HEARING ITEM: Dale and Donna Willie have requested a variance from
zoning regulations to allow the use of a mobile home for residential
purposes at 4532 Burley Drive in Chubbuck. Property is zoned Combined
Residential-Livestock (R-2L).
The hearing on this request was held September 2, 1976; but due to an
error in the publication of hearing final action could not be taken at
that time.
Commission Member Dick Anderson made motion variance be granted to Dale
and Donna Willie to allow use of mobile home for residential purposes at
4532 Burley Drive. Larry Rawlins seconded the motion. The voting was
unanimous.
PUBLIC HEARING ITEM: John O. Cotant, Jr. requests a variance from present
zoning regulations at 420 West Chubbuck Road to allow the residence at that
address to accomodate Highland Homes office and display area. The present
property is presently zoned Combined Residential~Livestock (R-2L).
Mr. Cotant said the home at 420 West Chubbuck Road would be used for offices
of Highland Homes with exception of present room used for office of Cotant
Truck Lines. He said they would possibly set up two homes for display in
the area where the present barn is located and that the truck line would
continue to use the present driveway. Dwain Kinghorn asked if there was
enough square footage to accomodate two display homes. Mr. Cotant said that
he was sure there was room.
Mr. Cotant said that he had talked to the people in the area and that they
had said they had no objection to his variance request.
Commission Member Del Peters made motion that John O. Cotant, Jr. be granted
variance to allow residence at 420 West Chubbuck Road to be used as an
office to accomodate Highland Homes; with two display homes and one storage
building allowed. The set back on the display homes to comply with the R-2L
zoning. That Highland Homes is to use the present access on to West Chubbuck
Road. This variance granted for a period of one year at which time owner can
come in for a renewal of variance. Larry Rawlins seconded the motion. The
voting was unanimous.
BAR X TRACTS: Daniel Dailey representing Forsgren and Perkins presented the
final plat of the Bar X Tracts. The Commission stated all property owners
had not signed plat - therefor they could not act upon it.

GLEN MARSHALL INSUSTRIAL PARK: Bob Thompson, of James Voeller and Associates,
presented a preliminary plat of Glen Marshall Industrial Park. He said that
it was to be the type of development to build to suit tenant. A
discussion followed on Lot 9 and the necessity of sidewalks along the
access road. It was determined that the cul-d-sac at the end of the access
road would allow trucks to turn.
Commission Chairman Jack Menard read recommendations of John Alder, City
Engineer.
Commission Member Dwain Kinghorn made motion to recommend to city council
to accept preliminary plat of Geln Marshall Industrial Park with recommendations
made by City Engineer and in compliance with city ordinances. Dick Anderson
seconded the motion. All voted in favor. Commission Chairman Jack Menard
accepted plan as designated and dated and signed by Jack Menard.
Super 8 Motel and Condiminium: Vic Herbert presented a plan for motel and
condiminium development on the John Powell, Jr. property at 4534 Yellowstone.
A discussion followed on access roads for traffic flow. Chairman Menard
read recommendations of Dan Stuart, Building Inspector. The Commission
voiced approval of the development.
