November 4, 1976
Minutes of the regular meeting of the Planning and Zoning Commission
held in the city municipal bulding November 4, 1976.
Present: Chairman Jack Menard, Commission Members Dwain Kinghorn,
Larry Rawlins, Dick Anderson, Del Peters, Jim Chatterton, Clifford
Payne and Dee Stalder.
Meeting called to order at 8:07 p.m.
Minutes of meeting held October 21, 1976 were read. Del Peters made motion
to accept minutes as read. Dick Anderson seconded the motion with all
members voting in favor.
PUBLIC HEARING ITEM: The Commission will consider whether or not to
recommend to the City Council that the City's zoning ordinance, Chubbuck
City Ordinance No, 98, should be amended to allow, as a conditional use
or otherwise, the establishment, in any commercial or light industrial
zone, of a facility for the storage over a limited period of time of a
restricted number of abandoned, wrecked, dismantled or inoperative motor
vehicles.
Denny Jones of Denny's Wrecker Service was present and asked what requirements
were in Ordinance # 98 that pertained to wrecked cars. He stated that his
business is a necessary operation for the community and that he had been
located in the present area since about 1969. Chairman Menard said that
he thought Mr. Marvin Christensen would be satisfied with an area that
would hold about ten cars. Mr. Jones replied that he operated a different
type of business from Mr. Christensen and would like to have the Commission
state what constitues a storage area. He said that he would be willing
to put a screening fence up that would block the view. He also said that
Mr. Christensen had contacted him to see if he would store his cars on a
temporary basis.
A lengthy discussion followed on the merits of allowing property in a
commercial area to be used for industrial purposes.
Commission Member Del Peters made a motion not to recommend to the City
Council that the City's zoning ordinance, Chubbuck City Ordinance No. 98,
should be amended to allow, as a conditional use or otherwise, the establishment
in an commercial or light industrial zone, of a facility for the storage over a
limited period of time of a restricted number of abandoned, wrecked, dismantled
or inoperative motor vehickles. Dick Anderson seconded the motion. All
Commission Members voted in favor with the exception of Dee Stalder who
voted no.
CHATTERTON SUBDIVISION FINAL PLAT: Bob Thompson,of Jim Voeller and Associates,
presented the final plat of the Chatterton Subdivision. John Alder, City
Engineer, had several questions pertaining to the plat. The streets would
need to be dedicated and a twenty foot easement would be required. He also
said that no street frontage should be located 300' from a fire hydrant as
measured along curb lines. Therefor two fire hydrants would be required.
Commission Member Dick Anderson made motion to recommend to the city
council the Chatterton Subdivision final plat be approved with the recommendations
of the City Engineer, John Alder. Dee Stalder seconded the motion. The
voting was unanimous.

AZTEC PARK SUBDIVISION: Bob Thompson, Engineer of Jim Voeller and
Associates, presented the preliminary plat of Aztec Park Subdivision. John
Alder suggested that Boyd street be a through street, connecting Alturas and
Heights Subdivisions.
A discussion followed on the recommendations of the engineer, he said the
roads should be straightened out and that the sewer and water lines should
not cross. Also that no lot frontage should be more than 300 feet from
fire hydrant. Roger Seaton said that he prefered not having such long
straight streets. Mr, Alder replied that for snow removal straight streets
were easier to clear.
Commission Member Jim Chatterton made motion to recommend to the city council
to accept the preliminary plat of the Aztec Park Subdivision with the
recommendations of the City Engineer, John Alder, The streets to be straightened,
Boyd street to extend to the west end of subdivision and to abandon Castle Street.
Toluca Street to be extended to the north end of subdivision. Dick Anderson
seconded the motion. Roll call vote: Chatterton - yes, Peters - yes,
Anderson - yes, Rawlins - yes, Kinghorn - yes, Payne - no, Stalder - no.
Chairman Menard reported that he and Mayor Cotant had met with Dan Mabey,
Bannock County Planning and Zoning Commission, and had discussed the
formation of a committe to be called B. I. C., Bannock Impact Commissio.

'J~Due to the re-organization of the Planning and Zoning Commission it was
necessary to determine the terms of the Commission as spelled out in Ordinance
#169'i which needs be accomplished by lot. The Commission Members drew
lots and their terms are as follows:
