MINUTES - June 3, 1976
MinuteS of the regular meeting of the Planning and Zoning Commission held in the
city municipal building June 3, 1976.
Present: Acting Chairman Dwain Kinghorn, Allen Martin, Larry Rawlins and Jack Menard.
Chairman James Branson, Dell Peters and Ed Reese were excused.
Meeting called to order at 8:25p.m.
Minutes of the Meetings held April 1, and May 10, 1976 were read and approved
as written.
Acting Chairman Kinghorn welcomed Jack Menard as a member of the Planning and
Zoning Commission.
PUBLIC HEARING ITEM: A proposal by Michael R. Wade, 4627 Sawtooth requesting a
variance be granted to allow him to build a garage on his corner lot with a front
yard setback and rear yard setback of less footage than required in zoning ordinance.
Property is located in a Multiple-family Residential (R-3) zone which has a front
yard and rear yard setback requirement of twenty feet.
Allen Martin asked Mr. Wade if he would consider building a 14' garage in order
to comply with the city ordinance. Mr. Wade stated he would prefer having his
garage 15.6' as he used his garage as a work shop.
The Commission members reviewed the sub-division plat of the Country Acres 4th
Addition.
Allen Martin moved to grant Michael Wade a variance to allow him to buld a garage
as shown on drawing with a 12.6' back yard with a front yard setback of less footage
than required in zoning ordinance. The garage to be 15.6' with the garage set back
from the front of the house. Jack Menard seconded the motion with all members
voting in favor.
PUBLIC HEARING ITEM: Kim W. Cooper, 5555 Yellowstone #16, representing the East
Congregation of Jehovah's Witnesses is requesting a conditional use permit to
construct a church building on the followsing described property. A tract of lannd
in the NE¼NW¼ of Section 11, Township 6 South, Range 34 EAst of the Boise Meridian,
Bannock County, Idaho described as follows: Commencing at the West 1/16
Corner on the North line of said Section 11, Then N 89o59'32'' E, along the North
line of said Section, 425.00 feet; Thence South, 299.00 feet to the True point
of beginning; Thence continuing South, 197.00 feet; Thence N 890 52'32" E,
161.49 feet; Thence North, !97.00 feet; Thence S89°52'32"W, 161.49 feet to the
True Point of Beginning and containing .73 acres more or less. The property is
presently zoned Agricultural Transitional.
Mr. Kim W. Cooper and Gary Cossaboom representing the East Congregation of
Jehovah's Witnesses bro~ the plans of the church building they were anticipating
to build along with the parking area and landscaping.
Mr. Mark Bunce stated he had no objection to the building of a church
in this area but that he was concerned as to what their plans were to develop
the road back to this area. Allen Martin and Dwain Kinghorn expressed concern
about the road also and if Doyle Chatterton had been consulted as to the development
of the road. Mr. Cooper asked if they could build and use the road as it is now,
the Commission members told them the road would have to meet city specifications.
Mr. Cooper and Mr. Cossaboom replied one of their members is a contractor, Mit
Campbell, and theywould like to work with Doyle Chatterton and Mark Bunce to develop
the road.
A discussion followed on how they would hook into the sewer. They were told
they would have to hook into the sewer line opposite their property , belonging

to Doyle Chatterton and that they would have to install man holes.
Mr. Cooper ased if they could put slag on their parking lot and mark it
with rustic marking. The Commission members said that they would recommend
putting slag on their parking lot for a period of one year and then it would have
to be black topped. They felt like they would have a better paving job by letting
it set for that period of time. They also told them that they felt the rustic
markings would add to their development.
The Commission Members informed Mr. Cooper and Mr. Cossaboom they would have
to resolve the use of the road before any action could be taken on their
request.
Commission member Jack Menard made a motion that as the conditional use
permit was in error the city should pay for the Public Hearing that would be
needed for re-zoning. This property consists of less than one acre and so this
property will have to be re-zoned rather than a conditional use. Larry Rawlins
seconded the motion with all members voting in favor.
