December 2, 1976
Minutes of the regular meeting of the Planning and Zoning Commission held
in the city municipal building December 2, 1976.
Present: Chairman Jack J. Menard, Commission Members Dwain Kinghorn,
Clifford Payne, Dell Peters and Dick Anderson.
Meeting called to order at 8:00 p.m.
Minutes of the meeting held November 4, 1976 were read. Commission Member
Clifford Payne made motion minutes be adopted as read. Dell Peters seconded
the motion. The voting was unanimous.
PUBLIC HEARING ITEM: a public hearing on the question of what recommendation
it shall make to the Chubbuck City Council on zoning classification(s) to be
adopted with respect to the following lands if such lands are annexed to the
City. Said lands, commonly known as the propoSed Aztec Park Subdivision,
are located adjacent to the existing western boundaries of the City of Chubbuck.
Ray Henschied expressed interest as to the disposition of property as his
in-laws, the Hulls, have property directly west of the proposed Aztec Park
Subdivision.
Ruth Bilyeu Johnson also owns property west of the Aztec Park Subdivision.
She said that Jim Voeller and Associates have survey stakes on her property
and that she definetly does not want to have her property zoned. She said that
she was emotionally involved with the farm area-that she realized that all
the new people coming in to the area had to have homes but why do developers
have to take prime farm land and turn it into housing. She expressed regret
that Planning and Zoning Commissions allow this to take place. Chairman Menard
told Mrs. Johnson that they had no control over who farmers sold their property
to. Chairman Menard asked Bob Thompson, Engineer for Jim Voeller and Associates,
if he could enlighten Mrs. Johnson as to why survey stakes were on her property.
Mr. Thompson said in surveying the property the line went seven feet inside of
the fence line. He said that he was sure that Mr. Seaton would either buy or
sell this seven feet of property. Mrs. Johnson said that she had no intention
of buying back her own property.
Mr. Henschied said that the main access irragation ditch is along the fence
line and unless due caution is taken they could create considerable problems.
Commission Member Dell Peters said that the legal matter of survey should
be straightened out to the satisfaction of those concerned. Mr. Henschied
asked Mr. Thompson is the survey had been made where the fence is in relation
to the stakes. Mr. Thompson said that he was sure the developer would write up
quit-claim on the seven feet of property involved.
Commission Member Dwain Kinghorn made the motion to recommend to the City
Council that if and when the Aztec Park Subdivision is annexed to the City
Of Chubbuck it be zoned Residential Two (R-2) - providing the dispute of the
west boundry line of Aztec Limited property and the Floyd Johnson and Hull
property be resolved to the satisfaction of the Hull and Johnson families by
December 14, 1976. Otherwise motion to become null and void.
Dell Peters seconded the motion. The voting was unanimous.
BAR X TRACTS: Klane Forsgren, Forsgren,Perkins and Associates, representing the
property owner, Steve Clinkscales, said he had agreed that a cul-d-sac on each
end of Charity Road would be satisfactory.
Commission Member Dick Anderson made the motion to recommend to the City Council
that a cul-d-sac on each end of Charity Road in the Bar X Tracts be allowed as
shown on plan dated and signed by Jack J. Menard.
Cli~ord-Payne seconded the motion. All voted in favor.
PRE-APPLICATION - DIXON-MANNING SUBDIVISION: Klane Forsgren, Forsgren,
Perkins and Associates, presented the pre-application plat for the Dixon-
Manning Subdivision. He said that it is located between Philbin and Rio
Vista Roads.
A lengthy discussion followed on the development of subdivisionSoutside
city limits but wanting city services. Commission Member Dick Anderson
asked if the present treatment plant would handle all the developments that
are planned. Mr. Forsgren said that when a municipality has a sewer it is their
responsibility to expand to meet the demand.
Chairman Jack Menard told Mr. Forsgren the pre-application permit was
satisfactory and that they could go ahead with the preliminary plat.
CHUBBUCK PLAZA INDUSTRIAL PARK FINAL PLAT: John Alder, City Engineer, discussed
the final plat of the Chubbuck Plaza Industrial Park. Chairman Menard told
Mr. Bob Thompson that Mr. Marshall should be given notice that if the road
is not extended the cul-d-sac will have to be installed. Mr. Alder's
recommendations are: No easement lines shown for telephone - should have
at least 20' easements. 78' north of present propery - street which will
extend to Pocatello Industrial Park will be completed, with curb, gutter and
black top and to be dedicated to the city. Ample radius on north end of street
be included and possibility of an additional man hole.
Commission Member Del Peters made motion to recommend to City Council Chubbuck
Plaza Industrial Park final plat be accepted with recommendations of John
Alder. Clifford Payne seconded the motion. The voting was unanimous.
REVIEW OF REVIEWING FEE FOR SUBDIVISIONS: a discussion followed on the
reviewing fees. The Commission asked that the present fee schedule be doubled
and a new fee schedule be set up for twenty-five or less lots for twenty-five
dollars. Engineer Alder said that as much time is spent reviewing small sub-
divisions as larger ones. The Commission therefor felt this would be more
equitable.
ZONE FOR IMPOUNDED CARS: Chairman Menard said that zoning is for the protection
of the people; that if those who need land for wrecked or impounded cars find
a piece of property that they think would be suitable they can come to the
Commission to have it re-zoned~Re-zo~i~.g wo.u~.d be ¢o~±dered. . ~
Commission Member Dick Anderson made mo~lon ~nat the v/anning ana Loning
Commission believe that under Ordinance #98 their is sufficient zones
to take care of all requests. Dell Peters seconded the motion. All voted in
favor.
Other Items Discussed:
1. Zoning officer should be attendance at regular Planning and Zoning
meeting.
2. Impact area - West of center line of Rio Vista Road, North of center
line of Tyhee Road, East - possibly somewhere close to new water tank
north and south.
3. Update survey on sewer from Forsgren & Perkins and Associates. What
the orginal intent of the present sewer was when installed.
