August 19, 1976
Minutes of a recessed meeting, August 5, 1976, of the Planning and
Zoning Commission held in the city municipal building August 19, 1976.
Present: Chairman Jack J. Menard, Commission members Dwain Kinghorn,
Dick Anderson and Jim Chatterton, Clifford Payne. Larry Rawlins and
Dee Stalder were excused.
Meeting called to order at 8:20 p.m.
PUBLIC HEARING ITEM: Kent J. Parrish, President of Land Investments, Inc.
requests a variance be granted to permit development of a trailer park
west of the Fort Hall Canal and east of Hiline Road directly east of Mobile
Manor on real property more particularly described as follows: Beginning
at a point that is West 415 ft. more or less from West 1/16 corner on the
North line of Section 11, T. 6S., R. 34 E., B.M. Bannock County, Idaho; said
point falls in the middle of the Fort Hall Canal as it intersects said
section line, thence southerly along the centerline of said canal a distance
of 1,550.0 ft., more or less, thence westerly, parallel to the North Section
line a distance of 80.0 ft., more or less to the centerline of said Hiline
Road to an intersection with the North line of Said Section 11, thence
easterly along the section line 110.0 ft., more or less to the Point of
Beginning, Contains 5.6 acres more or less.
Chairman Jack J. Menard read a letter from Robert L. Thompson, P.E. of
James Voeller and Associates, Inc. Letter attached to minutes.
The Commission Members discussed each point of the letter with Klane
Forsgren, Engineer for Land Investments, Inc. Jack Menard asked Mr.
Forsgren about his meeting with the people of the Fort Hall Canal Company.
He said that the Canal Company was concerned about the future use and need
of the Canal. He said that they felt some type of fence should be put
up between the trailers and the canal. He said that Max Parrish had been
agreeable to this.
A discussion followed on the access roads, the parking areas and the storage
areas also the future expansion of Hiline Road.
Chairman Jack Menard then tabled the Land Investment, Inc. request until
they submit plans that conform with City of Chubbuck Ordinance # 107 and
the Hiline Raod expansion.
HAWTHORNE TERRACE SUBDIVISION: Chairman Jack Menard read the City Council
Minutes of August 10, 1976 pertaining to the Hawthorne Terrace Apartments.
Chairman Menard and Commission Member Kinghorn questioned the legality of
individual owners being on private sewer lines.
Commission Member Dick Anderson made a motion to pass the plans to the
City Council with the Planning and Zoning Commissions approval and that
they have an alternate Engineer check out the sewer easement. Jim Chatterton
seconded the motion with all commission members voting in favor.
AZTEC ACRES SUBDIVISION: Mr. Paul Remay and Mr. Mike Bright presented
the Plans of the Aztec Acres Subdivision. This subdivision lies within
the one mile limit of the City of Chubbuck - therefor under city jurisdiction.
A discussion followed as to the size of the lots - they do not meet the
one acre requirement of the City of Chubbuck Subdivision Ordinance. Mr.
Klane Forsgren, Engineer for the Aztec Acres Subdivision, discussed the
size of the lots and also the well and pump. The Commission Members
questioned Mr. Forsgren about the water supply to the subdivision. He
stated that it would be more than adequate. The Commission Members asked
that 6" water lines be installed rather than 3" so that at a future time
if the City of Chubbuck should annex this area the streets would not have
to be torn up.
Commission Member Jim Chatterton made a motion to submit the Preliminary
Plat to the City CounCil for approval with the notes attached to the Plat
to be reviewed. Dick Anderson seconded the motion with all members voting
in favOr.
SITE PLAN DEVELOPMENT FOR UNITED CAMPGROUND AREA: Mr. Russ Konrad and Mr.
Noel Breneman presented plans for the development of a Motel, Resturant and
Apartment Complex at the former United Campground Area. Mr. Konrad asked
that they review his plans and give him the approval to start on two
of the Apartments. Jack Menard asked Mr. Breneman what his plans were for
the paved road that is already in the area. Mr. Breneman stated that he
would prefer to retain this road as a private road as he only has the
property leased.
A discussion followed on the drainage in the area, the water system,
where the water lines should be placed and the placing of fire hydrants.
Mr. Konrad asked for a letter stating the requirements that are
necessary for him to start developing two of the apaprtments. Mr. Menard
said that he and Mr. Forsgren would prepare a letter for him so that
they could proceed with their plans.
Dick Anderson moved the meeting be adjourned at 10:40 p.m.

Dear Sirs;
Hiline Road will be a four (4) lane highway in the
near future and all future development along tIiline
should be planned with this in mind.
The Legal Centerline of Hiline Road is not established
on the preliminary plat filed. If the Centerline sho~m
were used as the true Centerline and a forty foot half
street right of way was laid out on the plat, 0.6
acres of the planned usable acreage would be road
rigflt of way.
~]~e west right of way for the Fort Itall Canal varies
in width from 120' at Cht~buck Road, to ah~ut 250'
at a point 1070 feet south of Chubbuck Road, to about
95' at the south end of the proposed mobile home park.
~is places the entire n~bile home park within the
right of way of the canal. The canal company therefore
has access rights and any development within the
right of way must be approved by the Fort Hall Canal
The canal barfl( is about 12' higher in elevation than
the proposed mobile home locations. Tne water ele-
vation in the canal would be about 4' higher than the
mobile hon~s and if the canal b~unk was 12' wide at the
top smd the side slopes were held to a 1½'1 slope,
the entire 50' of right of way shown 'on the proposed
plat would be used up. ~]~is would place the row of
mobile homes adjacent to the bank right at the toe
of the fill slope. They would not have back yards.

All of the proposed storage area would be within the 80'
right of way of Hiline Road or within 50' of the canal
centerline. Part of the storage area would be on the
fill bank of the canal. Access to the storage area
would have to be from Hiline Road.
Six access areas are shown on the plat. To comply
with the proposed ordinances and existing agreements
between the City of C?,ubbuck, Pocat~llo, and Bannock
County, there should be only be two access areas onto Hiline
Road from the pl~posed development.
Chubbuck ordinance #107 states that all mobile hor~s
mu,~t abut on a roadway. It is questionable whether
6 of the proposed units ,abut onto a roadway.
The north parking area would only be about 10 feet
deep when Hiline right of way is extended to 80 feet.
The second parking area from the north ~ould be 30 feet
deep, and the most southern parking area would vary
from 30 feet to 12 feet deep.
After having reviewed the preliminary plat of ~.~bile
~anor Extension, I feel that the area to be developed
is not large enough to handle 24 mobile home units.
~he propOSed ~,bbile ~tanor F~%ension should be plmmed
with the 80' Hiline right of way in mind taking .into
account the change in elevation which will occure ag-
ainst the canal bank.
Two fire hydrants would berequired for an area over
1,000' in width, the plan just shows one.
