HomeMy WebLinkAbout008 05 76PLANNING AND ZONING MINUTES August 5, 1976 Minutes of the regular meeting of the Planning and Zoning Commission held in the city municipal building August 5, 1976. Present: Commission Chairman Jack J. Menard, Dee Stalder, Clifford Payne, Ed Reese, Jim Chatterton, Dick Anderson and Dwain Kinghorn. Meeting called to order at 8:00 p.m. Minutes of the meeting held July 1, 1976 were read with the following correction: The Glade Kynaston proposal on zoning have the following added - If property owners were in agreement. Commission member Dwain Kinghorn moved minutes be approved with correction. Dee Stalder seconded the motion. The vot~was un- animous. ~ PUBLIC HEARING ITEM: Kent J. Parrish, President of Land Investments, Inc. requests a variance be granted to permit development of a trailer park west of the Fort Hall Canal and east of Hiline Road directly east of Mobile Manor on real property more particularly described as follows: Beginning at a point that is West 415 ft. more or less from West 1/16 corner on the North line of Section 11, T. 6S., R. 34 E., B.M. Bannock County, Idaho; said point falls in the middle of the Fort Hall Canal as it intersects said section line, thence southerly along the centerline of said canal a distance of 1,550.0 ft., more or less, thence westerly, parallel to the North Section line a distance of 80.0 ft., more or less to the centerline of said Hiline Road, thence northerly 1,550.0 ft., more or less along the centerline of said Hiline Road to an intersection with the North line of Said Section 11, thence easterly along the section line 110.0 ft., more or less to the Point of Beginning Contains 5.6 acres more or less. If rezoning is required, a Residential -2 Trailer zone (Mobile Home Residential) is requested. Commission Member Kinghorn asked Mr. Parrish if the lots met the square footage that is required. CommissiOn Chairman Menard asked if an independent engineering study had been made. He also asked Mr. Parrish if the storage area and the playground area would be in compliance with the Mobile Park Ordinance. Commission Member Kinghorn said that with other developments in the city a park had been required and that he felt some consideration should be given to a park or a contribution toward a park for the people in this particular area. M. C. Doty, 5049 Whitaker Road, stated he was opposed to the variance request. He was concerned for this property to be used as a trailer park. He felt there was a real danger with the canal and children playing and living so clOse to it and that Hiline Road was narrow and had a heavy load of traffic now without adding to it. Mr. Doty stated that he had not been able to find any right of way for the canal or Hiline Road and this should be resolved before any development takes place. Mr. Menard told Mr. Doty that a study had been made by the City on the canal right of way and also the road at condiderable expense Commission members voiced concern that traffic would be backing out on to Hiline Road. Commission Chairman Menard esked that an independent engineer review the plans as to the dangers of the canal and the Hiline Road. Commission'Member Dick Anderson made a motion to table the variance request of Kent J. Parrish, president of Land Investments, Inc., until the study is made. Jim Chatterton seconded the motion. The voting was unanimous. PUBLIC HEARING ITEM: John O. Cotant, Jr., 420 West Chubbuck Road requests his property be rezoned from Residential - 2L (Combined Residential-Livestock) to C-3L (General Commercial - Livestock). Real property at 420 West Chubbuck Road is more particularly described as the east 251.02 ft. front and 198.96 ft. rear of Lot 16, Neider subdivision, which contains 1.64 acres. Mr. Cotant said he thought his property should have been zoned Commercial at the time zoning took effect. It was being used for commercial purposes at that time. He said that he was not aware that it was not zoned Commercial until two years ago. Quinton Harral, 516 Scott, asked if this request only applied to the home of Mr. Cotant or if it included the trucking area. Mrs. Ken Carter, 4856 Hawthorne, stated they were opposed to the apartments and a commercial area with the infringement on a residential area. She said that two realators had told them it would devaluate their property. Mrs, Harral asked Mr. Cotant if they would develo~ the present home into office space. Mr. Cotant said they had conSidered having ~he offices for Highland Homes there with the model homes set up out in the back of the property. M.C. Doty stated that when an area is zoned Commercial it changes the tax base on property. Commission Chairman Jack Menard said that Neighborhood Commercial - C-1 - allows the commission to protect the neighborhood with restrictions but under C-2 or C-3 there are no limitations. Commission Member Jim Chatterton said that he felt if the property is to be rezoned it should be in favor of the property owners in the neighborhood. Commission Member Clifford Payne made a motion to recommend to the City Council that request of John O, Cotant, Jr. for property at 420 West Chubbuck, be rezoned to Commercial -3L be denied. Ed Reese seconded the motion with all members voting in favor. REVIEW OF VARIANCE : Velbert Jackson, 4743 Yellowstone Avenue, asked for an extension of variance to allow use of mobile unit as an office. Mr. Jackson stated that he had not hooked up to the sewer and water which was one of the conditions of previous variance. He said that unit was for sale. Commission Member Dee Stalder made motion that renewal of variance granted on January 1, 1976 be denied. Dick Anderson seconded the motion. The voting was unanimous. Highland Homes, Robert N. Grimes, General Manager, asked for a one year of extension of variance granted on July 8, 1976. Mr. Grimes said that they were hooked up to water and sewer and that they had requested curb cuts from the State Highway Department but had not recieved them.~ Commission Member Ed Reese made a motion to extend the variance request of Highland Homes to use a Boise Cascade home as an office for their business at 4581 Yellowstone Avenue for a period of one year. With curb and gutter to be installed under state specifications by November 1, 1976. Dwain Kinghorn seconded the motion with the voting unanimous. ITEMS FOR REVIEW: 1. 2. Aztec Acres Subdivision - Paul Remy and Mike Bright Kinghorn Subdivision - Dwain Kinghorn Dan Mabey, Chairman of the Bannock County Planning and Zoning, spent some time reviewing proceedures with the Commission. Chairman Menard appointed Del Peters as Chairman of the Subdivision Sub-Committee with Larry Rawlins as co-chairman. Chairman Menard welcomed Dick Anderson as a new member of the commission'. Jim Chatterton made motion to recess meeting until August 19, 1976 at 8:00 p.m. Ed Reese seconded the motion. All voting in favor. Jack J. Menard, Chairman Ward, Secretary Highland HOmes variance extension to read, sidewalk, curb and gutter to be installed under State Specifications by November 1, 1976.
