Minutes of a special meeting of the Planning and Zoning Commission held
in the city municipal building April 21, 1976.
Present: Chairman Jim Branson, Commission members Dwain Kinghorn, Allen
Martin, Ed Reese and Del Peters.
Meeting called to order at 7:30 p.m.
KAY'S PLUMBING BUILDING PERMIT: Glen Hanway and Buddy Neely reviewed the
building plans for Kay's Plumbing. After some some discussion the Planning
and Zoning Commission inquired of the easement on the east side of his property.
Mr. Hanway stated that Kay's Plumbing has agreed with Gene Crawford to use the
same public right of way access. Mr. Crawford has a 30' right of way
easement and the Planning and Zoning Commission has requested Kay's Plumbing
to furnish an additional 10' for a 40' public right of way access.
Klane Forsgren reminded Mr. Hanway that an extra seven foot was needed for
future widening of Chubbuck Road. Mr. Hanway stated they would be glad to set
their building back far enough so that there would be no difficulty in the future.
Klane Forsgren explained to Mr. Hanway and Mr. Neely that the city council
was going to request curb, gutter and sidewalk on all new commercial development.
Mr. Hanway stated that with the contour of the ground that it was not
feasable to do this at this time; but that they would be agreeable to do so
at a future time.
Commission member Del Peters made a motion to accept the Plans of Kay's
Plumbing with provisions as stated. Allen Martin seconded motion. All voted
in favor.
BAR X TRACTS: Mr. Lloyd Lycon and Klane Forsgren, representing the owners of
the Bar X Tracts presented a preliminary plot plan. Allen Martin asked if
any of the roads would interfer with homes or wells already developed. Klane
explained that one road would have to be off set. There still would be
an existing 13' road back to Block 9.
Allen Martin asked if the people understood that if the plot pl'an was
accepted by the city they would have to accept the city ordinances. Klane
said that they did understand this . Mr. Forsgren asked that the city waive
the road standards and let the people chip and seal Promise Lane and the road
between Block 5 and 6 until any parcel of property be subdivided and then the
roads would be brought up to city standards by the subdivider. Any other roads
that a subdiverd starts on will have to meet city specifications.
Commission member Allen Martin made a motion to recommend to the City Council
that if the City of Chubbuck cannot control quality of control by issuing building
permits instead of Bannock County then the City of Chubbuck relinqueshes all
responsibility for the Bar X Tracts. Commission member Ed Reese seconded the
motion with all commission members voting in favor.
The Planning and Zoning Commission discussed the reviewing of commercial
building permits. It was decided that as long as the city has a building
inspector full time they would no longer review the permits.
