October 5, 1978
Minutes of the regular meeting of the Planning and Zoning Commission,
held in the city municipal building, October 5, 1978.
Meeting called to order at 8:02 p.m. by Chairman Dee Stalder.
Present: Chairman Stalder, Commission Members' Dwain Kinghorn, Becky
Hopkins and Janet Williams, C~tY Engineer., Ste~en~rt.~ Del~ Peters was
excused.
Minutes of the the regular meeting of the Planning and Zoning Commission,
held September 7, 1978, were read by the secretary. Chairman Stalder asked
for any additions or corrections. There being none, Becky Hopkins made the
motion toaccept the minutes as read. Dwain Kinghorn seconded the motion. The
voting was unanimous.
PUBLIC HEARING ITEM: CHURCH OF GOD OF PROPHECY, CHARLES E. WILSON, Pastor?
Chairman Stalder read letter of request for variance for day care center
at 379 Adams.
Mr. Wilson said his church had recently purchased the Mt. Zion Primitive
Baptist Church on the corner of Adams and Lucky, and were desirous of having
a day care center located there. He said they presently operated a small
day care center at their church at 4883 Valenty Road, with only about twelve
children. He said they were fulfilling a need of the public. He stated
they would fence the area with a four foot to six foot fence, they have a large
basement with kitchen facilities. He said an area would be provided for home
work, a Telvision room and children would be supervised until parents picked
them up. He said their curriculum is supervised by the State Welfare Commission
and would serve the community in a Christian manner.
Becky Hopkins asked if the State has quide lines for a day care center. Mr.
Wilson sa~ they were licensed at their present location and have been assured
they will Ticensed if variance request is granted. Dwain Kinghorn asked if it
would provide only day time care. Mr. Wilson said yes, they do provide night
time care at 4883 Valenty; but would not at this location. Dee Stalder asked
how many children they would be taking care of. Mr. Wilson said they would have
about forty children and possibly later as many as seveny five. He said their
license calls for a supervisor with every 6 to 8 children, inSide or outside.
Con Gilmor, 248 Adams, said he would like to protest the day care center. He
said they already have a traffic problem on Adams and he felt they had poor
response from the police department on people speeding.
Lorriane Kofoed, 398 Adams, said Adams is a bad street for children playing
in the middle of the road and that the Mothers do not supervise their children.
Darrell Burrows, 302 Adams, said he worked shift work and he did not like the
idea of the extra noise and traffic.
Wayne Newby, 275 Adams, said he is not against a day care center as such -
other than the traffic problems. He said people outside the area cause the most
problems with speeding, the people in the neighborhood recognise problem and
drive accordingly.

Mr. Newby said because of amount of children in the neighborhood and the
traffic problem, he would object to the day care center.
George Wainscott, 5282 Lucky, said there is a large number of children in
area. He said he would like to commend Mr. Wilson on how they have cleaned
up around the church and that it looked nice. He said he had no objection
to the church but would be strictly against the day care center.
Mrs. Malinda Harris, 5281 Lucky, said they had no objection to the church but
were opposed to the day care center.
Gladys Rippe, 5242 Lucky, said she objected because of the present traffic
on the street.
Nancy Astin, 246 Adams, said there is a traffic problem and that the children
do play in the street.
Gob Gilmore, 213 Adams, he is in agreement to day care center. He said he
would be in favor if some enforcement could be placed upon the road - esPecially
the speed - he would object otherwise.
Mr. Wilson said he would have to agree with the problems presented, there is
a traffic problem, children are playing in the street; he hopes to help with
the children and the reckless driving can be taken care of with police patrolling.
Dwain Kinghorn asked the people "Where do we allow day care Centers?" Children
are born and raised in all zones and day care centers are something we have to
provide. He said there was more of a need for them all the time.
Mr. Wainscott asked if the day care center would be subsidized. Mr. Wilson said
it would be provided for women on welfare, and supervised by the State Welfare
Agency. He said the child abuse and welfare program they have would be working
with children in the Chubbuck area, as there is a high rate of child abuse and
child neglect in this area.
Mr. Newby asked if the day care center at 4883 Valenty could be expanded to
accomodate more children. Mr. Wilson said it would be to costly to renovate
the building.
Dwain Kinghorn told those in attendance if they have a legitimate complaint
on the traffic problems on Adams and Lucky for them to call the Chief of
Police, Arnold Stone.
Janet Williams made the '-~motion to deny the variance request of the Church of
God of Prophecy, Charles E. Wilson, Pastor, to operate a day care center at
379 Adams Steet. Dwain Kinghorn seconded the motion. Voting was unanimous.
Chairman Stalder told Mr. Wilson he had the right of appeal to the City Council.
PUBLIC HEARING ITEM: DON NEVES,is requesting a variance to allow him to
operate a part time, after hours, Photography Studio at 4815 Hawthorne Road.
Chairman Stalder read Mr. Neves letter of request.

Mr. Neves said they presently have a studio in American Falls, Idaho and
would like to expand to the Chubbuck and Pocatello area. He said they would
seal of the garage and use the basement for part of their studio. He said at
a later time they would like to build a double garage in back of the present house.
He said he had contacted the bishop's of the 31 and 35 Church of Jesus Christ
of Latter Day Saints WArds and had been given verbal agreement for use of the
parking lot across the steet, however he felt the present driveway would take
care of the parking as they would probably have only one car at a time.
Chairman Stalder asked about a sign. Mr. Neves said they would like to have
a sign. He was told an illuminated sign would not be allowed.
Becky Hopkins made the motion to grant the variance request of Don Neves to
operate a part time, after hours, photography studio at 4815 Hawthorne Road.
The hours to be from 6:00 p.m. until 9:00 p.m. week days and from 10:00 a.m.
until 2:00 on Saturday, and to comply with the laws regulating signs, subject
to a yearly review. Janet Williams seconded the motion. All voted in favor.
PUBLIC HEARING ITEM: DON STOKER is requesting a variance to operate a small
catering service from his home at 803 Victor. Chairman Stalder read Mr.
Stoker's letter of request.
Donna Stoker, representing Don Stoker, said she works full time and the catering
service would be a part time service only. She said it would be taken care of
mostly by telephone and at the location of needed service. She said she
did not anticipate any additional traffic.
Dwain Kinghorn asked if it would have to meet health standards. She said it
did not just provide for food. They provide a decorating service, back drops,
tables and food. She said they would check with the health department also.
Dwain Kinghorn made motion to grant the variance request of Don Stoker, 803
Victor, to conduct a small catering business from his home, subject to meeting
health and building standards and subject to a yearly review. JanetWilliams
seconded the motion. All voted in favor.
PUBLIC HEARING ITEM: GLEN MARSHALL whether to recommend annexation and zoning
classification with respect to the following parcel of land situated,_ion the
East ½ of Section 34, Township 5 South, Range 34 East, Boise Meridian, Bannock
County, Idaho, said parcel containing 60.39 acres more or less. Chairman
Stalder read letter of request.
Mr. Marshall said they had questioned whether to wait until the new Land Use
Ordinance had been adopted. He said he couldn't see where it would create a
problem now; and they would be able to go ahead and develop their preliminary
plat. He said they are anticipating the development of the whole tract as a
ten year project. Mr. Marshall said a frontage road would contain the traffic
within the project. He said they would have a lead track along the railroad
track and would like to start it this fall.
A discussion followed on the present zoning and how it would affect this tract
of ground.

Dwain Kinghorn made motion to recommend to the City Council for approval
the annexation of property, described in public hearing notice, and requested
by Glen Marshall, also for zoning of Light Industrial subject to review of
City Engineer, Steven Smart. Becky Hopkins seconded the motion. Voting was
unanimous.
OTHER BUSINESS:
REX CHRISTENSEN was present and asked for the city to contact Clark Real
Estate and have them pipe the ditch that runs parallel to Stuart between
Hawthorne Road and the Portneuf District Library building. He stated it
would eliminate a hazard for children walking to school also that a car
had run off into it this summer.
The Planning and Zoning Commission went on record to neCommend action be
taken on this matter.
