May 18, 1978
Minutes of recessed meeting, on land use ordinance, held in the city
municipal building, May 18, 1978.
Meeting called to order at 8:07 P.M.
Present: Acting Chairman Dwain Kinghorn, Commission Members Becky Hopkins,
Dell Peters, Janet Williams and Mike Metcalfe, City Attorney Don Burnett
and City Engineer Steven Smart. Chairman Dee Stalder was present later
in the meeting.
Minutes of recessed meeting held April 27, 1978, were read by the secretary.
There being no corrections or additions, Mike Metcalfe made the motion to
accept the minutes as read. Dell Peters seconded the motion. All voted
in favor.
Land Use Ordinance - General Controls - continued.
Earl Romriell asked that the suggestions that had been made by the
developers be attached to the minutes. Mr. Romriell said he thought another
zone should be provided to protect people that anticipate building on to
their homes or building garages in established areas that are now zoned R-3
or R-4.
Commission engaged in a general discussion on the Height and Area Regulations
on page 9. Acting Chairman Kinghorn asked for a consensus vote on recommendations
to the City Council. All voted in favor.
Recommendations of the Commission are attached to minutes.
CHAPTER III SUPPLEMENTAL CONTROLS
Engineer Steven Smart said a determination should be made on fence
regulations; he said there is a discrepancy in present ordinance on corner
lots.
Dwain Kinghorn asked Attorney Burnett about (2) under Production Dwelling
Courts. Attorney Burnett said that it was to insure that court would not
develop one or two spaces and then move in and not develop anY more spaces.
John Alder, page 14, item 12, said he felt courts should be required to
provide recreational areas of 200 square feet for each lot rather than the
lOOsqUare feet in the ordinance. He said that subdividers are required
to have 750 square in subdivisions.
Salvage Site
(1) to amend to read, "Will be completely enclosed by a minimum 7'
high obscuring fence."
OFF STREET PARKING REQUIREMENTS
A discussion followed on off street parking.
RECREATIONAL or ENTERTAINMENT
1. Dining rooms, etc. to amend to read: One (1) for each one hundred
sguare feet of floor area

Attorney Burnett questioned if under #8 there would be adequate parking
for offices, public or professional.
8. Offices, public or professional administration or service
buildings to be amended to read: One for each three hundred square
feet of floor area.
SIGNS
Engineer Smart questioned some of the requirements on signs.
Attorney Burnett said the sign regulations were mainly for aesthetics.

Do you want to regulate or not.
Do you want the new downtown Chubbuck to look different from
Pocatello or Idaho Falls.

Section 3-5: MISCELLANEOUS SUPPLEMENTAL CONTROLS
A discussion was held on parking of recreational vehicles.
(c) to amend to read: Parking and Storage of Certain Vehicles --
vehicles, campers or trailers of any kind or type without
current license plates shall not be parked or stored in any residential
district other than in completely enclosed garage or carport. However, one (1)
boat and one (1) travel trailer or detached camper may be stored
in the side or rear yard.
DESIGN OVERLAY DISTRICT AND CRITERIA
Attorney Burnett reviewed Chapter four with the Commission.
Dell Peters made the motion meeting be recessed at 10:30 p.m until
May 25, 1978 at 8:00 p.m. Janet Williams seconded the motion. All
voted in favor.
