HomeMy WebLinkAbout003 02 78PLANNING AND ZONING MINUTES March 2, 1978 Minutes of the regular meeting of the Planning and Zoning Commission held in the city municipal building March 2, 1978. Present: Acting Chairman Dwain Kinghorn, Commission Members Becky Hopkins, Janet Williams, Del Peters and Larry Rawlins. Dee Stalder and Clifford Payne were excused. Dwain Kinghorn introduced Becky Hopkins and Janet Williams as new Commission members. Meeting called to order at 8:00 P.M. Minutes of the meeting held February 2, 1978 were read. Acting Chairman Kinghorn asked for any corrections or additions. John Alder asked that his statement be corrected to read, house must have 30' frontage on a major street. There being no other corrections or additions Del Peters made a motion the minutes be approved as corrected. Janet Williams seconded the motion. All Voted in favor. PUBLIC HEARING ITEM: NORMAN AND NANCY NIENDORF are requesting a variance from zoning regulations to allow an office for a business specializing in outdoor photography, at their residence, 4625 Tahoe Place. The property is located in an area zoned Multiple-family Residential (R-3). Mr. Niendorf said no unusual traffic pattern would be created as they would use their home strictly for a mailing address and an office. He said occasionally a delivery truck might bring merchandise. He said that he was a free lance photographer and did his work on location. Larry Rawlins made a motion to grant a variance to Norman and Nancy Niendorf to operate a business specializing in outdoor photography, at 4625 Tahoe Place. Variance is subject to a yearly review. Del Peters seconded the motion. Voting was unanimous in favor. PUBLIC HEARING ITEM: PLANNED COMMUNITIES SUBDIVISION, Steve Smart, Forsgren, Perkins and Associates, showed the plans of the subdivision and said they were asking for zoning recommendations if and when this subdivision was annexed to the city. He said they had provided a park area and were asking that the property be zoned Combined Residential (R-2), Multiple-family Residential (R-3) and Neighborhood Commercial (C-1). He said they would like to have a neighborhood commercial area to provide for the people in the immediate area. He said the subdivision was designed to eliminate through traffic, and that the lots varied in size. rMr. Roy Miller, developer, said the park was located at the rear of the subdivision, and he felt with future growth to the north and west the city could require future developers to add to the park area. Mr. Miller said they had tried to buffer the residential area with the commercial zone. Commission Members asked John Alder, City Engineer, if he had any questions, and he said he had no objection to the engineering. He said there might be areas of concern as the plat is developed. Ray Henscheid, representing Mrs. Iren Hull, said their concern was still the 6½' of property that was involved when this particular piece of ground had come before the Commission. He said they objected to the platting of this piece of ground. He said that Mr. Miller had assured Mrs. Hull ~LANNED COMMUNITIES SUBDIVISION the plat will not include any land west of the fence line. He asked this be resolved before final plat is accepted. Ruth Johnson said she was the owner of the property south of the Hull property and she concurred with statement made by Mr. Henscheid. Mr. Miller said this concerns the western boundry line. He said he had discussed it with the Johnson's and Henscheid's and that when the survey is run the boundry may be moved and at that time they will adjust the westerly boundry of the subdivision. Steve Smart said he anticipated it would be less than 10'. Del Peters. asked Mr. Henscheid if agreement would be adequate. Mr. Henscheid said they had a signed letter from Mr. Miller with a legal description. Del Peters made the motion to recommend to the City Council the Planned Communities Subdivision, legal description in public hearing notice, be zoned as indicated on preliminary plat, subject to letter of agreement between developer and property owners, in the event such lands~are annexed to the city. Janet Williams seconded the motion. The voting was unanimous in favor. Larry Rawlins made the motion to recommend to the City Council the property known as Planned Communities Subdivision be considered for annexation, subject to agreement between developer and property owners to the west. Becky Hopkins seconded the motion. All voted in favor. PUBLIC HEARING ITEM: MRS. DAVID LEE EDMUNDS, 325 Henry, has requested a variance from zoning to allow her to keep their present animals on their property. Property is presently zoned Combined-Residential (R-2). Mrs. Edmunds was not in attendance at the meeting. Mrs. Nancy Young, 335 Henry, said she had talked to Mrs. Edmunds about the animals and they would like the Commission to deny the variance. A discussion followed on keeping animals such as ducks, geese and pidgeons in areas that are not zoned for them. Becky Hopkins made the motion to deny the variance request of Mrs. David Lee Edmunds, 325 Henry, to allow her to keep their animals on their property that is zoned Combined-Residential (R-2). Larry Rawlins seconded the motion. All voted in favor. OTHER BUSINESS: HITCHOCK ACRES SUBDIVISION, John Alder, City Engineer, told the Commision this is a forced plat - negotiated with the City Council. He said the City Council has asked for an additional 20' for the street. He said when sidewalks were installed they would be on private property. A discussion followed on the further develpment of the Hitchcock property. Del Peters made the motion to recommend to the City Council to waive the preliminary plat, and to accept the final plat of the Hitchcock Acres Subdivision. Janet Williams seconded the motion. The voting was unanimous in favor. Variance review of Rick Slaven, 147 W. Linden. Variance was granted March 3, 1977, to allow the placement of a mobile home for residential purposes. Larry Rawlins asked Mr. Slaven if he had complied with the variance to connect to the utilities seperate from the house. Mr. Slaven said he had done so. Larry Rawlins made the motion to re-new the variance request of Rick Lee Slaven, 147 W. Linden, to allow a mobile home for residential purposes, subject to a yearly review. Del Peters seconded the motion. The voting was unanimous. Variance review of Charlie Frasure, to allow a mobile home as an office for Anderson Trucking Company. Mr. Frasure was not in attendance. Del Peters made the motion to renew the variance request of Charlie Frasure, to allow a mobile home for an office for the Anderson Trucking Company, subject to review in one year. Larry Rawlins seconded the motion. All voted in favor. WHITE WATER SUBDIVISION PHASE II: Klane Forsgren, Forsgren, Perkins & Associates, presented the preliminary plans of the White Water Subdivision Phase II. He said new planning and zoning laws, required by the State of Idaho, ask the cities to establish urban services areas. Development should be subject to ordinances which are the most strict. He said there is no legal agreement as agreement was not published between Bannock County and the City of Chubbuck. Commission Members aSked John Alder his opinion of the plat. He said no curb or gutter is shown and the fire hydrants are to far apart for city standards. A discussion followed on the sewer and water and road access. Mr. Forsgren said the homes would have geo-thermol water available for heating if they desired to use it. He said they had consulted with the State Highway Department concerning an'interchange at the 2½ mile road. He said that 2½ mile road would be re-located and connect with Hiline Road at the Empey property. Del Peters said he felt legal advise should be sought before recommendations are made. Larry Rawlins made the motion to recommend to the City Council they consider and review the White Water Subdivision Phase II as presented by Klane Forsgren and they recommend the subdivision be built according to Chubbuck standards. Becky Hopkins seconded the motion. Rawlins - yes; Hopkins - yes; Peters - no; Williams - no; Kinghorn - yes. MOUNTAIN VIEW SUBDIVISION: John Alder, developer, presented a pre-application plat for the Commission Members to review. A general discussion followed on the develpment of this property.
