June 15, 1978
Minutes of recessed meeting on public hearing for the land development
ordinance, held in the city municipal building, June 15, 1978.
Meeting called to order at 8:15 p.m. by Chairman Stalder.
Present: Chairman Dee Stalder, Commission Members: Dwain Kinghorn,
Becky Hopkins, Jane Williams, Dell Peters and Mike Metcalfe. City
Engineer Steven Smart and Deputy Clerk Dorothy Ward. Clifford Payne
and City Attorney Don Burnett were excused.
Page 21, Section 3-4, subparagraph (b), (2), delete "six", substitute
"eight", after"(Density 90% add Standard)"
Page 24, subparagraph (f), (6), strike "shall" substitute "may", after"laid"
strike "and constructed or marked off" substitute "or hand formed and shall
be constructed with approved crack control joints".
Page 24, subparagraph (g), (2) after "thickness" add "over a minimum
of 4 inches of base course".
Page 24, subparagraph (g), (3), delete "clear asphaltic membrane" add
"curing compound".
Page 25, subparagraph (h), (2), strike "shall edger marks and shall be
marked off in", substitute "edges finished with a ½ inch radius edger tool
with approved crack control joints at 5 foot intervals."
Page 26, subparagraph (i), (3) after "density" add"(Standard)" ; delete
"of undisturbed excavated trench materials."
Page 27, (5), second line from top, delete "gravel"
Page 28, subparagraph (k), (2), Pipe - add after "ductile", iron class
50," strike "iron or cast iron only".
Page 29, subparagraph (k), (2), Minimum Depth Pipe Cover - delete "4"
add "5".
Page 30, subparagraph (k), (3), after density add "Standard", strike "of
undisturbed excavated trench materials."
Page 31, Section 3-5, (h), after "compacted" add"by a method approved by
the City Engineer."
Page 31, subparagraph (i), (2), strike "six (6)", substitute "eight (8)"
Page 33, change subparagraph (1) to (m), add new subparagraph (1).
Page 33, subparagraph (1), If at the determination of the City Engineer,
public facilities are being damaged by equipment, erosion or other debris
caused by the developer, owners of specific lots, or their agents or
contractors, the City Engineer may cause that work~ be halted until the
damage is reparired, erosion or debris is cleared from the public facilities.
If necessary, the city reserves the right to accomplish such repair or
cleaning activities and assess the owner or owners of property from which
the erosion originated.

Page 33, Section 3-6, (a) after "development" add "or site"
Page 33, add new paragraph (c), There shall be no changes in development
plans, materials or specifications unless specifically authorized in
writing by City Engineer. All changes accomplished without this
authorization will be removed at the developers expense.
Chairman Stalder said this completed the public hearing on the land
development ordinance.
Minutes of the recessed meeting held June 8, 1978 were read by the
secretary. There being no corrections or additions, Mike Metcalfe made
the motion to acc~ept the minutes as read. Becky Hopkins seconded the
motion. All voted in favor.
Commission Member Mike Metcalfe made the motion to recommend to the
City Council the adoption of the land develpment ordinance, as outlined,
with exceptions of changes outlined in Planning and Zoning minutes, Of
June 8, 1978, marked A thru N and recommendations lettered 0 thru DD,.
by Commisison Members, June 15, 1978:
A. In the absence of legal council, the Commission asked for Page 8,
(2) and (4) be clarified to the City Council by Attorney Burnett.
B. Page 8, (a), after "measuring" strike "22 inches" and substitute
"24 inches"; following line do the same.
C. Page 10, Section 2-5, (a), strike "original and two copies" and
substitute "3 copies."
D. Page 10, Section 2-5: Final Plat Phase - Procedure.
Commission questioned if the Council wants the final plat to come back to
the Land Use & Development Commission.
E. Page 10, subparagraph 2, (a), strike "the original and" substitute
~3 cppies."
F. Page 11, subparagraph (c), to be clarified by Attorney Burnett.
G. Page 11, subparagraph (e), strike "original" and substitute
"reproducible original."
H. Page 12, subparagraph (c), following (3), add (4), Bases of
hearings; (5), All other requirements of Idaho Code pertaining to platting
and plat surveys.
I. Page 13, subparagraph (f), (1), strike "registered professional
engineer or."
J. Page 18, subparagraph (b), (17), strike "vertical" and substitute
"approved."
K. Page 19, subparagraph (c), (3), strike "nor will any lot depth be
less than one hundred feet."

L. Page 19, subparagraph (c), (5), strike "no lot shall have a
width less than 50 feet" and substitute "lot width(s) shall conform to
the land use (zoning) ordinance.
M. Page 21, subparagraph (f), add to end of paragraph "as prescribed
by City Engineer."
N. Page 21, subparagraph (g), add to end of paragraph, "or other
locations."
O. Page 21, Section 3-4, subparagraph (b), (2), delete "six",

Janet Williams made the motion to recess meeting, at 10:15 p.m, until
July 6, 1978 at 8:00 p.m. Dell Peters seconded the motion. All voted in
