Meeting called to order at 8:00 p.m. by Acting Chairman Dell Peters. Present: Acting Chairman Dell Peters, Commission Members Janet Williams, Clifford Payne and Becky Hopkins. Acting Chairman Peters said the motion and second had been made on the land development ordinance. He called for the vote on the ordinance. Hopkins, yes; Payne, yes; Williams, yes and Peters, yes. Clifford Payne made motion to adjourn recessed meeting on land development ordinance. Becky Hopkins seconded the motion. All voted in favor. Minutes of the regular meeting, of the Planning and Zoning Commission, held in the city municipal building July 6, 1978. Meeting called to order at 8:15 p.m. Present: Acting Chairman Dell Peters, Commission Members Becky Hopkins, Clifford Payne and Janet Williams. Chairman Stalder and Commission Member Mike Metcalfe joined the meeting late. Dwain Kinghorn was excused. Minutes of meeting held June 1, 1978, were read by the secretary. Dell Peters asked if there were any additions or corrections. There being none the minutes were approved as read. PUBLIC HEARING ITEM: DONNA PAYNE, requesting a variance from zoning regulations to allow her to operate a bookkeeping service from her home at 4855 Galena. Acting Chairman Peters read letter of request from Donna Payne. Mrs. Payne was not present. Clifford Payne made motion to table this item until August 3, 1978 as more information was needed. Janet Williams seconded the motion. All voted in favor. PUBLIC HEARING ITEM: DE WAYNE STAUFFER, requesting a variance from zoning regulations to allow the placement of a mobil home, on his property at 208 W. Linden. Acting Chairman Peters read letter of request from Mr. Stauffer. Mr. Stauffer was not present. Janet Williams made motion to table this item until August 1, 1978 as more information was needed. Becky Hopkins seconded the motion. All voted in favor. PUBLIC HEARING .ITEM: BOYD L. FULLMER, requesting a variance from zoning regulations to allow him to fence his front yard with a five foot fence. Chairman Dee Stalder read letter of request from Mr. Fullmer. Mr. Fullmer said the lot is a corner lot, that he would like to fence on Tahoe With the five foot fence. He said the neighbor to the West had a clear view BOYD L. FULLMER to the intersection. He said the neighbor had no objection to the fence. Mr. Fullmer said he had the additional driveway already in and that the driveway's were high enough there would be no obstacle for them in backing out of their driveway. Chairman Stalder asked Mr. Fullmer if a five foot fence would be necessary. Mr. Fullmer said he would like it for his small children and for the privacy it would afford. He also said they have some problem with children cutting through their yard on their way to school. Dell Peters made the motion to grant a variance to Boyd L. Fullmer to fence his front yard with a five foot board fence. Becky Hopkins seconded the motion. Peters, yes; Williams, yes; Hopkins, yes, Stalder, yes; Payne, no. OTHER BUSINESS: 1. Robert and Karen Kennedy, review of variance, to operate a drapery~ business at 5122 Hawthorne. The Commission asked if there was any one in attendance to protest the.~ extension of the variance. There being no one, the Commission stated they had observed that the Kennedy's business did not create any problem. Clifford Payne made motion to extend the variance request of Robert & Karen Kennedy to operate a drapery business at 5122 HaWthorne, with a yearly review. Becky Hopkins seconded the motion. All voted in favor. 2. Margaret Ohlin, 4855 Joy, review of variance to keep animals on her property. Chairman Stalder asked Mrs. Ohlin about the animals they had at this time. She said they had 3 adult ducks and 3 adult rabbits they were giving the rabbits away. She said they had built the fence that had been requested. Dell Peters made motion to extend the variance request of Margaret Ohlin to keep animals on her property at 4855 Joy, with a yearly review. Clifford Payne seconded the motion. All voted in favor. 3. Sherlyn Ann Simms, variance request tabled on June 1, 1978, for a mobil home at 4538 Burley Drive. Ms. Simms was not present. Dell Peters made motion to table this item. Becky Hopkins seconded the motion All voted in favor. ' 4. Merrell Subdivision - Tim Shirtliff, Hamilton & Voeller, presented the preliminary plat of the Merrell Subdigision. He said the would like approval on two lots without the street improvement. A general discussion followed on the street, sewer and water. Keith Merrell said Mrs~ Betty Jo Fenwick had given the easement for the road but did not with to participate in it at this time. Engineer Steve Smart said he and Attoreny Burnett had discussed this area and had determined Mr. Merrell could plat the two lots if it would be an all around good plan, conforming with the rest of the area. He said they were of the opinion the city should require the road improvements. Dell Peters asked if all the lots had been sold. A discussion followed on the people requesting building permits. MERRELL SUBDIVISION Becky Hopkins asked if a precedent would be set by issuing a building permit on an un-improved road. Engineer Smart said it 'could create a problem. Mike Metcalfe made the motion to table the preliminary plat of the Merrell Subdivision~ until legal advise can be secured from Attorney Burnett as to the legality of the plat. Del Peters seconded the motion. All voted in favor. The Commission agreed that Mr. Merrell could take the preliminary plat to the City Council and get their imput. Motion was made at 9:55 p. m. to adjourn. Dee Stalder, Chairman Secretary
