HomeMy WebLinkAbout002 02 78Planning and Zoning Commission Minutes February 2, 1978 Minutes of the regular Planning and Zoning Commission meeting held in the city municipal building, February 2, 1978. Meeting called to order at 8:00 p.m. Present: Chairman Dee Stalder, Commission Members Dwain Kinghorn, Larry Rawlins, Del Peters and Mike Metcalfe, City Engineer John Alder and Deputy Clerk Dorothy Ward. Minutes of meeting held December 1, 1977 were read. Chairman Stalder asked if there were any corrections or additions to the minutes there being none Dwain Kinghorn made the motion the minutes be approved as written. Larry Rawlins seconded the motion. The voting was unanimous. PUBLIC HEARING ITEM: Recommendation of zoning classification (s) to be applied to the lands described in legal public hearing notice, commonly known as "Planned Communities Subdivision", in the event such lands are annexed to the City. Mr. Klane Forsgren of Forsgren, Perkins and Associates asked for this item to be withdrawn as there had been an error in the legal description that had been published. Mr. Forsgren asked that this item be considered on February 23, 1978, if a public hearing is held for the Comprehensive Plan, The City Impact area, the land development ordinance and ordinance setting forth zoning classifications. PUBLIC HEARING ITEM: MR. MEL R. HARDY has requested a variance from zoning to allow an office for a manufacturer's sales representative, at his residence, 4935 Spraker Avenue. The property is located in an area zoned Combined Residential (R-2). Chairman Stalder read letter of request from Mr. Hardy. Mr. Hardy stated he would be conducting a telephone business only as his home. He was asked if there would be any deliveries made there and he said there would not be. Mike Metcalfe asked if a sign would be required and Mr. Hardy said there would be no need for a sign of any kind. Dwain Kinghorn said he had driven over to Mr. Hardy's neighborhood and he could see no reason for denying the request for a variance and there were no neighbors to protest in the audience. Mr. Hardy said he would be handling industrial lines. Del Peters made a motion to grant the variance request of Mel Hardy to allow an office for a namufacturer's sales representative, at his residence, 4935 Spraker, subject to review in one year. Larry Rawlins seconded the motion. The voting was unanimous in favor. PUBLIC HEARING ITEM: Christina Pfiefer has requested a variance from zoning to allow her to conduct a one-chair beauty salon in the basement of her home at 135 Stuart Avenue. Her home is located in an area zoned Combined Residential (R-2). Chairman Stalder read Christina Pfiefer's letter of request. Mrs. Pfiefer said she would like to have the shop in her home to be at home with her children. Chairman Stalder asked if she had contacted her neighbors to get their feelings and she said she had not as she was new in the neighborhood. ~wai~-Kinghorn asked Mrs. Pfiefer how the shop would be constructed for safety purposes. She said they would put in another entrance to the basement. Larry Rawlins asked about parking. Mrs. Pfiefer said parking on the street at the side of her home would be adequate. Dwain Kinghorn told Mrs. Pfiefer if the variance was granted a sign two foot square could be erected. Mike Metcalfe made the motion to grant Chritina Pfiefer a variance for a one-chair beauty salon in the basement of her home under condition she provide an out side entrance to said shop and rest room facilities in compliance to state and local code. Variance to be subject to review in one year. Larry Rawlins seconded the motion. Voting was unanimous in favor. PUBLIC HEARING ITEM: GLADE P. KYNASTON haSrequested a change in zoning classification on East Chubbuck Rd, legal description in pUblic hearing notice. The zoning change is requested to authorize an overnight trailer park on the property. Chairman Stalder read Mr. Kynaston's letter of request and asked if if there was any one in attendance to represent Mr. Kynaston, there being no one a general discussion followed on this property. Mr. Klane Forsgren, 4801Whitaker Road, said he was anxious for the city to adopt their comprehensive plan in order to know what the plans were for the develpment of East Chubbuck Road. He said at the present time if it was developed commercial it should be for the benefit of the people who live in the area. He said he did not feel that an overnight trailer park would benefit the people in that area. Janet Williams, 5730 Sorrell, said she would object to an overnight trailer park on this property. Virginia Hardy, 4935 Spraker, said she would be opposed to this development. Del Peters said this item should be tabled as there had been no plans presented to the commission for their studs~ Dwain Kinghorn made the motion to deny the request of change in zoning classification for property owned by Glade P. Kynaston. The motion was seconded by Mike Metcalfe. The voting was unanimous in favor. PUBLIC HEARING ITEM: LYNN HITCHCOCK has requested a variance for construction of a single-family residence on property located on the south side of Evans Lane which lies within an area zoned General Commercial (C-3). Chairman Stalder read letter of request. Mrs. Jerry Hitchcock, 152 Evans Lane, showed a drawing of the area on Evans Lane that they would like to have for their children to buiq~ on. Mr. Hitchcock said that when the sewer and water line was installed on Evans Lane they were told homes could be built there. Larry Rawlins asked about the traffic to the Marcrest Kennels. Mr. Hitchcock said there was no problem. Dwain Kinghorn said in the comprehensive plan the city will be adopting, it calls for Evans Lane to go through to Burley Drive at a future date and that the city was desirous of this.. Engineer John Alder said that the city ordinance states that in order to rec~ve a building permit a house must front a 30 foot major street and be legally subdivided~ Del Peters said his interpetation of the zoning ordinances is to use land as it was when zoning ordinances went into effect. ~ain'Kinghorn said the road should be resolved before any further development is allowed. He said the City is in need of more Commercial area. Mrs. Hitchcock said she felt the city was not using the Commercial area they have at the present time. Del Peters said he was in favor of letting the Hitchcocks build a home on their property. Engineer Alder said zoning does not allow illegal subdivisions and this is an ellegal subdivision. Earl Romriell said the Hitchcock family had always been cooperative with the requests of the City and he to would like to see Evans Lane developed properly. Mr. Hitchcock said they would continue to cooperate but they did not feel they should have full responsibility for the development of the road. Mr. Romriell said that when the city has subdivision ordinance that he felt the citizens could make you abide by it. He said th~ new comprehensive plan would allow this home to be built withou~ sub- dividing. Doctor Dwight Romriell said they had 372 foot frontage on Evans Lane. He said they were concerned with the traffic trying to turn into a 20foot street. Mike Metcalfe made a motion that the variance request of Lynn Hitchcock for construction of a single family residence on prope~tv~located~ on south side of Evans Lane which lies within an area ~a~ommercial (C-3) be granted pursuant to int6rpetation of subdivision regulations by City Council with agreement to provide adequate easement in front of said property to facilitate a 40 foot street. Del Peters seconded the motion. The voting was unanimous in favor. Del Peters made a motion to recommend to the City Council that the city participate in the development of Evans Lane. Mike Metcalfe seconded the motion. The voting was unanimous in favor. OTHER BUSINESS: EMILIO ESQUIBEL, 805 E. Chubbuck Road, said he had the understanding that his property was zoned Combined Residential (R-2). He said that when a building permit was requested to build a duplex they had been denied the permit and told the property was zoned Single Family Residential (R-l). Mr. Peters said he had been on the commission when the zoning went into effect and that he was sure it was the intent to have this property zoned Combined Residential (R-2). The Commission then asked Engineer Alder to try to clarify this item with Attorney Burnett and have this item on the City Council agenda on February 14, 1978. Larry Rawlins made a motion to adjourn the meeting at 10:20 p. m. Mike Metcalfe seconded the motion. All voted in favor. House must have 30' frontage on a major street.
