Meeting called to order at 8:00 P.M. by Acting Chairman Dwain Kinghorn. Present: Acting Chairman Dwain Kinghorn, Commission Members, Clifford Payne, Becky Hopkins, Dell Peters, Janet Williams and Mike Metcalfe, City Attorney Don Burnett and City Engineer Steven Smart. Excused Chairman Dee Stalder. Acting Chairman Kinghorn said the Commission would take up the city impact ordinance after the motion on the comprehensive plan had been completed. Minutes of recessed meeting held April 13, 1978 were read by the secretary. There being no additions or corrections, Mike Metcalfe made motion to accept minutes as read. Janet Williams seconded the motion. All voted in favor. Acting Chairman Kinghorn said the commission was ready to consider the motion made by Mike Metcalfe, April 13, 1978 on the comprehensive plan. Motion was read by the secretary. Becky Hopkins made motion to amend motion to remove Item #6 -reasons as follows' 1. Already a bad traffic area, commercial would make it worse. 2. Small stores attract children with the traffic problem this would create a very dangerous situation. o You have to draw the line somewhere. I believe there should be__no commercial property East of Hiline Road. If you allow exceptions for some, then you must allow them for others. o I believe the area should be checked by the city engineer to see if there is even enough area to do anYthing with - allowing for the planned arterial road. Finally, the comprehensive plan, as I understand it, is designed to encourage commercial property to stay in one, well planned area around Yellowstone Avenue. This exception to that plan would encourage more exceptions and defeat the purpose of the "Plan". Janet Williams seconded the motion. Payne, yes; Peters, yes; Hopkins, yes; Williams, yes; Metcalfe, no. Acting Chairman Kinghorn asked for vote on the Metcalfe motion, as amended, that the City Council adopt the comprehensive plan with certain changes. Hopkins, yes; Payne, yes; Metcalfe, yes; Peters, yes and Williams, yes. Comprehensive plan completed. Engineer Smart explained the bounderies that encompass the city impact area. He said the boundries had been established for about one year, that the Planning and Zoning Commision had worked on it for some time. Acting Chairman Kinghorn explained how the IEastern boundery was determined. IMPACT AREA He said that it would not be feasable for the city to provide sewer and water service East of the present water tanks. Glen Marshall asked if the proposed water storage area, above Chubbuck, b~ing b~lt by Simplots and the City of Pocatello, would be any hazard to the City of Chubbu~k. He ~sked if the land below could be defined as a flood plain area. Engineer Smart said area is East of Interstate and flooding would be doubtful with the Intersate as it is constructed. Dennis Leslie asked could it conceivably cause problems. Earl Romriell said the point well taken - with the area of impact established the City should be concerned about this holding pond. Gordon Wilks said he was sure Forsgren, Perkins and Associates could provide any engineering information that the city might be in need of. J2~t Williams made motion to recommend ratification of the area of city impact defined by ordinance. Becky Hopkins seconded the motion. Voting was unanimous in favor. LAND USE ORDINANCE: Dwain Kinghorn said that on page #6, item (b) "the Mayor, upon consultation with the City Council" should be deleted and "City Council" should be substituted. Kent Parrish asked if the Building Inspector could take care of this item rather than the Mayor. Earl Romriell suggested that the implementation changing Section 2-2, at lines 4-12, be changed to read, "such conflicts should be eliminated by ordinance, following conveyance fo property or request from the land owner,S), when the City Council finds tat such action is timely for orderly transition of the affected neighborhood(s). Bob Vesser said the map in Appendix A does not s-how present residential use. Attorney Burnett said if there is a residential area in the City, which is not shown residential on land use map, then correction will have to be made. He asked the people contact Engineer Smart for correction to be made. He said in Appendix A, I Use Districts (3) the correct wording is there to protect residentail areas. Max Parrish said Parrish Drive should be designated commercial. He said the majority of land owners would like it to be commercial. Gordan Wilks asked if it was the intent of the City Council to re-zone entire city. Acting Chairman Kinghorn said the council wants to protect people living in residential areas from becoming commercial zones. LAND USE ORDINANCE Keith Ankrum, 4612 Yellowstone, said his parents property on Yellowstone Avenue should not be divided into two seperate zones. Bob Vesser aSked if land use ordinance recognizes current uses. Dwain Kinghorn said yes, with recommendations. Max Parrish said when land use ordinance is passed it will affect zoning in all areas of the City. Rodney Parrish asked when the land use ordinance is adopted will there be a place where production homes can be put. Attorney Burnett explained "production dwelling." He said many homes are being built that are compatible to surrounding area - that they were trying to expand scope of housing through out the City. SCHEDULE OF GENERAL CONTROLS - Acting Chairman Kinghorn said Mike Metcalfe had expanded the "schedule of general controls" and he suggested replacing the original schedule with this one. HEIGHT AND AREA REGULATIONS, Dwain Kinghorn suggested the following changes be made - side yard - R--1 total side yare 20', minimum of 8'. iWithin a subdivision 50% of lots should be 80' frontage and 50% 70' frontage. Side yard - R-2 16', mini!mum 6' Within a subdivision 50% frontage 70" and 50% frontage 60' Gordon Wilks asked why establish a minimum lot size. Dennis Leslie asked why does Planning and Zoning Commission have to establish lot size. He said people buy what they can afford. Gordon Wilks said city will discourage subdivisions by establishing lot sizes. Max Parrish asked why there was a limit on height of buildings in Commercial and Industrial zones. Attorney Burnett said he thought for fire protections. Gordon Wilks asked once more why the city had to establish a minimum lot size. Dwain Kinghorn said in able to enhance reasonable growth you have to have lot size. Rob Broadhead said that in some areas of the City of Pocatello homes were built on 50' lots and they were aesthetically pleasing as homes built on 100' lots. Dell Peters said that side yard will control whether a person can build on to his home or build a garage. Engineer Smart said sometimes we try to protect people from themselves - he said excessive controls should not be imposed. He said by requiring 100' frontage you take away from people who cannot afford that size home. Rob Braodhead said that there is a need for all size lots. That you have to build where the demand is. Glen Marshall asked if council would consider extra zones. Mark Bunce said if city is trying to control developers - do it with side yard requirements. Gordon Wilks said the people who are recommending to the commisSion are the ones who deal with buyers. Dennis Leslie said he would be willing to form a committee to establish requirements that they would feel they could work with. Dwain Kinghorn told Mr. Leslie to form a committee and to have their suggestions to the Commission by May 4, 1978 for the Commission to review by May 11, 1978. Kent Parrish, rePresentlmg Land Investments, Inc., Intermountain Industries and the Parrish family, presented a letter requesting that all Parrish property on Parrish Drive not be excluded in Appendix A of the land use ordinance. Acting Chairman KinghOrn clOsed meeting fOr comments. Attorney Burnett said the comprehensive plan and the city impact ordinance was ready for the City Council to hold public hearing. Meeting was scheduled for May 16, 1978 at 8:00 p.m. Janet Williams made motion to clOse the hearing as to comprehensive plan and ratification of impact area map and further motion to recess hearing on land use ordinance and land development ordinance until May 11, 1978 at 8:00 p.m. Dell Peters seconded the motion.
