HomeMy WebLinkAbout004 20 78 Recessed MeetingPLANNING AND ZONING COMMISSION MINUTES April 20, 1978 Minutes of recessed meeting held April 20, 1978, at the City Municipal Building, on the Comprehensive Plan, Land Use Ordinance and the Land Development Ordinance. Meeting called to order at 8:05 p.m. by Acting Chairman Dwain Kinghorn. Present: Acting Chairman Dwain Kinghorn, Commission Members Del Peters, Becky Hopkins,Janet Williams and Mike Metcalfeo City Attorney Don Burnett, and City Engineer Steven Smart. Minutes of recessed meeting held April 15, 1978 were read. There being no corrections or additions, Del Peters made the motion to accept the minutes as read. Mike Metcalfe seconded the motion. Voting was unanimous. Janet Williams asked that her motion of April 13, 1978 on the Comprehensive Plan be withdrawn. Mike Metcalfe asked that his motion to the City Council on the recommendations on the Comprehensive Plan, made April 13, 1978, be withdrawn. PUBLIC HEARING ITEM: Mike Metcalfe made a motion to recommend to the City Council for approval of Comprehensive Plan as outlined with the exceptions below: 1. C-102 - Amend Goal #1 to encourage conversion of agricultural land to residential, commercial or industrial land use with in the corporate bounderies of the city as opposed to the area of city impact, and to delete other language. 2. D-201 - Map following show for planning purposes - Hawthorne Road be an arterial road north to Reservation Road. Philbin and Tyhee Roads are also to be shown as arterial roads. 3. D-203 - Add goal to effect that city cooperate with other governmental and tawing units in the use of public facilities. &. E-101 - Goal & - to amend goals to read in effect that adequate lot size and configuration be required to provide sufficient space for off street parking according to density of development. 5. Land Use Map - to delete all R-1 area development off Interstate Highway to Siphon Road to Rie Vista Road to Philbin Road thus creating R-2 uses through out entire area except where C-1 locations are shown. 6. Include zoning of Limited Commercial, C-l, of same dimensions as other C-1 areas at intersection of East Chubbuck Road and Hiline Road and corresponding change be made in description. 7. E-102 - Goal #5 - Strike last words -"at earliest feasable opportunity" and substitute - "in a manner consistent with orderly transition of affected neighborhoods." COMPREHENSIVE PLAN MOTION 8. To change land use map and description accordingly to eliminate residential uses in area bounded by Siphon Road, Yellowstone Avenue, the C-1 area at the Yellowstone and Tyhee intersection, and the Industiral zone paralleling railroad tracks and to extend the Industrial zone to include said area. Del Peters seconded the motion. Attorney Burnett advised that several elements in the motion represented "material" changes to the originally proposed plan. Therefore, to comply with the Local Planning Act, the hearing should be continued and appropriate notice given. Becky Hopkins made the motion to table motion untd_l April 27, 1978 at 8:00 p.m. Mike Metcalfe seconded the motion. A general discussion was held through out the motion. Mae Hitchcock said she would like to go on record as objecting to their property on Evans Lane being zoned Commercial. R. D. Vesser, 1~7 Parrish Dr., said he objected for his property to be zoned Commercial and that he felt other people owning property on Parrish Drive would also object even though they were not in attendence. Mr. Vesser was reminded that this was long range planning and his property would not have the zoning changed except upon further City Council action, which would not occur prior to a request from the owner or transfer of property. Max Parrish, 250 Parrish Drive, said that everyone in the City of Chubbuck will be affected with the change of zoning. Becky Hopkins said it is not consistant with long range plan to have a C-1 zone at Hiline Road and East Chubbuck Road. John Alder, ~592 Elizabeth, said he did not object to the C-1 ares but he did not think they should be on busy intersections. Boyd Fullmer, 715 Victor, asked that the flouine study be taken out of the Comprehensive Plan. He said he felt like it could be alluded to as to where it could be found. Attorney Burnett said that it was not legally mandated - that it could be put in in a short form. He said that he felt the air quality control was essential for industrial business that might like to locate in this area. He said the insert wd_ll be up dated without the plan being changed. Glen Marshall suggested that the We. st side of Yellowstone from Siphon Road to Tyhee Road would develop better if it was industrial to the railroad tracks and that the proposed Whitaker Road extension be developed. George Shiozawa, 5328 Yellowstone, said he felt this would be the most practical for this area. PUBLIC HEARING ITEM: Land Use Ordinance Rodney Parrish asked about the meaning of "courts" on page #3 under definitions. A discussion followed on the meaning of "Production dwellins" in courts. Rodney · Parrish said major appliance should be deleted. Rob Broadhead said they should delete from "it is intended to be occuppied." Steve Smart, City Engineer, said he felt parking space should be area 9 x 20 feet, however he said the 180' could be included. Rodney Clark asked for the 180' designation be left out with no specific parking size required.
