April 6, 1978
Minutes of the regular meeting of the PLanning and Zoning Commission held
in the city municipal building, April 6, 1978.
Meeting called to order at 8:00 p.m. by Chairman Dee Stalder.
Present: Chairman Dee Stalder, Commission Members Dwain Kinghorn, Janet
Williams, Mike Metcalfe, Clifford Payne and Dell Peters. Attorney Don
Burnett and City Engineer Steven Smart. Becky Hopkins and Larry Rawlins
were excused.
Minutes of the Planning and Zoning meeting held March 2, 1978 were read.
There being no corrections or additions, Dell Peters made the motion to
accept the minutes as read. Mike Metcalfe seconded the motion. Voting
was unanimous.
Chairman Stalder opened the public hearing, pursuant to notice given in
compliance with the Idaho Local Planning act, upon a proposed comprehensive
plan, ratification of an ordinance establishing an area of city impact, a
land use ordinance and a land development ordinance. At the outset of the
hearing, Attorney Burnett advised all in attendance that copies of the
comprehensive plan, land use ordinance and land development ordinance were
availabel from the city clerk; and that, in order to provide further
opportunity for review and comment on these items, the hearing should
be continued to a date certain after imput (if any) during this session had
been received.
Chairman Stalder invited imput, but the remarks from several members of the
audience pertained to procedures for recommending adoption of these items,
and the time the process would consume, rather than the substance of the
proposals. Mike Metcalfe moved, seconded by Dwain Kinghorn, that the hearing
remain open as to all items and be adjourned to 8:00 p.m., Thursday, April
13, 1978. The motion carried unanimously.
PUBLIC HEARING ITEM: John L. Alder, Vice President of Bunce, Alder and
Bunce, Inc., requests a change in zoning on the following described property:
A parcel of property approximately 51 acres in size located North
of I-8~Z~Eas~ of Hiline Road, South of Mountlake Subdivision, and South
~-~.0~'.~ Chatterton Subdivision. The proposed zoning is R-1 for
approximately46 acres of this parcel and R-3 for approximately 5 acres
located at the South West corner of the parcel bordering Hiline Road
and 1-86. Property is presently zoned Agricultural Transitional (A-T).
Chairman Stalder read letter of request. Mr. Alder said they had been planning
this Subdivision for some time. When it appeared it would be sometime before
the City would be adopting the new land use ordinances they had decided to
go ahead with it. He said he felt this was an unjust delay to ask them to
wait for the land use ordinance to be adopted.
Mike Metcalfe made the motion to table the request of John L. Alder, with
request to be re-opened April 13, 1978 after the hearing on the comprehensive
plan. Janet Williams seconded the motion. All voted in favor.
PUBLIC HEARING: John L. Alder
John Alder asked if plat would have to be re-done. Dwain Kinghorn said he
did not'feel that would be necessary. He said they had started platting under
old ordinance.
PUBLIC HEARING ITEM: FOUR WAY HOLDING CO., INC., requests a change of
zoning to allow that portion of Tract 14, Bonnie Brae Acres approximately
120' x 281.7', adjacent to tract 15 and fronting on Linden, be re-zoned
General Commercial (C-3). Property is presently zoned Multiple-Family
Residential (R-4).
Chairman read letter of request. No one was in attendance from Four Way Holding.
Keith Ankrum, representing Ray Ankrum, said Ankrum property is between the
Hitchcock property and property in question. Mrs. Mae Hitchcock said
she would oppose any additional truck parking in this area; she also
voiced concern about the irrigation ditches in the area.
Dell Peters made motion to deny request of Four Way Holding Co., Inc.to
allow that pOrtion of Tract 14, Bonnie Brae Acres to be re-zoned General
Commercial. Janet Williams seconded the motion. Williams, yes; Metcalfe, yes;
Payne, yes; ~¢ yes; Stalder, yes, Kinghorn, no.
PUBLIC HEARING ITEM: BART J. PARRISH, Vice President, Land Investments, Inc.,
request re-zoning of the following described property:
All that property in the West ½ of the Northwest ¼ of Section 11,
Township 6 South, Range 34 East, Boise Meridian, in the City of
Chubbuck, lying east of Hiline Road, bounded on the north by Chubbuck
Road and on the south by Interstate 1-86.
Chairman Stalder read letter of request.
Clifford Payne made motion to table request. Mike Metcalfe seconded the
motion. All voted in favor.
PUBLIC HEARING ITEM: STEVEN M. ENGLAND, 5165 Mesquite, requesting a variance
to allow him to build an addition of a family room and a double garage
onto his existing house, with a rear yard and side yard setback of less
footage than required in zoning ordinance. Property is located in a
Combined Residential (R-2) zone which has a front yard and rear yard set
back requirement of twenty feet.
Chairman Stalder read letter of request.
Mr. England said he had talked to the neighbors and they had no objection.
He said it would encompass the present driveway. Commission members asked
Mr. England if the neighbors to the west had any objection. He said they
did not.
Dwain Kinghorn made motion to grant a variance to allow Steven M. England
to build an addition of a family room and a double garage onto his existing
home, with rear yard and side yard setback of less footage thant required
in zoning ordinance. Mike Metcalfe seconded the motion. Peters, yes;
Payne, yes; Kinghorn, yes; Williams, yes, Metcalfe, yes, Stalder, no.
OTHER BUSINESS: GREG HELM, Custom Craft Builders, said that he is the

owner of the property behind Chubbuck Lumber on Valenty Road. He said this
is a new concept of condominium type mini commercial warehouses. Mr. Helm
said at the recommendation of his attorney the by laws had been sent to
Attorney Burnett for review.
Engineer Steven Smart said he had reviewed the engineering of the plat.
said that Mr. Helm had requested a portion of the Boise Payette Tracts
subdivision be vacated and that they would re-Plat that portion of the
Custom Craft Commercial Condominium.

Mike Metcalfe made a motion the Custom Craft Condominium plat, submitted
by Greg Helm, be recommended for acceptance by the city council. Dell
Peters seconded the motion. Voting was unanimous in favor.
FRANKLIN BRISCOE presented the preliminary plat of the Briscoe Subdivision.
Dwain Kinghorn asked Mr. Briscoe about the surface of the road leading
into the subdivision. He said it would be surfaced only as far as necessary.
Commission Members asked Engineer Smart about the engineering of the sub-
division. He said the City would need a right of way of 80' for Hiline
Road to be widened. He also said no dry wells were shown and that Vern Road
would have to be improved. A discussion followed on the water and sewer
lines.
Mike Metcalfe made a motion to recommend to the City Council they accept the
preliminary plat submitted by Franklin Briscoe, pursuant to changes indicated
by City Engineer on preliminary plat plans and subject to new zoning
ordinances. Clifford Payne seconded the motion. Voting was unanimous in
favor.
LARAMIE ANKRUM presented the preliminary plat of the Bonnie Gean Subdivision.
This subdivision is located in the county, adjacent to Lacey Vista Acres
and Space Acres. Dwain Kinghorn asked if Bannock County would allow
individual wells and septic tanks on less than five acres. Mr. Ankrum said
he had contacted the county and they could see no problem. Engineer Smart
said the area is in the City's impact area and if they had individual wells
and septic tanks the only concern of the City would be the streets.
Mike Metcalfe asked if County road standards were the same as the City of
Chububck. Tim Shirtliff, Hamilton & Voeller, said that the city required
curb and gutter and the count9 only required a driving space of 28'. Mr.
Ankrum asked if they would b~-required to have curb and gutter. Dell Peters
said the City Council could waive the cirb and gutter requirement.
Dwain Kinghorn made a motion to recommend to the City Council the pre-
liminary plat of the Bonnie Gean Subidivision be accepted and the streets
be deVeloped according to City of Chubbbck standards. Dell Peters seconded
the motion. The voting was unanimous in favor.
MOTEL 6 preliminary plat was presented by Tim Shirtliff, Hamilton & Voeller.
Engineer Smart explained to the Commission the layout of the ground involved.
He said he had written Motel 6 and Mr. Corimor C. Geisler on March 30, 1978
that this property is part of an illegal subdivision and a plat of the
property must be recorded with Bannock County.
Mr. Shirtliff said he had been in contact with Motel 6 and they would be
willing to cooperate with the City. They have requested the preliminary
plat be waived so they might continue with their plans for a June
starting date.
MOTEL 6
Engineer Smart said he felt the Planning and Zoning Commission could serve
the City,and the developers of the two pieces of property by waiving
the preliminary plat of Motel 6 and Mr. Geisler. He said Attorney
Burnett suggested both pieces of property be platted on one plat.
Mr. Shirtliff said there is an additional 15 feet of proPerty owned by
Roy Miller adjacent to the Motel 6 property. Mr. Miller is negotiating
with Motel 6 to purchase this strip of property. He said if it is not
purchased by Motel 6 he would recommend this be platted as a lot.
Dell Peters made a motion to recommend to the City Council to waive
the preliminary plat of Motel 6 and Mr. Corimor C. Geisler on West
Burnside. Clifford Payne seconded the motion. All voted in favor.
