May 10, 1979
Minutes of a public hearing held May 10, 1979, by the Planning and
Zoning Commission, at 8:00 p.m. in the city municipal building, 5160
Yellowstone. The purpose of meeting was to determine whether to
recommend to the City Council for adoption the (a) comprehensive plan,
(b) land use ordinance, (c) land development ordinance and (d) land
improvement standards ordinance.
Present: Chairman Dee Stalder, Commission Members: Dwain Kinghorn,
Becky Hopkins, Janet Williams, Del Peters and Mike Metcalfe, City
Attorney Donald L. Burnett, Jr., City Engineer Steven Smart and
Secretary Dorothy Ward.
Meeting called to order at 8:07 p.m. by Chairman Stalder~
Chairman Stalder read public hearing notice on comprehensive plan.
A. Comprehensive Plan
Kent Parrish asked why West Chubbuck Road is not a Planned Arterial
Street rather than a Planned ColleCtor Street. The City Engineer
advised that the large master map showed Chubbuck Road as an
arterial between Hawthorne and Hiline and a collector on either side.
Further that Whitaker was shown as a collector, north of Siphon and
local elsewhere. It was pointed out that smaller maps in audience
would have to be adjusted accordingly, Attorney Burnett noting that the
small maps refer to the large master maps for details, gave the opinion
that such adjustments would not constitute "material" changes.
Kent Parrish asked about property owned by the Parrish family on East
Chububck Road adjacent to the R-1 zone; he said they had understood it
would be zoned R-2; but on the Land Use Pattern map it is shown as R-1.
The Commission discussed this item at some length.
Attorney Burnett asked that the minutes indicate Kent Parrish had noted
the Land Use Pattern Map of the Comprehensive Plan does not provide
for the R-2 develoment in the area he had described and further it seems
to be the consensus of the Commission in prior discussions this
division should be made; the only question is whether it should be
made now bv recycling the hearings or whether it should be made at a
six month 'interval ~rovided for. This item to be taken under ~dvisement.
B. Land Use Ordinance.
Chairman Stalder read public hearing notice on Land Use Ordinance. After
ordinance was reviewed, Chairman Stalder asked if there was any questions
or items to be discussed. Kent Parrish asked about Section 3-2: Supplemental
Yard and Height Controls (d) Architectural Projections.
C. Land Development Ordinance.
Chairman Stalder read public hearing notice on Land Development Ordinance.
After review of ordinance, Chairman Stalder asked for any questions or
discussion. There being none they took up the next item of business.
D. Land Improvement Standard Ordinance.
Chairman Stalder read public hearing notice. After reviewing the
ordinance, Chairman Stalder asked if there was any questions or
discussion. There being none, he informed the Commision all the
public hearing items had been discussed.
Dwain Kinghorn said commission should take under consideration the
request of Mr. Parrish on the Comprehensive Plan. A lenghthy discussion
followed again on this item.
Becky Hopkins made motion to recommend to the City Council for
adoption the Comprehensive Plan, Land Use Ordinance, Land Development
Ordinance and the Land Improvement Standard Ordinance. Janet Williams
seconded the motion.
Dwain Kinghorn said the Commission should consider the request of Mr.
Parrish and if it is a "material" change, another hearing should be
scheduled. Attorney Burnett ruled this would be a "material" change
of the Comprehensive Plan.
Becky Hopkins asked fOr her motion to be voted on. Chairman Stalder called
for vote on motion. Hopkins, yes; Peters, no; Kinghorn, no; Williams,
yes; Stalder, no. Motion failed.
Del Peters made motion to move for the purpose of hearing, the plan be
changed, that portion of R-2 district south of East Chubbuck Road and
east of Hiline road be extended to include unplatted a'rea, west of 1/16
line in the N W 1/4 of Section 11; and plan with that change be re-heard
June 7, 1979. Dwain Kinghorn seconded motion. Hopkins, yes, Kinghorn, yes;
Peters, yes; Williams, yes, Stalder, yes.
Becky Hopkins made motion to close hearing on Land Use Ordinance, Land
Development Ordinance and the Land Improvement Standards Ordinance and
recommend they be adopted by City Council. Del Peters seconded the
motion. Hopkins, yes; Peters, yes, Williams, yes, Kinghorn, yes'
Stalder, yes. '
Becky Hopkins made motion meeting be adjourned at 12.20 p.m. Janet
Williams seconded the motion. All voted in favor.
