March 1, 1979
Minutes of the regular meeting of the Planning and Zoning Commission,
held in the city municipal building, March 1, 1979.
.Meeting called to order at 8:00 p.m. by Chairman Stalder. Chairman'
Stalder welcomed Dean Wood and Boyd Neider as new members of the
commission.
Present: Chairman Dee Stalder and Conm~ission Members: Dwain Kinghorn,
Becky Hopkins, Dean Wood, Boyd Neider and Mike Metcalfe, City Engineer
SteVen Smart. Janet Williams and Del Peters were excused.
Minutes of the regular meeting of the Planning and Zoning Commission, held
February 1, 1979, were read by the secretary. Chairman Stalder asked
for any additions or corrections to the minutes; there being none, Dean
Wood made motion to accept the mi~nutes as read. Mike Metcalfe seconded ~he
motion. Voting was unanimous.
PUBLIC HEARING ITEM:
1. CAROL BURGE, 1730 W. Quinn road, #410, HAS REQUESTED A VARIANCE
from zoning regulations to allow the placement of a double wide mobil
home on her property at 202 Briscoe Road. Property is zoned Multiple-
family Residential-Livestock (R-2L).
Chairman Stalder read letter of request from Carol Burge.
Ms Burge said she would like to put the mobil home on a permanent foundation,
and live in it until her family is grown. She said she had purchased the
property for her daughter to have a horse. She stated her home had burned
in December, 1978 and that it would be to expensive for her to

the present home would be removed also the present foundation.
Mike Metcalfe asked if her mobil home looked like a regular home or a mobil
home. She said it looked more like a home.
Ray Coles, 227 Briscoe Road, said the house would be.costly to rebuild. If
mobil home looks like house rather than a trailer he would not object; but
if this would allow other trailers to move in, he would strongly object.
He said there is property in the area that he felt could be developed into
a trailer court and they would object to this.
William Armstrong, 128 Briscoe, said if mobil home would not be a permanent
structure he would not object; but if it would allow trailers into the
area he would have to object to allowing it here.
Dwain Kinghorn said if variance was oranted it would be subject to a yearly

Mike Metcalfe reviewed guidelines for variances for the commiss.ion and
those in the audience.
Becky Hopkins stated the new ordinances the city has been working on,
allows mobil homes only in courts or in areas of three or more. She said
the commission needs to uphold the ordinances. She said 'you would be
looking at six years for mobil home to be on the property. She said she
felt other alternatives should be available for Ms Burge.
Dean Wood said the commission needs to follow guidelines set forth in the
ordinances.
Becky Hopkins said it would be a hard decision to make. The Comprehensive
Plan of the city makes it impossible to allow mobil homes in residential
areas and she felt the city council and commission had worked hard on
the changes and they should be upheld.
Becky Hopkins made motion to deny the variance request of Carol Burge, to
allow, the placement of a mobil home at 202 Briscoe Road, for residentia~l
purposes. Mike Metcalfe seconded the motion. Metcalfe, yes; Wood, yes;
Neider, yes; Kin§horn, yes; Hopkins, yes, Stalder, yes.
OTHER BUSINESS:'
1. RICK L. SLAVEN, 147 W. Linden, yearly review for a mobil home
for residentail purposes. Mr. Sloven was not present.
Chairman Stalder reviewed the minutes p~rtainin§ to this variance from
1977 and 1978.
Mike Metcalfe stated that a different situation existed today than in 1977,
He said following the guidelines set forth the commission must be cautious
in approval of mobil homes in'residential areas, the commission must not
variegate from decision.
Dwain Kinghorn said the area mobil home is in is a different situation
than the preceding item on agenda; there are mobil homes in the area and
Carefree, Inc. is on the East of the mobil home.
Boyd Neider made motion that letter be sent to Mr. Slaven stating variance
may be denied unless he can show due cause, why variance should be
extended. Item to be tabled until April 8, 1979 meeting. Dean Wood
seconded the motion. The voting was unanimous.
2. NORTHSIDE PLAZA - FINAL PLAT - Glen Marshall,developer and
Bob Thompson, Northwestern Engineering',' presented the final, plat of the
Northside Plaza. Mr. Marshal said the reason the~ were returning the
final plat to the Planning and Zoning Commission was the~State Highway
Department people had advised against a frontage road. He said they
would prefer having a 90o approach; because of the headlight problem. ~'Mr.
Harshail said the~ would be installing 12" water lines in the proje¢l;,

NORTHSIDE PLAZA
Mr. Marshall said the council had been concerned about the Yellowstone
right-of-way; and he had met with the highway department and they had
agreed to exchange letters to reserve the 7' when the lots are sold; at
the time the 80' road is to be built, property would be deeded.
Dwain Kinghorn made motion to recommend for approval, to the City Council,
the Northside Plaza final plat, with recommendations of Engineer Smart
to be considered. Dean Wood seconded the motion. All voted in favor.
REVIEW OF VARIANCE - WHEELS UNLIMITED - R. KIRK SHULER - Commission reviewed
.the variance that had been granted Mr. Shuler. Mr. Shuler was not present.
Dwain Kinghorn made motion variance reqest of Mr. R. Kirk Shuler, for

Dean Wood made motion to have secretary contact Attorney Donald Burnett and
have him notify Mr. Shuler variance not to be extended and ask if any action
city could take in this matter. Mike Metcalfe seconded the motion. The
voting was unanimous in favor.
Mike Metcalfe made motion to adjourn at 9:20 p.m. Dean Wood seconded, with
the commission voting in favor.
