Meeting called to order at 8:00 p.m. by Acting Chairman Dwain Kinghorn. Present: Acting Chairman Dwain Kinghorn, Commission Members: Janet WilliamS, Dell Peters, Boyd Neider and Dean Wood, City Engineer Steven Smart and Secretary Dorothy Ward. Excused Chairman Dee Stalder and Becky Hopkins. Minutes of the regular meeting of the Planning and Zoning Commission held May 3, 1979 were read by the secretary. Acting Chairman Kinghorn asked for any additions or corrections. There being none, Janet Williams made motion to accept minutes as read. Dean Wood seconded the motion. All voted in favor. Minutes of a public hearing held May 10, 1979 were read. Acting Chairman Kinghorn asked for any additions or corrections. There being none, Dell Peters made motion to accept the minutes as read. Janet Williams seconded the motion. Voting was unanimous. PUBLIC HEARING ITEM: DON NEVES, REQUESTING A VARIANCE from zoning, to allow him to place a sign approximately three feet by five feet, to be hung at 4815 Hawthorne for Don's Studio of Photography. Acting Chairman Kinghorn read letter of request. Mrs. Neves said the sign would be hung flush with the studio and would be a sand blasted sign. Dell Peters reminded the commission members they have not allowed ordinance to be extended to include signs of this size; and other businesses have not suffered from the smaller signs. Acting Chairman Kinghorn told Mrs. Neves the commission had talked with Mr. Neves at the time of his variance for the studio, about the sign requirements. Dell Peters made motion to deny the variance request of Don Neves, to place a three feet by five feet sign for Don's Studio of Photography, at 4815 Hawthorne Road. Dean Wood seconded the motion. All voted in favor. PUBLIC HEARING ITEM: JOHN D. CEGIELNIK, REQUESTING A VARIANCE to allow him to build a sixteen foot by twenty two foot garage, with a rear yard and side yard setback of less footage than required in zoning regulations. Property is located in a Combined Residential (R-2) zone. 4904 Redfish. Acting Chairman Kinghorn read letter of request. Mr. Cegielnik said they would like to build a stick built garage, for storage and one car. He said they had no storage at the present for their lawn mower or other supplies. He said he woUld have a four foot side yard and eighteen feet four inches rear yard; and there was a ten foot easement in the back yard. Acting Chairman Kinghorn read statement from Mark Smith, Lot 8 Block 5, Alturas Park, stating he had no objection to the four foot side yard. Commission members studied the plan and discussed the plans of Mr. Cegielnik. He was asked if he could locate the garage in such a way there would be PUBLIC HEARING ITEM: JOHN CEGIELNIK, continued more of a side yard. He said With the size of the lot, it was impossible to locate the garage with more of a side yard. Dean Wood made motion to grant variance to John D. Cegielnik, 4904 Redfish, to allow him to build a sixteen foot by twenty two foot garage, with a rear yard and side yard setback of less footage than required in zoning regulations. Boyd Neider seconded the motion. The voting was unanimous. PUBLIC HEARING ITEM: JOHN ELLESSON, REQUESTING A VARIANCE of the area requirements in the zoning ordinance to allow him to construct a duplex on Lot 3, Block 1, Chatterton Subdivision. The lot area required is 8500 square feet, Lot 3 Block 1, Chatterton Subdivision has 7,538 square feet. Acting Chairman Kinghorn read letter of request. Mr. Kinghorn than asked Mr. Ellesson if he intended to build on the lot himself or if he was intending to sell and another party build the duplex. If this is the circumstances the contract purchaser would have to come into the city with an earnest money ageement and request the variance. Mr. Ellesson said he probably would sell the lot for this purpose. No other action was taken on this matter. PUBLIC HEARING ITEM: A PROPOSAL TO CHANGE THE LAND USE PATTERN specified in said Comprehensive Plan to provide for multiple household dwellings east of Hiline Road and south of Chububck Road. This change would allow the city to zone the area in such a manner that multiple household dwellings would be permitted without limitation upon density, subject to lot size and area requirements provided by ordinance. Del Bunce, 834 Mark, asked to have area defined and what would be allowed in R-2 zone. Barbara Robinson, 724 Norcrest, said she would object to high rise apartments and wanted to know what controls would be in effect. The people in the audience were told this piece of property would have to be subdivided and platted, no one would be able to just start building on it without plans presented to the city. It would have to be rezoned before it could be used. Ron Thompson, 703 Bedford, asked if development would go to the end of Bedford. Vickie Nielson, 4732 Mount Lake Drive, stated objection to apartments being built, said she would like to see area zoned R-1. Joan Padrnos, 742 Bedford, asked about road being extended to Bedford and their area being opened up for additional traffic. She said they would like to see the area zoned R-1. Michael Johnson, 723 Bedford, said he opposed zoning change, and that he also opposed multiple dwellings in the area. Acting Chairman Kinghorn told these people the area is shown as Agricultural Transitional (A-T) on the present Comprehensive Plan, that it was the feeling COMPREHENSIVE PLAN of the commission area was meant to be shown as R-2; to show this property as R-2 in the Comprehensive Plan does not effect a zoning change. Max Parrish said in the Comprehensive PLan, as far as they knew, throughout the hearings, this property had always been designated R-2; part of it is already R-2, only when some one noticed the line jogged, it became apparent it was not R-2 in the Comprehensive Plan. A lengthy 'discussion followed with the audience and the commission members. It was the consensus of the people they would like to see this area zoned R-1. Boyd Neider stated the commission should respect the ideas of the people when they come and express themselves, even if the things they ask for are not right, it should be respected. Many of the people voiced the opinion, their area is new in the city and many of their homes have been built since the city has had the public hearings on the comprehensive plan and they felt their view. should be heard. Dell Peters and Janet Williams said the R-2 zone would act as a buffer between the CHatterton Subdivision and Hiline Road. Dean Wood reminded the people Hiline Road would probably be a four lane road in the future. Acting Chairman Kinghorn explained to the people what was allowed in the R-1 and R-2 zone. Dell Peters said area requirements address themselves to multiple family units ~and still has same effect as single household dwelling, when you put in multiple family units, additional space has to be included. Dell Peters made motion to recommend to the City Council, the proposed change in the Comprehensive Plan, for property located east of Hiline Road and south of Chubbuck Road, to provide for multiple household dwellings in a General Residential (R-2) zone; and for the adoption of the Comprehensive Plan with that change. Janet Williams seconded the motion. Wood, yes; Neider, abstained from voting; Peters, yes, Kinghorn, yes; Williams, yes.
