April 5, 1979
Minutes of the regular meeting of the Planning and Zoning CommiSsion, held
in the city municipal building, April 5, 1979.
Meeting called to order at 8:00 p.m.
Present: Chairman Dee Stalder, Commission Members:
Williams, Dean Wood, Dell Peters and Boyd Neider.

Minutes of the regular meeting of the Planning and Zoning Commission, held
March 1, 1979, were read by the secretary. Chairman Stalder asked for any
additions or corrections; there being none,motion was made to accept minutes
as read. All voted in favor.
PUBLIC HEARING ITEM- MRS. JESSE GILMORE, 4760 Whitaker Road, has requested
a variance to install a four (4) foot chain link fence around her property.
Property is presently zoned Mobile-home Residential (R-2T).
Chairman Stalder read Mrs. Gilmore's letter of request.
Mrs. Gilmore showed pictures of her property, she said automobiles and snow-
mobiles have driven across her property causing a dangerous situation. She
said also that the children on bikes and skate boards cut across their yard.
She presented a petition from her neighbors stating they did not object to fence.
Dwain Kinghorn said he had driven by Mrs. Gilmore's and could see the problem
that existed.
Mrs. Gilmore said they had a dog and there is a four foot fence around her
neighbor's property and across her back propery and they would like the four
foot fence to help keep their dog in the yard.
Dell Peters said the ordinances could not be stretched in order to keep the
dog penned. He asked if they would not be protected from their problems
with a three foot fence.
A discussion followed on the heiqht of fencing available to purchase, and
if ordinance needs to be amended'if three foot fence is not available.
Boyd Neider said that chain link fence would not impede the view of automobiles,
that shrubs should not be planted where they would block the view.
Mrs. Gilmore said they would not plant shrubs by the fence at all; their
plantings would be next to the mobil home.
Mrs. Fern Rust, 510 Bluebird, said her property joins Mrs. Gilmore's and
she did not object to the fence.
Boyd Neider read the definition of fences from Ordinance #98, page 28, for
those in the audiance and the commission.
Dell Peters made motion to grant a variance to allow Mrs. Jesse Gilmore, 4760
Whitaker, to fence her property with a four (4) foot chain link fence. Janet
Williams seconded the motion. Voting was unanimous.
OTHER BUSINESS:
1. RICK L. SLAVEN, 147 W. Linden, yearly review for a mobil home for
residential purposes, variance granted March 1, 1977.
Chairman Stalder read the minUtes of the March 1, 1977 meeting and the review
of variance of March 3, 1978.
Mr. Kinghorn said the commission had granted the variance to Mr. Slaven
as they had wanted to go to school. Mrs. Slaven said that she is
attending school and that he had hoped to register again in September. She
said they had gone to condiderable expense to put the sewer and water in to
the mobil home.
A discussion followed on the mobil homes in that area of the city.
Boyd Neider made motion to accept the petition for extension of variance
request of Rick L. SLaven, subject to a yearly review. Dell Peters seconded
the motion. All voted in favor.
2. DON ANDRA was present and asked the commission about putting a
trailer,on property he has purchased on East Linden, for a freight company
to use as a temporary office until he could build a building.
The commission discussed this item and if there was any way they could help
Mr. Andra.
Dwain Kinghorn made motion, with approval of the Planning and Zoning Commission,
to inquire of Attorney Donald L. Burnett, Jr. if the commission could waive
the requirements of variance request to allow Mr. Andra to use a trailer for
an office for a freight company on a temporary basis. Boyd Neider seconded the
motion. The voting was unanimous.
A discussion followed on a letter received by Boyd Neider from the Bannock
County Land Development Board on a public hearing they would be holding, on
April 24, 1979. This is a request being made by Charlie Frasure. It was
decided to turn the letter over to the City Council for their review.
Janet Williams made motion to adjourn at 9:30 p.m. Dean Wood seconded the
motion. All voted in favor.

CITY OF CHUBBUCK, IDAHO
NOTICE IS HEREBY GIVEN that�at 8:00 p.m. on April 5, 1979, at the
City Municipal Building, 5160 Yellowstone, Chubbuck, Idaho the Planning
and Zoning Comission of the City of Chubbuck will conduct a public
hearing with regard to the following item:
1. Determination whether to grant a variance as requested by
Mrs. Jesse Gilmore, 4760 Whitaker Road, to install a four (4) foot
chain link fence around her property. Property is presently zoned
Mobile -home Residential (R -2T).
Interested citizens may appear with regard to the foregoing
item, and at the time indicated will be given an opportunity to be
heard in support of or in opposition to the proposal.
