Minutes of the regular meeting of the Land Use & development Conmission
held in the City ~kmicipal Building, October 1, 1981.
Present: Chairman Richard Allen, Co~mission _.Members: Dee Stalder, Pete
Anderson, Earl Romriell, Myrna Cain, Janet Williams, City Engineer
Steven Smart, Secretary Dorothy Ward, Chairman Allen welcomed
Robert Allen as a new Commission Member.
Meeting called to order at 8:00 p.m. by ChairmanAllen.
ChainnanAllen asked for any corrections or additions to the minutes of
September 10, 1981; there being none, Dee Stalder made the motion to
accept minutes as written. Pete Anderson seconded the motion, with
all Ccmmzission~rs voting in favor.
PUBLIC HEARING ITEM: GEORGE A. STEINMETZ FOR A CONDITIONAL USE PERMIT FOR
A TRANSMISSION REPAIR SHOP at 4959 Hawthorne.
Mr. Steinmetz said he worked on transmissions out of cars, mostly for Shaw
Auto Parts. He said occasionally he had a vehicle in for repairs, however
he had all the facilities to do any type of car repair.
Chairman Allen asked Mr, Steienmetz if this was a full time operation. He
replied yes, it is their source of income.
Janet Williams asked if he expected to erect a sign. He replied, no, he did
not need a sign, he has all the work he could do.
Chairman Allen asked for public testimony in favor of the Transmission Repair
Shop.
LindaLarsen, 4950 Hawthorne Road, said she and her husband did not object to
the shop in the neighborhood.
Chairman Allen read a statement from some of the immediate neighbors stating
they found it not tobe an annoyance to them. This statement attached to
the minutes.
There being no other testimony in favor, Chairman Allen asked for testimony
opposed to the Transmission Repair Shop.
Bob
Ward, 4930 Hawthorne Road, requested Hawthorne Road be re-zoned Comnercial
if the Commission continues to allow conn~rcial uses to go in, such as the
Transmission Repair Shop. He stated there are several areas that could be
utilized for just such uses. He asked the Commission if they did allow
the Transmission Repair Shop to go in, to make strict conditions and asked
if it could be reviewed each year.

Chairman Allen then closed the public testimony.
Chairman Allen then read frcmOrdinance # 205 the definition of vehicle
repair. He stated this request should perhaps be handled as a home
occupation. -
The Commission then discussed the possibilities of this request as a home
occupation and if a vehicle repair shop wouldbe allowed.
Earl Romriell questioned if this could be classified as a hc~e occupation.
Dee Stalder said the city has the Land Use Ordinance and he felt it should
be upheld, that a vehicle repair shop was not allowed in an R-2 zone.
Pete Anderson questioned Mr. Steinmetz as to the other work he did, not related
to transmission repair and the parking. Mr. Steinmetz said he possibly
worked on two cars a week that he always had them parked inside of the
shop and never parked cars in the street.
Pete Andersonmade motion to consider the request of George A. Steinmetz
as a home occupation. ~;rna Cain seconded themotion. Stalder, no;
RDmreill, abstained, Anderson, yes; Robert Allen, yes; Richard Allen,
yes; Cain, yes and Williams, yes.
Janet Williams made motion to recc~mend to the City Council for approval
subject to the following conditions: shop be used for transmission
repair only, size of building not to exceed twenty five (25) percent
of the dwelling size, no exterior storage, no exterior signs, operating
hours be from 8:00 a.m. to 6:00 p.m., vehicles to be repaired be in
enclosed area, that all expansion to be brought before the Con~nission,
for Mr. Steinmetz to meet the standards set forth in Ordinance #205
regarding home occupation and the conditions not transferable.
Pete Anderson seconded the motion. Stalder, no; Romriell, abstained;
Robert Allen, yes; Richard Allen, yes; Anderson, yes, Cain, yes;
Williams, yes.
OTHER BUSINESS:
Design Review - Pine Ridge Chevron Sign. The Con~ssion reviewed the
application and photograph of the sign.
Earl Romriell made motion to re~d to the City Council for approval
the sign of the Pine Ridge Chevron. Dee Stalder seconded themotion,
with all voting in favor.
Design Review - North Chuckwagon Restaurant to be built at the Pine Ridge
Mall.
The Commission reviewed the plans and discussed the area with the City
Engineer, Steven Smart.
Earl Romriell made motion to reccmm~_nd for approval the Design Review
of the North Chuckwagon to the City Council. Janet Williams seconded
themotion. With all Co~mission~rs voting in favor.
OTHER BUSINESS:
Design Review - addition to McArthurMachine Shop - 342 Hiway
Avenue. Steven Smart said application was not complete, therefore
he was unable to make any recon~nendations.
Pete Anderson mademotion to table the Design Review application of
McArthur ~chine shop until conrplete drawings are brought in and
the application completed. MyrnaCain seconded the motion, with
all Commission Meml~rs voting in favor.
Dee Staldermade motion to adjOurn at 9:50 p.m., Janet Williams seconded
themotion. All members voted in favor.

there is no annoyance in him doing so.
