~nutes of the regular meeting of the Land Use & Development Conm~ssion
held in the City Municipal Building, May 7, 1981.
Present: Chairman MichaelMetcalfe, Cc~missionM~mbers: Earl Rc~riell,
Pete Anderson, Janet Williams, Myrna Cain, Richard Allen, City Engineer
Steven Smart, Secretary Dorothy Ward. Con~nission~r Dee Stalder was
excused.
Meeting called to order at 8:00 p. m. by ChairmanMetcalfe.
Chairman Metcalfe asked for any corrections or additions to the minutes of
April 2, 1981, there being none, Chairman Metcalfe made motion to accept
minutes as written. Richard Allen seconded the motion. All Cc~mission
Members voted in favor.
PUBLIC HEAR/NG ITEM:
1. A. F. McOMBER ASKING FOR A CONDITIONALUSE PERMIT TOCONSTRUCT STORAGE
building or buildings on a parcel of property ownedbyMr. McOmber. Property
is presently zoned General Cc~nercial ~Ce2) and lies directly west of
business property at 4705 YellowStone Avenue, Chubbuck, Idaho.
Mr. McOmber stated this property has been an eye sore for some time and he felt
it could be an addition to the city and particularly to the area. He showed
pictures of the type of building that would be erected.
Chairman Metcalfe asked what type of security would be provided. Mr. McCmber
said each renter would be provided with a key and the manager of the Colonial
Inn, which Mr. McOmber owns, would handle the renting and supervision that
wouldbe required.
Cc~nission Members asked Mr. McOmber about the easements and the type of drive
way he would be installing. Mr. McOmber said he had a twenty five foot easement
and hoped to use a fifteen foot easement of Denny Jones. He said, however if
he was not able to use the fifteen foot easement he had a building he could
remove and have a 44 foot driveway. He said he did not have an easement off
frc~West Linden to his property.
Richard Allen said he would like to have Denny Jones explain the easement he
has with Mr. M~Dmber. Mr. Jones said there is a twenty five foot easement of
Mr. M~2~ber's and the fifteen foot easement he provided but that it was to
be used by special request only.
Engineer Steven Smart said the driveway needed to be either have a chip and seal
coat or black top. He said the City required off street parking to be paved;
but where it is private property possibly gravel would be allowable. He said
if gravel was used a dry wellwould notbe necessary.
CONDITIONAL USE PERMIT - A. F. McOmber - continued
Commission Members discussed the following:
1. If platting would be necessary.
2. Control city would have over the density.
3. No specific plans had been presented.
4. Requirement of a Design Review Permit.
Richard Allen made motion to reconmend to the City Council to grant a conditional
use permit to A. F. Mcfknber to construct one storage building 50'ix150', one
story, in Phase One, on property located at 4705 Yellowstone, in a General
Commercial zone (C-2), based on the following:
1. Have a defined 40' minimum driveway into the property.
2. Entire surface area , including driveway be chip and seal.
3. Drainage be taken care of on own property.
4. Design Review Permit of Phase #1 to be approved before any building
permit is issued.
5. All other city ordinance requirements be met.
Pete Anderson seconded the motion, with all Con~nissionMembers voting in favor.

1. Sign Systems, Inc., Design Review Permit, for an interior illuminated
sign to be installed over canopy of Bar entrance of the Green Triangle.
The Conm~ssion reviewed the application for Design Review and drawings provided
by Sign Systems, Inc.
Janet Williams made motion to recc~nend to the City Council, for approval, the
Design Review Permit of Sign Systems, Inc., for an interior illuminated sign
over the canopy of the Bar entrance to the Green Triangle.
Richard Allen seconded the motion, with all voting in favor.
2. A proposal by MollyAlexander, requesting a conditional use permit to
operate a group day care center, at 4904 Spraker, for up to 12 children, three
years and older. Item tabled from April 2, 1981 meeting to allow Mr. and Mrs.
Alexander to review the conditions that would need to be met, as recon~ne~ded
by the Building Inspector, Dan Stuart.
Mr. and Mrs. Alexander were not present.
Richard Allenmademotion to recc~r~_nd the CityCouncil deny the conditional
use permit of MollyAllexander to operate a group day care center, at
4904 Spraker, Chubbuck, Idaho. MollyAlexander is not in compliance with
the ordinance and due to their lack of interest in attending the meeting;
also the con, nents of neighbors objecting to the group day care center.

Earl Romriell seconded the motion, with all Commission M~mbers voting in favor.
3. Review of variance granted Rick L. Slaven in March, 1977, to place a
mobile home at 147 W. Linden for residential use.
Mr. Slaven was not present. Two requests have been sent to Mr. Slaven in
regards to his review.
Richard Allen made motion to table this item, until the June 4, 1981 meeting,
and in the meantime a registered letter be sent to Mr. Slaven requesting
his presence at that meeting.
Janet Williams seconded the motion, with all voting in favor.
Janet Williams made the motion to adjourn at 9:20 p.m, with Myrna Cain seconding
the motion. All members voted in favor.
