HomeMy WebLinkAbout012 03 81LAND USE & DEVELOPMENT COmmISSION MINUTES December 3, 1981 Minutes of the regular meeting of the Land Use and Development Commission held in the city municipal Building, December 3, 1981. Present: Acting Chairman Earl L. Romriell, Commission Members: Pete Anderson, Robert Allen, Dee Stalder, Myrna Cain, Janet Williams, Public Works Director Steven Smart and Secretary Dorothy Ward. Chairman Richard Allen was excused. Meeting called to order at 8:00 p.m. by Chairman Romriell. Chairman Romriell asked for any additions or corrections to the minutes of November 5, 1981. There being none, Dee Stalder made motion to accept minutes as written. Robert Allen seconded the motion. All commission members voted in favor. PUBLIC HEARING ITEM: A PROPOSAL BY PEGGY STEBBINS FOR A CONDITIONAL USE PERMIT to act as a Commission Mailer and a Beauty Consultant from her home at 582 Chickadee. Property is located in a General Residential (R-2) zone. Mrs. Peggy Stebbins, 582 Chickadee, said that acting as a Commission Mailer would be handled through the post office, and that as a Beauty Consultant she would go to other people's homes. Dee Stalder asked if delivery trucks would be coming to her home with deliveries. Mrs. Stebbins said that U P S would be making deliveries and she would pick up orders from the post office. Pete Anderson asked if customers would be coming to her home for orders. Mrs. Stebbins said no, she delivers to the customers homes. Chairman Romriell asked for comments from the audiance in favor of the conditional use permit of Peggy Stebbins. There being none, he than asked for any comment in opposition to the proposal. Chairman Romriell read a letter from Mr. John Boyle, 542 Chickadee, opposing the conditional use permit of Peggy Stebbins, he said he was concerned that a traffic problem might develop. Mrs. Stebbins reiterated that all mailing is done through the post office and selling done over the telephone. CONDI'TIONAL USE PERMIT - PEGGY STEBBINS, continued Chairman Romriell said this business could be allowed as a home occupation. Robert Allen asked if Mrs. Stebbins would have any signs on her home for this type of business. She said no, signs were not necessary. Janet Williams made motion to recommend to the City Council for approval the conditional use permit of Peggy Stebbins, to act as a Commission Mailer and a Beauty Consultant from her home at 582 Chickadee. If parking problems should arise, conditional use permit to be reviewed. Conditional Use Permit to apply to Mrs. Peggy Stebbins, 582 Chickadee, and not be transferable. Robert Allen seconded the motion, with all commission members voting in favor. OTHER BUSINESS: Review of variance granted Margaret Ohlin, 4855 Joy, to keep present animals on property zoned General Residential (R-2) . Mrs. Ohlin was not present, but had sent a letter asking for the variance to be renewed. She said at the present time they have two mallard ducks. The commission members discussed this variance and the conditions under which it was granted. Pete Anderson made motion to continue the variance of Margaret Ohlin, 4855 JoY, to keep present animals on her property, as long as she has complied With original variance, subject to review in one year. Dee Stalder seconded the motion, with all commission members voting in favor. Review of variance granted Robert & Karen Kennedy to operate a Custom Drapery Shop at 5122 Hawthorne Road. Property is in a General Residential (R-2) zone. Mrs. Karen Kennedy was present. Dee Stalder asked if they had expanded their business. She said they had always had carpet and floor coverings. Janet Williams made motion to extend the variance request of Robert and Karen Kennedy to operate a Custom Drapery shop at 5122 Hawthorne, subject to a yearly review. Myrna Cain seconded the motion, with all commission members voting in favor. Review of variance granted Don Neves to operate a part time, after hours Photography Studio at 4815 Hawthorne Road; also review variance for sign on same studio. Property is in a General Residential (R-2) zone. Mrs. Don Neves was present. Commission members asked if any complaints had been received. There being none, Robert Allen made motion to approve the continuation of variance granted to Don Neves to operate an after hours Photography Studio, and also the sign on the studio, subject to a yearly review. Pete Anderson seconded the motion, with all commission members voting in favor. DESIGN REVIEW - SIGNS: 1. J & M Enterprises sign - Trailer Court, Hiway Avenue and Yellowstone. Sign is a non'conforming, existing sign. Pete Anderson made motion to recommend for approval the J & M Enterprises sign for trailer court at Hiway Avenue and Yellowstone. Janet Williams seconded the motion, with all voting in favor. Mr. Petrol's Pantry sign - 4756 Yellowstone. Steven Smart said sign is a non-conforming, permanent sign. He said the temporary signs had been removed or combined with the permanent sign. Janet Williams made motion to recommend for approval permanent sign of Mr. Petrol's Pantry. Myrna Cain seconded the motion, with all commission members voting in favor. 3. Parkway Apartments & Mobile Home Court sign - 4613 Yellowstone. Sign is a non-conforming, existing sign. Dee Stalder made motion to recommend for approval the Sign of Parkway Apartments and Mobile Home Court. Pete Anderson seconded the motion, with all commission members voting in favor. 4. Triangle Oil Company sign - 4030 Yellowstone. Sign is a non-conforming, existing sign. Robert Allen made motion to recommend for approval the sign of Triangle Oil Company. Dee Stalder seconded the motion, with all commission members Voting in favor. Big Indian Mobile Homes Sales sign - 5050 Yellowstone. Sign is a non-conforming, existing sign. The commission discussed the location of sign. Pete Anderson made motion to recommend for approval the sign of Big Indian Mobile Homes Sales, with the condition at the time of Yellowstone Highway construction, sign be relocated from the right-of-way. Dee Stalder seconded the motion. Voting was unanimous. DESIGN REVIEW - SIGNS - continued Realty Country sign - 4501 Yellowstone. non-conforming, existing sign. Sign is a The commission members discussed the location of the two signs located at Realty Country. Dee Stalder made motion to recommend for approval Realty Country sign, with following stipulations: 1) non-permanent sign be made stable or affixed to ground, subject to approval of City Engineer, Steven Smart. 2) At the time of new highway right-of-way construction, if signs not in conformance, signs will have to be moved. Janet Williams seconded the motion. All commission members voted in favor. Sonya Worona - Camelot Mobile Home Estates sign - 330 West Chubbuck Road. Sign is a non-conforming, existing sign. Pete Anderson made motion to recommend for approval the sign of Camelot Mobile Home Estates. Janet Williams seconded motion. The voting was unanimous in favor.
