April 2, 1981
Minutes of the regular meeting of the Land Use & Development
Commission held in the City Municipal Building, April 2,
1981.
Present: Chairman Michael Metcalfe, Commission Members: Earl
Romriell, Pete Anderson, Janet Williams and Richard Allen,
City Engineer Steven Smart and Secretary Dorothy Ward.
Meeting called to order at ~:20 p.m. by Chairman Metcalfe.
Chairman Metcalfe asked for any additions or corrections to the
minutes of March 12, 1981. There being none, Pete Anderson
made motion to accept minutes as written. Janet Williams
seconded the motion with all voting in favor.
PUBLIC HEARING: A PROPOSAL BY MOLLY ALEXANDER, REQUESTING A
CONDITIONAL USE PERMIT to operate a group day care center, at
4904 Spraker, Chubbuck, Idaho,for up to 12 children three years
and older. The property is situated in an area zoned General
Residential (R-2).
Jere Alexander, representing Molly Alexander, explained they had been
caring for about five children and would like to expand and have
up to twelve children. He said they had four small children of
their own and this allows his wife to be home with them, this
is the basic reason they would like to operate a group day care
center. He said they planned on moving after school is out in
May.
Chairman Metcalfe asked for any testimony in favor of the group day
care center. There being none he then asked for testimony opposing
the group day care center.
Peggy Goetz, 4903 Sheppard, said their back yards join and that she
was opposed to the center. She stated they have dogs in their
yard and the children tease them with a type of pop gun, also the
noise is disturbing to them.
Dale Neil, 4914 Spraker, said they objected to the group day care
center. He also asked if there are standards that have to be met
to operate a group day care center.
Chairman Metcalfe said there are and that the Alexanders' would be
expected to comply with all the building and safety codes that
are applicable.
Chairman Metcalfe presented a petition that had been given to him
by some of the residents in the area opposing the group day
care center.
PUBLIC HEARING ITEM - MOLLY ALEXANDER, GROUP DAY CARE CENTER
The Commission discussed the recommendations that had been made
by the City Building Inspector, Dan Stuart. Mr Alexander
said they would not be willing to spend a great deal of money
bringing their home up to code, for such a short time. He
said they would reduce the number of children they were caring
for first.
Richard Allen asked if they had installed the fire extinquishers
and smoke alarms that had been recommended. Mr. Alexander
said they had not but would be willing to install them.
Pete Anderson asked how certain he was that they would be able to
sell out by the end of May. Mr. Alexander explained he was
working in Idaho Falls and they would move even though they
might not be able to sell their home.
Earl Romriell suggested that Mrs. Alexander phase down her operation
and in the meantime review the recommendations of~the Building
Inspector and the Commission table this item for one month.
Peggy Goetz said she would not object to a two month time limit,
but they would not want to have to put up with the noise problem,
fence problem and the children teasing their dogs all summer.
Pete Anderson said he felt the Commission had a responsibilty to the
City Council and the Community and the people using the facility
that all safety standard be met , even if it is a two month
period. He said he would make a motion to table this item and
allow Mr. Alexander to examine the requirements set forth in the
U. B. C. and Life Safety Code and see if he wants to go to the
expense,~and if he is, then come back next month and ask for a
condtional use.
Janet Wiiliams seconded the motion, with all Commission Members
voting in favor.
OTHER BUSINESS:
1. Review of variance granted Rick L. Slaven, March, 1977,
to place a mobile home at 147 W. Linden, for residential purposes.
Mr. Slaven was not present.
with the Commission.
Chairman Metcalfe reviewed the variance
Dwain Kinghorn, 145 Hiway Avenue, said the variance had been granted
to accomodate Mr. Slaven, so that he could go to school. He
said the city has denied other people the privilege of placing
a mobile home for residential purposes, and he felt the Commission
should take a good look at extending the variance.
Janet Williams made motion to table the review of Rick L. Slaven until
May 7, 1981. Richard Allen seconded the motion. All voted in favor.
Richard Allen made motion to adjourn at 9:10 p.m, seconded by Janet
Williams. All voted in favor.
