HomeMy WebLinkAbout010 07 82LAND USE & DEVELOPMENT COMMISSION MINUTES October 7, 1982 Minutes of the regular meeting of the Land Use and Development Commission held in the city municipal building, October 7, 1982. Present: Acting Chairman Dee Stalder, Commission Members: Myrna Cain, Janet Williams, Pete Anderson, Ronald Nelson, Public Works Director Steven Smart and Secretary Dorothy Ward. Meeting called to order at 8:05 p~. m. by Chairman Stalder. Chairman Stalder welcomed Roanld Nelson as a new member of the commission. Chairman Stalder asked for any additions or corrections to the minutes of August 5, 1982. There being none, Pete Anderson made motion to accept minutes as written. Myrna Cain seconded the motion, with all members voting in favor. PUBLIC HEARING ITEM: 1. HURLEY HAMILTON, 4656 TARGHEE PLACE, REQUEST FOR A CONDITIONAL USE permit to place a mobile home on his property was withdrawn at the request of Mr. Hamilton. 2. LINDAY MOODY, 5042 PLEASANT VIEW, IS REQUESTING A CONDITIONAL USE permit tO operate a ten child Pre School in her home. Property is presently zoned Limited Residential (R-l). Commission Member Pete Anderson asked to abstain from motion and discussion on this item, as he lives within the three hundred foot area that notices were mailed to. Linda Moody stated she wished to operate a ten child Pre School in her home for two hours per day. She said that it would be similar to the MontesSori program. She said they would remodel their garage for the Pre School, that there would be no structural changes made in their home. Mr. Moody said the garage was partially completed and that a minimal amount of changes would be needed. Commission Member Janet Williams asked if a license was required from the State of Idaho for a Pre School. Mrs. Moody rePlied that their was no such license required. Commission Member Myrna Cain asked if the Pre School would be for neighborhood children only. Mrs. Moody said it would be primarly for the neighborhood children but it would not be limited to just neighborhood, and that she did not feel it would have any affect on the traffic, as most children that were brought by car were in car pools. PUBLIC HEARING - LINDA MOODY - PRE SCHOOL CONDITIONAL USE PERMIT Chairman Stalder asked for testimony in favor of the Pre School. Brenda Clark, 4969 Pleasant View, said she had no objection to the Pre School and that she did not see any traffic problems developing. She said most of the children that would be attending would be within walking distance. Judy- Smart, 5208 Pleasant View, said that Mrs. Moody was good with the children, and she felt the children deserved to have the best instructors possible. She also said she could see no problem with the traffic increasing. Chairman Stalder then asked for testimony against the Pre School. Linda Gustafson, 5140 Pleasant View, stated they had bought their home in the Bunce Subdivision because it was a restricted zone. She said she did not like to see a precedent set. Gary Seymour, 5069 Pleasant View, said he had no objection if the children came to the Pre School from within the subdivision and if conditions could be put on to limit to such. He said the street was not a through street and he was concerned with the traffic if people started bringing their children from other areas. Linda Gustafson said she did not think their would be enough children in the subdivision to support a Pre School over any period of time. Linda Moody said the Pre School would be limited to ten children, for two hours a day, four days a week. Margaret Beebe, 1001 Willow Lane, Pocatello, said she brought her children out to Mrs. Moody and she would not 1.ike to see it limited to the Bunce Subdivision. Mrs. Moody said a cooperative had been in operation for about three years, where the mothers took turns teaching the children. Dan Beebe, 1001 Willow Lane,said Mr. Moody had taken a petition around the neighborhood and that the neighbors did not object to the Pre School Mr. Moody showed the Commission the petition but took it back as he wished to contact more people. Dwain Kinghorn, City Councilman, discussed with the Commission and the people in the audience the need for Day Care Centers, Pre Schools, etc. He commended the Moody's for asking for a conditional use permit, rather than just going ahead and operating without approval. Ron Nelson said we need to have laws to govern; but sometimes there are so many restriction on people they are not able to do the things they wish to do with their own property. He said he felt there could be conditions and a review every year if conditional use permit is granted. PUBLIC HEARING - LINDA MOODY - PRE SCHOOL CONDITIONAL USE PERMIT Public Works Director, Steven M. Smart, explained the Code governing the amount of Children and the requirements of operation.' Ron Nelson made motion to recommend to the City Council for approval the conditional use permit for Linda Moody to operate a Pre School from her home at 5042 Pleasant View, with the conditions that a review be held each year and that the classes be limited to ten children for two hours daily, four days a week. Myrna Cain seconded the motion. Chairman Stalder asked for roll call vote, Nelson, yes; Cain, yes; Williams, no; Stalder, yes. OTHER BUSINESS: REVIEW OF VARIANCE GRANTED CHRISTINA PFIEFER TO OPERATE A ONE CHAIR BEAUTY Salon from her home, 135 Stuart Avenue. Mrs. Pfiefer was present and a discussion followed on parking on Fern Street. Mrs. Pfiefer said her ladies had been parking diagonally and that the police had issued citations. She said sometimes it is difficult to park parallel. Mrs. Pfiefer was told that Fern Street is a dedicated street and that diagonal parking would not be allowed. Pete Anderson made motion to renew the variance of Christina Pfiefer to operate a one chair Beauty Salon from her home at 135 Stuart. Janet Williams seconded the motion, with all Commission Members voting in favor. DESIGN REVIEW FOR CONVENIENCE FOOD MART (CFM), AT PINE RIDGE MALL, presented by Bob Awes, with the firm of Cedric Allen Architect. Commission Members discussed with Mr. Awes the construction of the Food Mart. Members were concerned that no green area was shown on the drawings. Janet Williams made motion to recommend to the City Council for approval the Design Review for Convenience Food Mart (CFM), at the Pine Ridge Mall, with a ~nimum four foot green area on the north and east side of building. Myrna Cain seconded the motion, with all Commission Members voting in favor. DESIGN REVIEW FOR SIGN FOR CONVENIENCE FOOD MART (CFM), AT PINE RIDGE MALL, Presented by Bob Awes, with the firm of Cedric Allen Architect. Mr, Awes said the sign would be on the north side of the building, would be mounted on the canopy facade and be self luminated. Janet Williams made motion to recommend to the City Council for approval the Design Review of Sign for Convenience Food Mart (CFM), at the Pine Ridge Mall. Pete Anderson seconded the motion, with all voting in favor. OTHER BUSINESS: REVIEW OF VARIANCE GRANTED RICK L. SLAVEN, MARCH, 1977, TO PLACE A MOBILE HOME at 147 W1 Linden, for residential purposes. Mr. Slaven was not present. Pete Anderson made motion to table review of Mr. Slaven variance, that a registered letter be sent to him, requesting his presence at next Commission meeting, November 4, 1982. Janet Williams seconded the motion, with all Commission Members voting in favor. CONSIDERATION OF PROPOSED CHANGES IN ZONING OF BANNOCK COUNTY THAT MIGHT BE in conflict with the Chubbuck Comprehensive Plan. Commission Members discussed the proposed changes, but not being sure as to the current standing with Bannock County this item was tabled until a later date. Pete Anderson made motion to adjourn at 10:05 p.m., Ron Nelson seconded with all Commission Members voting in favor. H.
