HomeMy WebLinkAbout011 18 82LAND USE & DEVELOPMENT COMMISSION MINUTES November 18, 1982 Minutes of the regular meeting of the Land Use and Development Commission held in the city municipal building, November 18, 1982. Present: Chairman Richard Allen, Commission Members: Dwain Kinghorn, Ronald Nelson, Pete Anderson, Myrna Cain, Janet Williams, City Attorney, B. Lynn Winmill, Public Works Director, Steven M. Smart, Commission Member Dee Stalder attended the meeting after 8:30 p.m. Chairman Allen called the meeting to order at 8:05 p.m. Chairman Allen asked for any additions or corrections to the minutes of October 8, 1982. There being none, Janet Williams made motion to accept minutes as written. Myrna Cain seconded the motion with all commission members voting in favor. PUBLIC HEARING ITEM: A HEARING WITH REGARD TO THE PROPOSED REVISION OF THE CITY OF CHUBBUCK'S LAND USE ORDINANCE. Chairman Allen asked for public comment in favor of the proposed revision of the Land Use Ordinance. There being no comment, Chairman Allen suggested the Commission go through the ordinance page by page to see if they had any comment on the area's where changes had been made. Dwain Kinghorn discussed the proposed changes in Child Care Centers and Hobby Kennels. Pete Anderson suggested the ordinance include a definition of vegatation used in screening, he said many areas put in the vegatation to meet the requirements of the ordinance and then let it deteriorate. Jerry Tydeman, Jerry's 4 Wheeler, 5008 Yellowstone, stated he feels city is trying to put him out of business with this ordinance. Attorney Winmill assured Mr. Tydeman that the city had no such plans, that if he was in compliance with the City Ordinances h~s.~.bus~ness would not be affected. He suggested Mr. Tydeman's attorney, Mr. Tydeman and himself get to together and discuss his problems. Commission members spent considerable time discussing "Vehicle temporary storage site", page six. They were concerned if 30 days was sufficient time for repairs on a vehicle and the 25% fair market value of a damaged vehicle. Dwain Kinghorn asked the Commission to make their decision on this item without his comment as he is a neighbor of Mr. Tydeman. Pete Anderson made motion to change Section 1-5: Definitions, (z) (aa) "Vehicle temporary storage site" change 30 days to 60 days. Dee Stalder seconded the motion, with all Commission Members voting in favor. PUBLIC HEARING ITEM - continued Janet Williams made motion to recommend to the City Council for their approval the proposed revision of the City of Chubbuck's Land Use Ordinance With the change in Section 1-5: Definitions (z) (aa) from 30 days to 60 days and a definition of Vegatation be included in the ordinance. Myrna Cain seconded the motion, with Commission Members .voting, Nelson, Yes; Stalder, yes; Anderson, yes; Williams, yes, Cain, yes. Allen, yes.
