HomeMy WebLinkAbout005 06 82LAND USE & DEVELOPMENT COMMISSION MINUTES May 6, 1982 Minutes of the regular meeting of the Land Use and Development Commission held in the city municipal building, May 6, 1982. Present: Chairman Richard Allen, Commission Members: Dee Stalder, Myrna Cain and Robert Allen, City Attorney B. Lynn Winmill, Public Works Director Steven M. Smart and Secretary Dorothy Ward. Pete Anderson and Janet Williams were excused. Meeting called to order at 8:00 p.m. by Chairman Allen. Chairman Allen asked for any corrections or additions to the minutes of the meeting held February 4, 1982. Mrs. Ward called attention to a correction that had been made at the request of Steven Smart on page two of the minutes. Minutes should have read - Mr. Watt said they would need about 100 feet of space between towers in direction of wind flow, and only about 20 feet if perpendicular to direction of wind. Dee Stalder made motion to accept minutes as corrected. Myrna Cain seconded the motion. All commission members voted in favor. PUBLIC HEARING: Proposed revision of the City of Chubbuck's Land Use Ordinance; an ordinance repealing Ordinance No. 205, and amendments thereto, and enacting a Revised Land Use Ordinance of the City of Chubbuck, regulating land use within the jurisdiction of the City. Chairman Allen in reviewing the ordinance with Commission Members asked for their recommendations on the changed areas, that had been marked in the ordinance. The following recommendations were made: SECTION 1-5: Definitions, page two, (i) "Kennel" strike animals, on last line, add dogs. (p) structure intended for human occupancy or use - should not have been changed. Chapter Two, SECTION 2-1: page six, (b) after household dwellings, add Class I Production Building. SCHEDULE OF GENERAL CONTROLS - Page 10 Government Facilities, under C-2 change Permitted to Conditional Class III (within Production Building Cluster Arrangement) under A change Conditional to Permitted and R-2 change Conditional to Permitted. Chapter III - SECTION 3-2, page thirtee~ (e) add - Such structure may exceed the height limitations provided for in this paragraph, only upon issuance of a conditional use permit as herein provided. SECTION 3-3, page 14, (b) Kennels - (1) after motels and hotels, add, any residential structure provided for human occupancy. (c) Bulk Storage - (2), page fifteen, after Uniform Fire Code add, as adopted by City of Chubbuck. (h) Production building cluster - page seventeen, (9) strike building permits, add a conditional use permit. (10) strike connector and add collector. (1) Salvage Sites -page eighteen, (2) after one (1) acre, add, and shall not be located any closer than 5000 feet to any other existing salvage site. The commission discussed the requirements for a kennel and how many dogs that should be allowed. They expressed concern that three dogs constitue a kennel, under this ordinance, they said that often people have two hunting dogs and a house dog. Dee Stalder made recommendation to the City Council to consider four dogs rather than three dogs as a kennel; and also to look at the city records as to how many people this would effect. Robert Allen seconded the recommendation with all voting in favor. SECTION 6-9 - Kennel - page thirty five, strike paragraph, add, After December 31, 1982, no Kennel shall be operated or maintained within any district in which the same is not conditionally permitted. Dee Stalder made motion to recommend to the City Council for approval the Revised Land Use Ordinance with the changes that have been recommended. Myrna Cain seconded the motion. Stalder, yes; Robert Allen, yes; Cain, yes; Richard Allen, yes. Motion was made by Myrna Cain at 9:50 p.m. to adjourn, Dee Stalder seconded, with all commission members voting in favor.
