February 4, 1982
Minutes of the regular meeting of the Land Use and Development Commission
held in the city municipal building, February 4, 1982.
Present: Chairman Richard Allen, Commission Members: Dee Stalder, Mike
Metcalfe, Robert Allen, Pete Anderson, Myrna Cain, Janet Williams, Public
Works Director Steven Smart and Secretary Dorothy Ward.
Meeting called to order at 8:00 p.m. by Chairman Allen.
Chairman Allen asked for any corrections or additions to the minutes of the
meeting held January 7, 1982. There being none, Janet Williams made
motion to accept minutes as written. Pete Anderson seconded the motion
with all commission members voting in favor.
PUBLIC HEARING ITEM:
1. AN APPLICATION BY JAMES CLOSE, FOR A CONDITIONAL USE PERMIT to place
a wind electrical generator on his property at 739 E. Chubbuck Road.
Property is presently zoned Limited Residential (R-l).
Mr. Close was present and stated he was interested in erecting the wind
generator for energy'conservation purposes. He said Federal Government
had asked citizens to conserve and he felt this was a cost effective
method to do so.
Phillip S. Watts, Western Liberty, Pingree, Idaho, Contractor of job,
discussed with the commission members different aspects of the job. He
said.the system would phase in with Idaho Power. It would be a free
standing tower, they would keep the base small for eye appeal. He said
system would be most cost effective at 60 feet, that it would give a
better pay back. That at 100 feet,the cost of material, the pay off
would not be there.
Mr. Watts said the system automatically shuts itself down, that it will
produce at $1200.00 worth'of electricity a year. With the wind blowing
hard it would produce a maximum of 10 kilowatt, which will feed back
into the power line if not being used. He said the meter will run
backward and the agreement with Idaho Power is they will buy the
additional power created. He said with a 40% tax credit, the pay
back should be three to four years based on the current price of
electricity.
Mark Bunce, 755 E. Chubbuck Road, asked about maintenance of the system
and about the noise that would be created.
Mr. Watt said the system is designed for very little maintenance. He said
there would be some noise bUt he had no good figures at~his time. He
said the housing would be at the top of the tower; therefor he didnot
think there would be a noise problem.
PUBLIC HEARING - JAMES CLOSE, electric wind generator - continued.
Mike metcalfe said he personally approves of anyone having the ability
to sustain themselves; but he felt the commission should use caution
in setting a precedent in allowing this wind generator.

Pete Anderson asked Mr. Watt how close together towers could be placed
if other people in the area would be interested in installing them.
Mr. Watt said they would need about 100 feet of space between towers ih direction

Mr. Anderson asked Mr. Watt about the safety features. Mr. Watt said if
Idaho Power looses its power the system will automatically shut
down. There will be no visible power lines. He said they have a
contract with Idaho Power, if system not operating safely Idaho
Power can open up the system.
Mr. Dahl Zohner, 701E. Chubbuck Road, expressed concern abouth the
aesthetics of their neighborhood if towers similar to this tower are
erected on other neighbor's lots.
Mr. Dean Groesbeck, 750 E. Chubbuck Road, said he wished to go on record
as opposing the granting of the conditional use permit.
Mike Metcalfe made motion to recommend to the City Council the conditional
use permit for James Close, 739 E. Chubbuck Road, be granted to
erect an electrical wind generator. That it comply with all construction
standards of the City of Chubbuck, that the tower itself not to exceed
60 feet in height. Robert Allen seconded the motion, with Commission
Members voting as follows, Stalder, yes; Metcalfe, yes; Robert Allen,
yes; Anderson, no; Cain, yes; Williams, yes; Chairman Allen abstained
from voting.
Mark Bunce, 755 E. Chubbuck Road, asked the commission members if they might
be in favor of amending the Land Use Ordinance to allow towers of over
35 feet. After some discussion the members expressed the opinion that
control was needed and conditional use permits should be asked for.
Dee Stalder made motion to adjourn at 9:00 p.m., Janet Williams seconded
the motion with all commission mem~
