September 1, 1983
Minutes of the regular meeting of the Land Use and Development Commission
held in the city municipal building, September 1, 1983.
Present: Acting Chairman Thomas Nield, Commission Members: Dee Stalder,
Ron Nelson, Robert Allen, Pete Anderson, Public Works Director Steven
Smart, Secretary Dorothy Ward. Janet Williams was excused.
Meeting called to order by Chairman Nield at 8:15 p.m.
Chairman Nield asked for any additions or corrections to the minutes of
August 4, 1983. There being none, Dee Stalder made motion minutes be
approved as mailed out. Pete Anderson seconded the motion, with all
commission members voting in favor.
PUBLIC HEARING ITEM: AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING
CHUBBUCK CITY ORDINANCE NO. 241 (Land Use Ordinance) by modifying the
schedule of General Controls in Section 2-3(b), and to show Animal Care Sites
and Commercial Kennels as conditionally permitted uses in an
Agricultural Land Use District and to modifythe provisions of Chapter 7
concerning hearing procedures for consideration of applications for variances,
conditional use permits,amendments to the Land Use Ordinance and revisions
to the city's Comprehensive Plan.
Ordinance No. 219 was read in full by Chairman Nield.
Chairman Nield asked for public comment, there being none, he then asked for
discussion from the commission members.
Commission Members discussed the changes in the ordinance.
Ron Nelson made motion to recommend to the City Council for their approval
the changes in Ordinance No. 219, with the typographical errors and
misspelled words to be corrected. Robert Allen seconded the motion.
Allen, yes; Anderson, yes; Stalder, yes; Nelson, yes and Nield, yes.
OTHER BUSINESS:
1. The Public Hearing for a change of zoning of property located at
225 E. Chubbuck Road, that Arshad Ali is contract purchase~ of property.
This item was tabled August 4, 1983 until the City Engineer could determine
where the dividing line was between Commercial and Industrial Zone.
A map was shown to the commission members showing the property to the west
of Mr. Ali's property was a split zone. It was determined this property
owner would have to request his property either be Commercial or
Industrial.
Commission Members discussed spot zoning.

Dee Stalder made motion to recommend to the City Council they approve the zoning change of Mr. Ali's proposed property, 225 E. Chubbuck
Road, to Commercial provided that it can be tied in with existing property
that is commercially zoned to the west.
Ron Nelson seconded the motion. Nelson, yes; Stalder, yes; Anderson, yes;
Allen, yes; Nield, yes.
Motion made to adjourn at 9'30 p.m. by Pete Anderson, seconded by Robert
Allen. All commission members voted in favor.
