Lynn Winmill. Public Works Director Steven Smart. Secretary Mvrna CraDo. Janet Williams was excused. Meeting called to order at 8:09 p.m. by Chairman AndersOn PUBLIC HEARING ITEM: REVIEW OF PRELIMINARY PLAT FOR THE COWBOY OIL SUBDIVISION, owned by Hancock-Geisler, 2605 So. th, Pocatello, Idaho. Subdivision located in the 100 Block of East Linden, on the corner of East Linden and Yellowstone Avenue. Chairman Anderson as for imput from the City staff. Engineer Steve Smart informed the commission that they wanted to build a truck wash on this property. The comprehensive plan has a projected street shown. BecauSe this~a corridor th~'the~comprehensive plan would like to preserve and has that impact on the comprehensive plan a preliminary plat is required. The corridor is east of the proposed building. The building is inside the Bonniebrae Acres that was plated in 1926. This has been divided into at least 3 or 4 parcels. The corridor goes through lot 2 and is. 50' in Width. Chairman Anderson aSked for comments from the Developers. Mr. Dav~ Platt of Forsgren and Perkins stated that at the present .there are 3 houSes in the way of the road right of way. tf Mr. Hancock was going to limit' the use of his property at this time,~ there ought tOa~ ~ n agreement made as to the worth of the property th e damaged. Mr. Marty Ward representing Mr. A1 Stapp of Chubbuck Pro Wash stated that there is only 30' from the building to proposed road and that it takes 70' to turn a semi around. If the road is put in it will put the truck wash out of business. Mr. Hancock feels it is premature with all factors involved to locate a corridor in the area. The owners can indicate a place for a corridor on the east end (block 2). If a corridOr was put in the truCks would have to turn onto the road. Chairman opened the meeting to public comments. Don Andra of 133 E. Linden expressed concern for the road stating that he felt it was not fair to businesses. > CQW~OY OIL SUBDIVISION - REVIEW OF PRELININARY PLATT (cont.) Fred Rader - Butte, Montana wanted.to park'truCkS on this property and leave them over night. Keith Ankrum-- 4612 Yellowstone stated that the proposed road. would cut.across his property and he doesn't feel the rOad should be put in as it would drOp the property value. Chairman Anderson closed the public hearing asking for comment from the commission members. Attorney Winmill stated that the City would have to put out a lot of money to acquire the land and at this time the city doesn't have any new money. If the city were to exclude these individuals from the fair use of their property we would be in inverse condemnation. They would be entitled to compensation now. The city needs to look at realistic alternatives now and amend the comprehensive plan for the future so the roadway can be constructed. Chairman Anderson pointed out that Kingsway is the only land appropriated or dedicated for this corridor. Engineer Smart stated that the lands were divided into there current status long before any state or city subdivision ordinance. This issue is enforce because of the way the comprehensive changed plan is written and that's why its here. The comprehens~.ve Plan has in the last several months. If the commission doesn't feel like the city ought to be addressing this problem at this time then hewould recommend that the plat not even be completed. We could eliminate that because all of these properties were in place well before any state or city subdivision ordinances were in force. Robert Allen questioned if there is a no need for a subdivision would there be a need to vacate. Robert Allen made a motion to recommend to the City Council that they determine that this does not impact the comprehensive plan and therefore a plat is not required under the ordinance and that it be determined in the near future what they wanted to do with the roadway. Sue Parrish seconded the motion. Roll Call vote: Parrish, yes; Cain, yes; Anderson, yes; Allen, yes; Hopkins, yes. OTHER BUSINESS: The PROPOSAL BY STEWART NELSON, 11631 Nelson Lane, Pocatello, Idaho, for a conditional use permit to place 4 plex Units on the west 550 feet of Lot 18 Block 1, Paradise Acres Subdivision. Property is presently zoned General Residential (R-2) STEWART NELSON CONDITIONAL USE PERMIT (cont.) Chairman Anderson was informed by the City that the City hadn't received anything from Mr. Nelson and that Mr. Nelson was not in attendance, so the hearing was tabled until the June 6 meeting. STUDY AND RECOMMENDATIONS ON IMPOSING a percentage limitation on DuPlexes and multi-family dwellings in R-1 aod R-2 districts through the city. The Commission discussed Conditional Use Permits, Percentage of Housing and made recommendations to Attorney Winmill. Adjourned at 9:30 p.m. y na Cr~po, Secretary
