May 2, 1985
Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building, May 2, 1985.
Present: Chairman Pete Anderson, Commission Members: LeRoy S.
Quick, Council Representative, Myrna Cain, Sue Parrish, Robert
Allen, Ron Nelson, City Attorney B. Lynn Winmi!l, Public Works
Director Steven Smart, Secretary Dorothy Ward. Becky Hopkins,
Janet Williams and Dee Stalder were excused.
Meeting called to order at 8:00 p.m.by Chairman Anderson.
Chairman Anderson asked for any aditions or corrections to the
minutes of April 4, 1985. There being none, Myrna Cain made
motion to accept minutes as written. Sue Parrish seconded the
motion, with all commission members voting in favor.
PUBLIC HEARING ITEM:
PROPOSAL BY DELORES J. BARRUS FOR A CONDITIONAL USE PERMIT
TO OPERATE A DAY CARE CENTER AT 4562 Burley Drive, Chubbuck,
Idaho. Property is presently zoned General Residential (R-2).
Chairman Anderson asked for comment from the city. Steve Smart said
he and the Building Inspctor, Cary Campbell had discussed as
length Mrs. Barrus's applicationfor a day care center. He
said Mr. Campbell had indicated a number of things that would
need to be done to bring the building up to code. He said
each time a conditional use request comes in for a day care center,
there are a number of things that need to be done to bring the
building up to code.
Chairman Anderson asked for comment from Mrs. Barrus.
Mrs. Delores Barrus, 4562 Burley Drive, said they had installed
an additional .entrance on the north side of the house, the
garage is being finished and the yard will be completely fenced.
She said she had talked to the State office and they had informed
her about smoke alarms, rooms required, and fire extinquishers,
and the bath rooms required.
She said the basement would have sheetrock and electric heat.
Robert Allen asked Mrs. Barrus if she would have any problem
bringing the house up to code. She said whe would not, that
she would like the building inspector to come over and go over
the requirements with her.
Mrs.Barrus said they would provide parking for three cars on the
north side entrance. She said four cars could park in the
driveway.

Chairman Anderson asked for comment for or against the conditional
use permit for Delores J. Barrus. There being none° public
hearing was closed.
Chairman Anderson asked for comment from the commission members,
Commission members discussed the parking situation. They indicated
a turn around should be made so cars would not be backing out
after dropping children off.
Sue Parrish asked about the old buildings on the lot, if they would
be a fire hazard°
Robert Allen said it appeared there were numerous things that would
need to be done to bring home up to code.
Commission members discussed the traffic problem on Burley Drive,
and the fact that area has commercial property at the present.
Robert Allen made motion to approve the conditional use permit for
Delores J. Barrus, 4562 Burley Drive, Chubbuck, Idaho, to
permit her to operate a day care center with the following
stipulations, building to meet all building code requirements
of the City of Chubbuck, yard ~ be completely fenced with child
pruf fencing, to meet state or local laws, statues or regulations,
including health department requirements. Adequate parking,
with access for cars to be able to turn around, and parking
requirements to meet the Land Use Ordinance. Conditional Use
Permit to be reviewed on a yearly basis.
Ron Nelson seconded the motion. Roll Call vote: Parrish, yes;
Cain, yes; Quick, yes; Nelson, yes; Allen, yes; Anderson, yes°
PUBLIC HEARING ITEM:
PROPOSAL BY STEWART NELSON, 11631 NELSON LANE, POCATELLO,
IDAHO, FOR A CONDITIONAL USE PERMIT TO PLACE 4-PLEX
Units on the west 550~ feet of Lot 18 Block 1, Paradise
Acres, Chubbuck, Idaho. Property is presently zoned
General Residential (R-2).
Chairman Anderson asked for comment from City Staff. Steve Smart
said he had briefly looked at proposed layout;there were two
or three things that need to be addressed. He said Mt.Ne!son
had shown 24 4-Plex structures, each structure would require
13,500 square feet per building. The amount of land Mr. Nelson
has would allow only 16 buildings with a total of 64 lying units.
He also stated that this parcel ~ land is platted in Paradise Acres,
and the 5 acres would only be about 5% of land in Paradise
Acres, therefore the moritorium on multiple housing would
not apply to this application. He said there may be an ambiguity
in the ordinance with a driveway defined as a street, a private
street not public; if defined as a street city may require
a cul-de-sac or turn around at the end of street. He said
the land had already been platted therefore it would not have
any affect on the Comprehensive Plan.
STEWART NELSON - conditional use permit for 4-Plex Units
Mr. Nelson said he would like to develop in three phases. Commission
members discussed with Mr. Nelson the parking and where garbage
dumpsters would be placed. He said the area shown for storage
units would be for tenants to rent for storage.
Attorney Winmill suggested to Mr. Nelson he might consider a
Planned Unit Develoment; that way he could get aroung the
square footage requirement; but that it would require more
planning.
Chairman Anderson asked for public comment.
Robert Guaterex, 5674 Eve, said he was against the high density;
said he felt it would reduce the value of their home. He asked
when the zoning had been changed, said he had not been notified.
Mr. Guaterex's name was on mailing list, and Attorney Winmill
informed him city had met the requirement. Letter had not been
returned to city.
Randall L. Cannon, 195 Abraham, said he opposed ~e 4-Plex units
behind his home. Said he was concerned about the property
values.
Van Vanderwood, 208 Abraham, said he had been informed by other
people, concentrated areas such as this, caused police problems.
John D. O'Hearn said they had not been notified of meeting; the notice
had come addressed to their son.
Stewart Nelson said he felt multiple family residents should be
concentrated in one area. He said the homes involved
would have their back yards facing the ~-Plexes
are fenced~ with screen type fencing.
Public hearing closed.
Attorney Winmill said the commission could require dense screening
of trees and shrubs in a~aadjoining the land owners, similar
that was required of Cottonwood Cove.
Sue Parrish said she was not sure she goes ~ theory all multiple
housing should be in one place, that it made area to dense.
She said she felt it was better to intergrade into all zones.
Chairman Anderson said there were several areas he was concerned
about.
Commission members discussed the set back requirements.
Attorney Winmill said it might be better towait and see the proposed
less dense area and whether to approve over objections of residents.
He said the Land Use Ordinance provides that the adverse affect
on property values and neighbors is something that should be
taken into account.
Ron Nelson made motion to table the request of Stewart Nelson for

a conditional use permit to place 4-Plex Units on the west 550
feet of Lot 18 Block 1, Paradise Acres Subdivision, Chubbuck,
Idaho, until May 9, 1985 at 8:00 P.M. Mr. Nelson to address
the following items:
a) Re-drafted site plan
b) Density
c) Green Area
d) Buffering between residential & multiple family
e) Adequate Lighting
f) Cul-de-sac at end of driveway
g) Drainage
h) Set Backs
i) Sidewalks
j) General aesthetics of area
Myrna Cain seconded the motion. Roll call vote: Nelson, yes;
Allen, yes; Quick, yes; Cain, yes; Parrish, yes; Anderson, yes.
OTHER BUSINESS:
1. Attorney Winmill and the Commission discussed the
memorandum prepared by Attorney Winmill regarding
the proposed amendments to Land Use Ordinance for control
of density in Residential Land Use Districts.
Attorney Winmill asked commission members to have comments ready
for May 9 meeting.
