Present: Chairman Pete Anderson, Commision Members: Becky Hopkins, Sue Parrish, Dee Stalder, Myrna Cain, Janet Williams, Robert Allen, Public Works Director Steven Smart, City Attorney B. Lynn Winmill, Secretary Dorothy Ward. Chairman Anderson called meeting to order at 8:00 p..m~ Chairman Anderson asked for any aditions or corrections to the minutes of December 6, 1985, there being none, Janet Williams made motion to accept minutes as written. Myrna Cain seconded the motion, with all commission members voting in favor. PUBLIC HEARING ITEM: 1. PROPOSAL BY KENT J. PARRISH, PRESIDENT OF LAND INVESTMENTS,INC., FOR A LAND USE DISTRICT CHANGE ON LAND EAST OF THE HILINE CANAL between Chububck Road and 1-86 Interstate, located on the southeast corner of Chubbuck Road and Hiline Road. Land east of Buffalo Road to be zoned Limited Residential (R-l), land west of Buffalo Road to be zoned General Residential (R-2). Property is presently zoned AGRICULTURAL (A). Chairman Anderson asked Steven Smart for comment, he said about 1½ to 2 years ago, Land Investments had come in for a Land Use Change on this property to General Residential (R-2)~ they had been turned dowel at this time, for two reasons. The residents in area requested a Limited Residential (R-l) zone, and it had not been advertised for R-1 and the City Council wanted a more specific proposal as for development. He said, Land Investments, Inc. had now come in with a specific proposal, as had been requested, with the ground that was zoned Agricultural to be zoned Limited Residential (R-l) in part and General Residential (R-2) in part. Kent Parrish, President of Land InvestmentS, Inc., said the statement of Steven Smart was correct, the land above Buffalo Road to be R-Iand below R-2. He said property adjoining other property %~ould be R-1. Chairman Anderson opened public hearing for comment for or against proposal. Mabel Falter, 707 Norcrest, said she was a Realtor as well as being a home owner in the area. She said she would like to know how this development would affect her home. She said her home would be affected if multiple housing was allowed.~ She was ~ told multiple housing was not permitted in R-1 zone and only conditionally allowed in R-2 zon~ PUBLIC HEARING ITEM: LAND INVESMENTS, INC. LAND USE CHANGE. Michael Johnson, 723 Bedford, questioned if the Comprehensive Plan showed this property as R-2, he said it was his under · standing that it was all R-1. Steve Smart said there was a small strip of east of the canal that is R-2. Fred Falter, 707 Norctest,asked if R-2 zone would permit a mobile home park. Attorney Winmill that a mobile home park would be allowed in an R-2 zone, however a mobile home court probably would not fit into area because of the restriction in the ordinances for a mobile home court. He said if this was a concern it could be a part of the findings of fact and conclusions of law of this meeting that a mobile home park could not be developed on this small strip of land. Carol Johnson, 723 Bedford, said the reason they had come to the meeting is because they are concerned for their property, the aesthetic value, the value of their homes because they are against multiple family dwellings and rentals~ She said they would like to protect the view. Chairman Anderson closed the public hearing from commission members. and asked for comments Attorney Winmill read the requirements for a mobile home park. It indicates screening should be a solid screen fence, it also indicates that no court allowed where access is by a local road as opposed to an arterialc~rcollector street. Would be a precluding fact as access would be off from Buffalo Road which would be a local road~ He said it was pretty clear that no mobile home court could be allowed in this area. Commission members discussed: 1. Easement of canal company 2. Canal being piped 3. The zoning in the comprehensive plan 4. Production Dwellings Chairman Anderson said commission would have to determine the correct zoning in the comprehensive plan. Janet Williams made motion to table the request of Land Investments, Inc., for a Land Use District Change on land east of the Hiline Canal between Chubbuck Road and Interstate 1-86, located on the southeast corner of Chubbuck Road and Hiline Road, until March 7, 1985 and research be done to determint the designation of strip of land in the comprehensive plan. Myrna Cain seconded the motion. Roll call vote, Hopkins, yes; Allen, yes; Williams, yes; Cain, yes; Stalder, yes, anderson, yes~ Parrish abstained. PUBLIC HEARING ITEM: 2o Review preliminary plat for Hiline Heights Subdivision, same address as above item. Janet Williams made motion to table the review of preliminary>f plat for HilineHeights Subdivision until the March 7, 1985 meeting until zoning in comprehensive plan resolved. Becky Hopkins seconded motion. Stalder, yes; Cain,yes; Williams, yes; Allen, yes; Hopkins, yes; Anderson, yes° Parrish abstained. PUBLIC HEARING ITEM: 3. PROPOSAL BY ROGER SEATON, 1377 QUINN ROAD, POCATELLO, IDAHO, FOR A CONDITIONAL USE PERMIT TO PLACE 3 4 PLEXES ON 3 LOTS LOCATED west of Hawthorne Road and north of Chastain Drive. Property is presently zoned R-2o Chairman Anderson asked Steve Smart for comment. He said area was zoned R-2 and fourplexes were conditionally allowed. Mr. Seaton said property is pretty well designated as what it is going to be, everything around it is multiple family dwellings except for the home on Lot 4 of the Chastain Park Subdivision, and Chubbuck Elementary School. Chairman Anderson opened meeting for public comment. Rodney Parrish, 689 E. Chubbuck Road, said if Mr. Seaton had met all the requirements, he should be allowed to build. Chairman Anderson closed public hearing, and asked for comments from commission members. The findings of fact and conclusion of law having been met, Robert Allen made motion to approve the conditional use permit of Roger Seaton to place 3 4 plexes on 3 lots located west of Hawthorne Road and north of Chastain Drive~ Janet Williams seconded the motion. Hopkins, yes; Allen, yes; Williams, yes; Cain, yes; Parrish, yes; Stalder, yes; Anderson, yes. pUBLiC HEARING ITEM: 4. REVIEW PRELIM~ PLAT FOR CHASTAIN PARK SUBDIVISION, same address as above. Steve Smart informed the commission members the north half of Chastain Drive had never been dedicated to the city. When the Hawthrone Terrace Apartments had been built, the south 25 feet had been dedicated to the city. The city would also iike to have an additional 8 feet on Hawthorne Road dedicated to city, in comprehensive plan it calls for this road to be 66 feet. Attorney Winmil! Chastain Drive would have to be dedicated to city PUBLIC HEARING - CHASTAIN PARK SUBDIVISION -continued as four lots were being developed and they would need to have access to a public right-of-way. Commission members discussed the following: 1. The water line on Chastain Drive 2. The traffic generated by the four plexes Becky Hopkins made motion to recommend to the City Council for their approval the Chastain Park Subdivision, subject to determination of proper dedication to Chastain Drive and Hawthorne Road. Motion died due to lack of second. Becky Hopkins made motion to recommend to the City Council for their approval the Preliminary Plat for Chastain Park Subdivision subject to the following conditions: 1. A payment by the devloper in an amount determined under the provisions of our ordinances, which would be in lieu of dedication of park land. 2. Determination of what dedication would be required on Hawthorne Road and Chastain Drive , under ordinance° Janet Williams seconded the motion. Review of conditional use permit granted Bicycle City, Victor Herbert, to develop a Bicycle Motocross Track on Lot 4 Block 1, Pine Ridge Mall Development, behind and adjacent to Pine Ridge Mall. Permit granted May 5, 1983 subject to yearly review. Mr. Herbert was present and answered questions of the commission. Robert Allen made motion that conditional use permit of Victor Herbert, for Bicycle City, to operate a Motocross Track at the Pine Ridge Mall be renewed for two years° Sue Parrish seconded the motion , with all commission members voting in favor.
